The Planning Commission recommended that the street be vacated in its entirety from Third to Fourth Streets, as reported by Duane Arndt. On motion of Council_n Peterson, seconded by Councilman Wohlers a resolution was introduced vacating that portion of Mulberry Street between Thircl ana Pourth Streets and the conveyance of the North 200 feet to the City. ROBERT Me GARRY, 2315 Oak Ridge Road was spokesman for the citizens on his street - they are not opposed to the development of Wild Pines - they feel that Oak Ridge Road is not built to handle the traffic that i. proposed to be handled and there was an agre...nt when that area was developed that Interlachen Drive would be developed a8 an egress and ingreu. This is the narrowest streat in this area (Oak Ridge Road) with the exception of Laurie Court. Fairmeadows Road is forty feet wide. They would like to see their street made into a cul-de-sac. Mr. Orrin Thompson stated they had no objection to a cul-de-sac on this -street. councilJaan Lallllllrs asked if we are going to open up Interlachen Drive i. all that property in the City of Stillwater - he understands that. ,this road is the boundary line. Mr. Shelton stated it is a 60 foot platted right-of-way with 30 feet in Stillwater and 30 feet in Stillwater Township. Mr. TbOlllpson stated that. they would have to pull back, and as long as they pay for it they could put in the street - approve the Preliminary Plat subject to the building of a full street on Interlachen Drive. CouncilJaan Lammers requested that the developer make a general stateMnt of the type of homes they propose. Mr. Orrin Thompson explained that they would be building in three major areas at the present time - regular homes and townhouses - the homes run from 25 to 45 thousand dollars. The average the last two years has been in the neighbor- hood of 30 to 32 thousand dollars - 1,000 and 1,800 square feet. All homes have double garages -- once in a while a single garage. Councilman Lammers questioned if the devoloper intends to comply with all the existing ordinance.. Mr. Thompson stated they would and that this wouldn't be done in one plat but in stages. We will work with the City on the streets and curbs before you will be asked to approve a final plat. We will post a performance bond on the amount estimated by your engineer. '~ ,- r . . . . . (August 24. 1971 - continued) r-. ~ councilman Lammers stated that we are concerned about lnterlachen Drive and Oak Ridge Road and appreciated the problems that this could cause. Mr. Blliott stated that it would be possible to construct a 20 foot road on a 30 foot right-of-way. so_time in the futlre when they put in storm sewer and water it would be a benefit to the property to the North if it is developed. Mayor powell stated or asked that if the street were put in as platted with the sewer and water so that it would be put in Stillwater Township and paid for by the developer, would Stillwater Township object to that improvement. Clay Newman from Stillwater Township Board stated that he and the other IDInber with him could Dot make a decision on this and. it would have to be taken up at a regular meeting. ~ MJ:'. Blliott suggested that scme negotiations should be made with Stillwater Township on this matter. Chief AbrahUlson stated that the City could live with an angle in the road but that. a cui-de-sac would be the wrong thing, and a dead-end on that. street would be a fire prot.ection problem. He didn't feel tlat the traffic was going to be that great down that way, and that the City has the right to put in stop signs in at every intersection. Mr. McGarry stated that the prime concern i8 the safety factor. If the con- census is not in agreemwnt with a cul-de-sac:.', just so it keeps the traffic out of there. Mr. Duane Arndt, Chairman of the Planning commission stated that the C0lllllli8sion recommended the approval of the plat as outlined in their Finding of Pact. They recOllllD8nded sidewalk.s in the collector street in the Town Bouae area which will lead to the COIlIIl8rcial area. He stated ordinance No. 389 rtlquires sOM very specific things for a new plat which requires sewer. and water connections which in'lOlV8s a considerable amount of money and the city has to get involved in that. The plat does have setback. line. on all the lots. , --,"- Mr. Thompson stated they would have to find the street grades on the proposed plat and the street layout sizes on the final plat and the sewer and water. This will be done before they come to the City with the final plat - the final plat will have all of this information. Mr. Arndt stated that the minority of the Colllllission felt that this should be treated as a Planned Unit Development since under the existing structures that exist in Stillwater once the Townhou.e. are developed. the only restrictions that the City has is the zoning restrictions. They are concerned about the aethestics of this whole development. '- Mr. McGarry again requested that the council consider the oak Ridge Road problem, and qua.tione4 the placing of the Town~houses and the multi-dwellings in their backyar4s rather than leave the.. where they were