MaY 3. 1971 SPECIAL MEETING The meeting was called to order by president powell. present: councilmen Balfanz, Lammers, wohlers and president powell Absent: councilman peterson Also present: city coordinator, Marshall city Attorney, Kimmel FLOOD nVERTlME PAY On motion of councilman Lammers, seconded by council~n Wohlers the council approved the payment of flood pay at the overtime rate for the employees detailed on the 1971 Flood payroll sheet. M. SPECIAL MEETING The meeting was called to order by President powell Present: councilmen Balfanz, Lammers, Peterson, Wohlers and president powell (Councilman 1~mmers arrived at 4:50 P. M.) Absent: None Also Present: City Coordinator. Marshall: Acting City Clerk, Schnell: city Attorney. Kinnel: SUpP.rintencient of Public works, Shelton: Consulting Bngineer, Elliott ~ NO. 49 CONTRACT FOR 1971 The contract was reaa in its entirety and the following changes were recOl1IlI8nded: ARTICLE I - section 4 Add ahead of present wording - "Within each job Classification". _ Section 5. Add at the end -if he posses qualifications for the position" . ARTICLE II=. Section 4. In the fifth line change "reimburseo" to "paid". Add at the end "no deduction being made for the portion of sick leave reimbursed by workmen's compensation-. ARTICLE VIII-section 1. Waeres - Delete "or the cost of Living Increase, whichever is greater." section 2. Leave out entirely and then renumber all the other sections to a total of 6. Mr. Marshall was instructed to contact Mr. McPherE.on regarding these proposed changes and the retyping of this contract. UNFINISHED BUSINESS This was the day and time set to open bids on Local Improvement No. 101 Dike Removal, Embankment Construction, Bridge Demolition and Miscellaneous construction Items. The Clerk read the advertisement for bids alOud, Mayor Powell inquired if the advertisement for bids was published, and the Clerk informed the council that the advertisement for bids was published in the Stillwater Evening Gazette, official newspaper of the city, on April 23, 1971 and in the Con- struction Bulletin on April 22, 1971. Porest Lake, Minnesota ,- Bid Bond '- Total sid $24,205.00 on motion of Councilman Peterson, seconded by councilman Balfanz these bids were referred to the City Attorney and the Consulting Engineer for a report later in the meeting. ~ M.ISCELLANEOUS ITEMS Mr. Elliott reported that due to the fact that the stipulation for sewer separation has not been approved and sent in to the PCA they will not approve the plans and specifications for Project No.1, L. I. #99 for sanitary sewer. The first stipulation relates to the sewer separation and the second one relates to the Nutrient Removal which is to be taken care of by the Metro Sewer Board. On motion of councilman Peterson, seconded by Councilman Balfanz Mr. Elliott was directed to write a letter to the Pollution Control Agency regarding this stipulation. .... v 61 . . . . . . (May 4. 1971 - continued) At this time the OATH OF OFFICE was administered to RAYMOND MARSHALL, City Coordinator, City Clerk, City Treasurer by the Acting city Clerk, Dorothy schnell. on motion of Councilman Peterson, seconued by councilman Wohlers the City Coordinator and consulting Engineer were instructed to contact the Pollution Control Agency in person and discuss the problem with the refusal of the PCA to approval of extension of sewers in the City of stillwater and that this be done as soon as possible and report back at the next Council meeting. UNFINISHED BUSINESS On motion of Councilman Wohlers, seconded by Councilman Peterson a resolution was introduced awarding the contract for the removal of the Dike, Local Improvement No. 101 to Miller Excavating for a bid price of $22,299.00 and that we hold the second low bid until the contract is entered into with Mr. Miller. (see resolutions). RESOLt7l'IONS The following resolutions were read and on roll call were unanimously adopted: 1. Execute applicati~~ for Sewer Separation Federal Granc_ (repass) 2. City Attorney Provide Legal Data for Hud Funds. (repatos) 3. Awarding the Contract for Dike Removal (Miller Excavating).
