The Invocation was given by City Coordinator. Marshall. Present: councilmen Balfanz, Lanmere, Peterson, Wohlers and President powell Absent: None Also Present: City Coordinator, Marshall: city Attorney, Kimmel: Superintendent of Public work., Shelton: Director of Public Safety, Abrahamson: Consulting Engineer, Blliott: Director of Parks and Recreation, al.kum. IIrm:IVIDUAIS AND DET.....A'l'IONS MR. ROBBR'l' RICHARDS, 618 East Burlington was concerned about the trees that have been damaged in the area because of the road construction. This matter will be checked into. MRS. ROBERT nAVIS, 1029 Third Avenue South has discussed here assessment with Mr. Shelton and Councilman Lammers and Mr. Shelton wrote a letter to Councilman Lammers, explaining the situation. There is no beilefit nece.SiarilY~.'c!Il!t~inition to the Davis property as they come into their property off a drive from DUbUque Street. There is a serious doubt if the Davis property is benefited by the street above their property. They were assessed for 66 feet. MR. KIMMEL stated that it seems that the situation raises a question that if a street goes past a piece of property, because of the hills and valleys we end up with a street that is not an Qccess to the property that we do by. Ultimately the Davis' are serviced by a public street for which they will never be aBsessed. councilman Lammers stated that there is a platted street into the Robert Davis property by an extension of Dubuque Street. councilman Peterson stated that we have several other assessments of this nature and other problems that are in question and thought it would be much wiser to refer this and all other assessments of this nature to the con9ulting Engineer, Superintendent of Public works, and the City coordinator to study and come up with a recommendation for the next Council meeting. The city coordinator should set a date and time for this meeting and inform the property owners that their assessments will be considered at this time. The date of the meeting will be Tuesday, September 28, 1911 at 1:30 P. M. with the following people: Mr. Nick Junker 433 pine Tree Trail Mr. Robert Richards 618 East Burlington Mr. Irv Bloom 1504 West Linden Street Mrs. Robert Davis 1029 Third Avenue South Mr. & Mrs. Robert D. (September 21. 1971 - continued) " ~ GERRY GALONITZ. 710 West Linden Stree~ appeared before the Council in reference to a catch basin on Linden Street following the work that is being done there. and Mr. Elliott stated he would personally see that there is a catch basin put in there so that the drainage problem is taken care of. UNFINISHED BUSINESS On motion of Councilman Peterson. seconded by Councilman Wohlers the Clerk made the second reading of an ordinance entitled "AN ORDINANCE ADOPTING THE MINNESarA HIGHWAY TRAFFIC REGULATION ACT". ~ The ordinance was read section by section followed by roll call .after each section and all members of the Council voted in the affirmative. The Chair then put the question. "Shall this ordinance pass?- and on roll call the ordinance was unanimously adopted. _ BUSINESS on motion of Councilman Lammers, seconded by Councilman Balfanz~I1...c::llllirkmade the first reading by title of an ordinance entitled "AN ORDINAlfCBAIIBJ!U)ING ORDINANCE NO. 383, THE ZONING ORDINANCE. Discussion was held regarding the possibility of another hearing or;presentati~ by the Clark Oil Co. for a Special use Permit for a filling station at the corner of Myrtle and Third Streets. Mr. JCitllmel requested that he have a couple of days to check on this matt.er and advise the council about scheduling another hearing on tb.is request which will be the same as previously heard. At that time the majority of the council voted agaiDSt it and it is assumed ';hat the majority would not be in favor of hearing it again. ...... On motion of Councilman Lammers. seconded by Councilman Peterson this matter was referred to Mr. Kimmel for his study and recommendation before action is taken on this bearing for a special use permit. (Councilman Balfanz abstained from voting on this motion). , , ~ On motion of Councilman Peterson. seconded by Councilman Balfanz a Surety Bond for $5,000 for Moelter Construction Co. for an excavating permit was approved. (renewal). APPLICATIONS On motion of Councilman Peterson. seconded by councilman Wohlers the following contractor's Licenses were granted under Ordinance No. 448: Richard J. Jackson 1424 Hallam St.. Mahtomedi General Contractor (new) Quality Construction Service Co. 2001 E. 24th St.. Minneapolis Sid~ng Contractor (new) An application for an Amusement Machine License from Gregory Rosemark. 3447 Grand Avenue South. Minneapolis for machines at the Pla Mor was referred to the Director of Public Safety. 153 154 . (September 21. 