originally planne4. They feel they shou14 be put in SOM other part of this development. ~' Mr. Thompson stated that there were two reasons for what they did. He further explained that when they build: Townhouse. they completely sod and shrub them. They are story and half Townhouse. with garages and patios and that they blend in with single family houses. They do a good job of planning and screening on these Townhouse., and if they were three story apartments they would not blend in with the area. They are grouped in fours and sixe. They will be SO feet from the back of the lot line with a minimum of 100 feet. The units are stagerred to fit into the landscaped area. Mr. Robert Ga Katz, 2309 Oak Ridge Boad asked if they had any assurance that there wouldn't be a parking lot between their property and the Townhouses. Mr. Thompson state4 that they would submit this with the lan4scaping and placement. Mr. McGarry stated that they had bought their property and improved it with the understanding that it would be a single family area a 131 . . . . 132 . . , (August 24. 1971 - continued) Mr. Thompson stated if they were objectionable he would not have placed them the way he did. Mr. Duane Arndt stated that the single detached houBe is a very:expensive housing unit and it i8 their feeling that this type of housing is desirable unle.8 you want an area llke Edina. He felt 'l'ownhoi,1ses would not detract from the value of their property. and if they did go in they would be desirable. councilman LalDnWra questioned why they had to have any Townhouse. in this particular location and Mr. Thompson replied that the property to the South has too great of a tarain for this type of housing. and they want to preserve the tre.. in the area. ARVID DETERS, 2319 Oak Ridge Road questioned why in the suburbs where Town- house. have been built the people have run up against such opposition and Mr. Thompeon explained the oppoaition has been to multi-dwellings and not Town- houses. He further explained that Eden Prarie they have at least 60 percent Townhouses and 20 percent single houses and that it is the nature of America and that it is going to be here and this ie going to be a way of life. He did not know of any Townhouees that were turned down, but that three and four story apartment hou..s have been turned down. IIE'. McGarry stated they are not in opposition to Townhouses in this area, but they do not want the. in their backyards. Mr. btz felt that 8011I8 planning consideration should be given to the people that are already there. Mr. Deters again brought up the dr..inage problem in this are. and the drainage to Long Lake and he wanted to see that something is done about this in the plan. MICHABL BELDAP, 2112 Pair_adows Road asked about the condition of Meadow- lark Park and the City Coordinator stated tha\: they are working with Mr~;'Stein- darf on this project and that dirt is being hauled into this area. TheCity is doing as much ae they can to make this park more useful - it i8 City property and they will improve it. council...n Laaners asked if Duane and Jack had reviewed this plat and had any c~nts on it. Mr. Elliott did state that he did make a preliJainary sewer and water layout for the former layout of wild Pines. He felt from. an engineering standpoint he has to establish the City's sewer and water before the final or vb_Ie' area is platted and felt this could be accomplished. There may be a need for 'an additional well. He has not looked into the street drainage but the water all gets to the lake now. It is just a matter of storm sewers and catch basins. Mr. Clay Newman and Mayor Powell questioned the flow of the water in the area and the lake and who would be responsible for this,. and M:r. Elliott stated that we would not be diverting any water. Mr. William Fierke stated that they have talked to Archie Jackson about the drainage in the area and his property and if the lake became too full it would flow into Archie's property and then it would flow on into McKusick Lake and on down to Brown's Creek and then to the St. Croix RiVer. Se a180 talked to Archie about digging a ditch on his property to divert the flow, but he felt there was not too much auger of it getting too full. Maynard Nelson, 2316 Oak Ridge Road asked that the shore line of Long Lake not be disturbed for the natural features and it should be kept wild for the fish and other game in the area. Mr. Clay Newman agreed that something should be dCtne to pre.erve the ecology of the area and he also stated that we do have in this part of the seven county area,. we are furnishing most of the recreation development for the whole Metro area,. and if we put a park in this area it would be used by the people of the Metro areaa r r ~, . . . . . . f' '\ ,,.,.,,,. .... ..../ '- v (August 24, 1971 - continued) 133 Mayor powell stated that this is going to be an open area and would not be for picnics or bonfires. Mr. Newman stated that just as soon as you make it public property the people are going to be there. and we don't know who is going to police it. The Mayor closed the hearing at 9:35 P. M. and declared a recess until 9.50 P. M. on motion of councilman Balfanz, seconded by Councilman Peterson a resolution was introduced approving the changes in the Wild Pines Sub-Division Plat 1ncluding the recommendations of the Planatiag;::. COIIIIlssion.and making sure that the problem of Interlachen Drive be resolved between them and Stillwater Township, clarify the Townhouse locations and water storage dedication. From the State of Minnesotal Governor Wendell R. Anderson, thanking the Mayor for taking time out to attend the meeting on the tax bill. (no action). . . . 