The Invocation was given by City coordinator. Marshall. Present: Councilmen Balfanz, Lammers, Peterson. Wohlers and President Powell. Project #1. MSA Street Construction and Water Services. The Clerk informed the Council that the notice for hearing was published in the Stillwater Evening Gazette. official newspaper of the City on September 17, 1971, and a copy was mailed to all known property owners affected on September 15, 1971. The Mayor then opened the hearing. '- MR. ELLIOTT explained that the improvements consisted of construction on MSA streets on Sixth Avenue South from East Orleans to East Churchill and North Second Street from East Wilkin Street to River Heights Drive. This work included curbing. gutters, surfacing, replacement of sidewalks. and replacement of water services and other appurtenances. It is the City's policy to assess $12.50 per front foot for property owners plus any replacement of water services to the property line. The surfacing of Sixth Avenue South is to begin on Friday of this week, a~ North Second Street 1s very nearly completed. COUNCILMAN LAMMERS asked if Mr. Elliott had any idea what the construction costs per foot for this type of street and he was informed that the cost of MSA streets is approximately $70.00 per lineal foot or $35.00 per front foot and of that cost $12.50 is being aasessed and the balance is borne by the State Aid f~nds from gas ta:." money. DONALD BRISTOL, 1121 North Second Street inquired if he paid improvement of North Second Street this year. he questioned assessed again next year when they do Stillwater Avenue. $12.50 ~or the if he would be MAYOR POWELL stated that if there is anything to do with storm water separation then Stillwater Avenue would not be done for a few years when this project is undertaken. The City is holding off on this to get a federal grant. He was informed on his side lot he would be assessed 35% of that footage if that is his long side. . . . . , . 158 . . . (october S. 1971 - continued) JOHN SELLECK, 1211 North Third Street questioned his was informed that he would be assessed for the water street work. water service and he service only and not MRS. CHARLES COLOMBO, 910 Sizth Avenue South questioned the assessments for the water services and the street work, and Mr. Marshall told her that her assessment would be $1.000.00 for the street work and $248.19 for the water service of copper tubing to the property line. She further complained that they dug only one trench for their water service and the neighbors and felt this cost was very high for some copper tubing for these services. Mr. Marshall further explained that each property owner that received a water service is sharing the cost of the total project ana not necessarily the cost of just the service to the property line. MRS. JOHN CONNERS, 923 Sixth Avenue south stated she and her deceased husband are paying for the sewer for the second time. She inquired about her assess- ment and she was told it is $650.00 for the street and $248.19 for the water service for a total of $898.19. MR. BRZSTOL questioned the interest rate and time for payment and was informed the rate of interest is 6~ and the assessment will be spread over ten years. CHARLES TURNBLAD, 927 Sixth Avenue South asked about the bill for '130.00, which he received from the Board of Water Commissioners and whether or not this had any bearing on the $248.19 figure and he was informed that this charge of $130.00 was for the service from the property line to his house, and is billed separately by the Water Department. The $248.19 is the water service from the watermain in the street to the property line. He also asked whether ~r not they would have a aunfaced street and sidewalks this fall, and Mr. Elliott stated they hope to have it finished, weather permitting and if the sidewalks are not completed the contractor will have to make some tempprary arrangements so that the people can get in and out of their homes and driveways. MR. KERMIT MORN, 501 North Greeley Street asked that the payment of this assessment be clarified and Mayor powell explained the full procedure for payment. MRS. DAVID BJORKMAN, 916 Sixth Avenue South asked about the replacement of her stairs and also the removal of a tree thae will be uprooting the sidewalk if it is not taken out. The Northern States power Company had come up to take it out but her neighbor told them not to take it out. (Mr. Elliott will check this matter out since he stated that he was aware that one set of stairs was to be replaced but did not know if it was hers.) MRS. CONNORS asked about completing the sidewalks or streets so that she could get out of her driveway, and she was assured that this matter would be taken care of, but if not, she is to call the City Hall and it will be taken care of. COUNCI~ LAMMERS questioned whether there are any streets proposed to be con- etructed where the work