1971 - continued) COMMUNICATIONS Mr. Al Bergen requesting a refund of the $100.00 sewer connection charge and other sawer chargGs Oil the R. E. hTiC'kson home, 208 West Chestnut Street. Mr. Shelton s..ated he will pu;:sue this further to see if possibly it drains dawn to Myrtle Street and report back to the council. This is to be considered by the Public Works COlmuittee and make a recommendation as to the amount of the rebate, if any. CITY COORDINATOR'S REPORT 1. Mr. Bud Fraser bas complained about the sidewalk on the East Side of Horth Second Street and alBa the railings at the same location. on motion of Counci~n Balfanz, seconded by councilman Lammers this matter be referred to the PUblic WorKs committee and they repair the problems until a permanent solution can be made, and also that a reply be sent to Mr. Fraser. 2. Mr. Marshall reported that he is working on the Flood plain matter for the insurance and it will be ready shortly, and the Flood Plain zoning Ordinance is being studied by the Planning commission. CONSULTING ENGINEER I S REPORT 1. Mr. Elliott will have the final plans and specifications for the Sewer project on Hancock Street by the next Council meeting. 2. Mr. Blliott stated that the council should be considering accepting pelitions for street work for next year so that the Public Works can look at these streets before they are covered with snow. Mayor powell suggested that Mr. Elliott meet with the Public works committee meetings but not be a voting member of'the Committee. The city should also consider replacing sidewalks when they do given street work. COMJIT'P'I'BB REPORTS PUBL1:C WORkS Jack Shelton 1. On motion of councilman Peterson, seconded by councilman Wohlers the Clerk was directed to advertise for bids for Hot Mix Bituminous, and Trucks for Snow Removal, said bids to be returnable on October 26, 1971 at 4,30 p, M. 2. Mr. Shelton stated that he is in the process of ordering the Snow Emergency Signs from CFM and he will probably order 100 signs. PUBLIC SAFETY Wallace Abrahamson 1. On motion of Councilman Peterson, seconded by Councilman Wohlers that the recommendation of the Director of public safety be followed to remove the parking meter at 212 East COJMl8rcial Avenue and make it a "Loading zone". (see resolutions). RECREATION Councilman Balfanz Mr. Balfanz cited the minutes of the commission which was held on September 15, 1971 regarding the hours for open skating, the rules for the tennis and basketball courts. and the charges for ice time. r- . . r , ...- '-' t"" '-' ~ . . Mr. Blekum brought up the matter of a skating rink in the FairmeadowB area and the problems to flood such a rink due to the location of the hydrants and the crossing over private property. The Mayor directed that the City Coordinator, Mr. Kimmel, and Mr. Blekum check out possible sites before the next council meeting_ Mr. Elliott explained that he has been in contact with Mr. Pattee regarding the air opening for the Ice Arena. PBTI.TION (out of order) r-- A petition for a street light on Orleans Street between South Fifth and Harriet Street by residents in Forest Hills. On motion of Councilman Peterson, seconded by Councilman Balfanz this request for a street light was referred to the Public Works committee for study and recommendation. CITY ATTORNEY'S REPORT Me. Kimmel reported that the annexation hearings on Wild pines and the property requesting annexation to oak Park Heights has been continued to November 10 and II, 1971. UNFINISHED BUSINESS (out of order) 1. councilman Lammers asked if a "No parking" sign could be erected by tho Legion Club where the curb is painted yellow and this matter was referred to the Public Works Committee. 2. Councilman Lammers questioned whether or not the work on the Main Street Stairs has been completed and Mr. Shelton and Mr. Elliott were asked to instruct Mr. LeTourneau to finish his job. 3. On motion of Councilman Lammers, seconded by Councilman wohlers that Mr. Marshall and Mr. Shelton writ~ letters to the realtors in the City and inform them of the requireme".lts of the Sub-Division Ordinance and also the Register of Deeds. . \ J. . . . 156 (September 21, 1971 - continued) 4~ councilman Lammers questioned the status of the sale of property to the School District for a new Junior High School on the old dumpsite. It was concluded that there has been liC) official council action on this matter and all of the publicity in the paper has been taken from the School Board minutes. 5. On motion of councilman Lammers, seconded by Councilman wohlers a resolution was introduced for the payment of the bills. (see resolutions). RESOLUTIONS The following resolutions were read and were on roll call unanillOusly adopted: 1. Directing the payment of Bills. 2. commending Ruben Jacobson on his service to the city of stillwater. 3.