134 . I (August 24. 1971 - continuedl CITY COORDINATOR'S REPORT 1. On motion of councilman Peterson, seconded by Councilman Balfanz. the Council authorized the Mayor, City Coordinator, City Attorney and the Consulting Engineer to attend a meeting in Chicago on September 2, 1971 regarding the City's Grant for the Sewer Separation Proj~ct. 2. Mr. Mar&.hall informed the Council that they did have a quote of $90.00 per hour to cepair the sewer line on Linden Street from MOelter Construction but ainee Moelter was unable to take care of this work at this time, 80 David Junker has been authorized to do this work and he is currently on the job and i8 doing it for the price that Mr.. Moelter had agreed to. 3. On motion of Council...n LamID8ra, seconded by Councilman Peteraon it is the recommendation of the Administrative committee that the City Coor- dinator be authorized to advertise for bids for the purchase of an Elect.ronic Accounting Machine said bids to be returnable on Ssptember 7, 1971 at 7.30 P. M. 4. Mr. Marshall infor_a the Council that Geraldine McGough at the LibrZiry ia.considering the possibility of buying bacK Bome retirement time with P.B.R.A. and if she decides to do so the City would have to match this amount which would be $286.28. ' On motion of counci111811 Peterson, seconded by Counct1man Balfanz the City Coordinator was intructed to cheCK the matter out with Mi.s Jlc:Gough and the P..B.R.A. and report back on September 7, 1911. 5. Mr. Marshall informed the Council that he will have all the figure. put toget!wr 8. to the dike costs and will present them to the Council on September 7th for their consideration as to assessments for this cost. 6. The matter of the plat for A. B. Jackson has been referred back to the Planning Commission for their meeting on September 9th . Mr. Kimmel stated that he should petition for annexation and detachment and he was instructed to work with Mr. Jackson and the officials of Stillwater Township on this matter. 7. Mr. Marshall reported that the air conditioner in the Fire Department is not operating and the contractor who had put this unit in states that the replacement cost would be $2,500.00. He is in the process of checking out scae other alternatives for air conditioning for this building and report back at a later meeting. 8. JCr. Marshall .tated that there should be some type of replanting of trees where they are being taken down during the construction of projects in the City. on motion of Councilman Peterson, seconded by Councilman Wohlers the City Coordinator, the Consulting Engineer and the Recreation Department were instructed to check into trees that would be removed during the 1971 program and r.port back to the Council. Mr. Blekum stated that this would be a good idea but they should not consider planting of trees in the boulevards but rather on private property and obtain permission to do this. 9. The matter of the reconstruction of the Main Street, Willard Street, and Chestnut Street Stairs was discussed again. The City coordinator and the City Attorney were directed to explain to Mr.. Willie Schroeder that as soon as we get his performance bond we will proceed with this contract and also that Mr. Shelton check out his qualifi- cations for this type of work as it seelllS to be questionable. r 11. On motion of councilman Balfanz, seconded by Councilman Peterson the City coordinator and the Public Safety Director were directed to buy whatever is reqmited for the Police Reserves and Volunteer Firemen for disability benefits until the end of the year. RICHARD CLAMMBR from the Eastern Softball League appeared before the Council reque.ting permission for the use of Lily Lake Park for a tourn...nton September 10-11-12, 1971. A discussion followed about the charges for the use of the Lily Lake park facilities and the matter of allowing the sale of concessions. on motion of councilman LaDlD8rs, seconded by councilman Peterson that perllission be granted to Richard Claaner for the Eastern Slow Pitch League to conduct a tournament at the Lily Lake Park and that he be charged $75.00 for the rent of the field and an additional $5.00 for each game played under the lights. This matter was considered at the Planning Comaaission meeting on August 23 and was tabled until their next. meeting on September 9th. Mr. Elliott announced that he would be at the Municipal Building on September 3, 1971 at 1100 P. Mr. Abrahamson informed the Council that he had a phone call from a group requesting permission to use the City parks for a picnic for a group that is marching from the TWin Cities to the Minnesota State Prison.