hasn't been started as of this date. MR. ELLIOTT stated that there are a number of residential streets where the work will be continued until next year, and not all of these streets will be completed this year. '- COUNCILMAN LAMMERS asked that we require the contractor to complete the work in a given area before moving on to another and that we ask that they stop the work now and clean up the areas that are completed as far as the streets are concerned. MR. ELLIOTTT stated that the clean up is not a pay item - what he is considering doing is to pay them only half of the cost of grading since the filling up of the boulevards is part of the grading costs. (Later in the meeting he was directed to contact the contractor, and get them to finish up the streets that have been under construction and not to start any new ones for this construction season). MRS. CHARLES COLOMBO questioned whether or not they would have to pay these assess- ments before the work was completed, and Mayor powell stated the street maybe done this year, and if not, at least $12.50 per foot of the work is done, and the City pays interest on that money now for t~e bond paymentA. Mr. Marshall further stated that if they allow it to go on the taxes they would not be paying for it until May 31, 1972. On motion of Councilman Peterson, seconded by councilman Wohlers a resolution was introduced adopting the assessment roll for Local Improvement Nos. 98 and 99, project 1 - MSA Street Construction and Water Services with a payment period of ten years at 6~ per annum interest rate. UN?INISHED BUSINESS - MISCELLANEOUS ASSESSMENTS 1. Discussion was held regarding the abatement of the street assessment on Third Avenue for the Robert Davis property and if they are willing to pay a unit assessment should the extension of Dubuque Street be improved then the City will abate this assessment of $404.75. ,~ On motion of Councilman Larmers, seconded by councilman Wohlers the assessment of $404.15 for the Robert navis property. 1029 Third Avenue South. plat No. 9850-6320 be deleted from the Assessment Roll for Local Improvement No. 81. 2. On motion of Councilman LammeJ:s. seconded by Councilman Peterson. abate- ment was authorized for Paul Liberty. 1801 West Olive Street. plat No. 10416-3800 and 10416-4000 in the amount of $1.256.40 on Local Improvement No. 88 (Pine Tree Trail). 3. On motion of councilman Lammers. seconded by Councilman Peterson abatement was authorized for Ruby and Frederick C. Durocher. 1502 West Olive Street. plat No. 10415-5000 in the amount of $239.09 which is the amount of one sewer and one water service. (The Mayor declared a recess from 8:30 to 8:45 P. M.) 4. On motion of Councilman Peterson. seconded by Councilman Balfanz abatement was authorized for George and Margaret Shattuck. 2110 Fairmeadows Road. Plat No. 9611-3150 and 9611-3850 in the amount of $133.98 leaving a balance of $89.32 to be assessed for 8 feet. assessment for Local Improvement No. 91. 5. On motion of councilman Peterson. seconded by councilman Wohlers abatement was authorized for Gilbert Benson. Lake view Drive. in the amount of $861.80 for the sixty (60) foot right-of-way on Local Improvement No. 18 (Pine Tree Trail). 6. On motion of Councilman Balfanz. seconded by councilman Peterson the abate- ment of a portion of the assessment for Irvin Bloom. 1504 West Linden street. Plat No. 9890=3500 and Robert Murphy. 1514 West pine. plat No. 36312D on Local Improvement No. 88 were denied. 1. On motion of Councilman Lammers. seconded by councilman Wohlers the Council denied the request of Independent School District No. 834 for the abatement of the interest on the assessment for Local Improvement Nos. 98 and 99. project 1. MSA Street construction. (Athletic Field - Gixth Avenue South). ~ 8. On motion of Councilman Wohlers. seconaea by councilman Lammers payment of the cost of finding the sewer stub-ins on West Olive Street to the contractors were denied. 9. The Council agreed that the use of the Lily Lake Park by the Little League Football be left to the recommendation of the Recreation commission. 10. The matter of progress on the Orrin Thompson development was discussed and it was agreed that there should be a meeting of the Planning Commission. the City Council and the residents in Fairmeadows on this matter. Mr. Marshall. Mr. Elliott. and Mr. Shelton are to make the arrangements for such a meeting. . ~ 159 . . \ t " . . 1HO . (october 5, 1971 - continued) RESOLUTIONS The following resolutions were reaa and on roll call were unanimously adopted: 1. On motjon of councilman Balfanz, seconded by Councilman wohlers a resolution was introduc~d authorizing the employment of Shirley Montbriand on a temporary basis in the City Clerk's office at a rate of $2.25 per hour. 2. Adoption of the Assessment Roll - Local Improvement No. 98-99 project No. 1 - 1971 - MSA Street Construction and Water Services.
