The Invocation was given by Mr. Marshall. Present: Councilmen Balfanz, Peterson, Thompson, Wohlers and President Powell Absent: None Also Present: City Coordinator, Marshall; City Attorney. This was the day and time to open bid quotations for the rental of trucks for snow removal for the 1974-75 season. On motion of Councilman Balfanz. seconded by Councilman Peterson, the Clerk was directed to open the one quotation received. Michael J. Raleigh P. O. Box 261 Stillwater, Minnesota 55082 Quote Price 70~ per yard/per hour-$14.00 (two - 20 yard trucks) On motion of Councilman Peterson, seconded by Councilman Balfanz this quotation was referred to Jack Shelton for a recommendation later in the meeting. QUOTATION NO. I 2. On motion of Councilman Peterson. seconded by Councilman Balfanz the City Coordinator was directed to inform Mr. Thomas Swain who petitioned for a street light on Orwell Avenue in the Penthouse Acres area that the City cannot install such a light until we have the final plat of this area, and also contact Mr. Tony Leitte requesting that he attend a Council meeting in the very near future and explain to him why the plat hasn't been filed and also ask him to bring along Mr. Art Holm. 3. MR. ARTHUR PALMER, JR. of the Lowell Inn appeared before the Council in reference to obtaining an Off Sale Wine License which would enable him to sell his imported and domestic wines that he sells with his dinners to his customers on a restricted basis. On motion of Councilman Peterson, seconded by Councilman Balfanz the Clerk made the first reading by title of an ordinance entitled "AN ORDINANCE AMENDING ORDINANCE NO. 416". (see ordinances) 4. JOSEPH F. O'BRIEN, 320 North Second Street, appeared before the Council regarding his receiving credit on his assessment for the improvement of North Second Street, Local Improvement No. 109, in the amount of $607.08 which he felt was the amount due him for the sidewalk which he had con- structed along the East side of his property on North Second Street which was put in 7 or 8 years ago. The sidewalk had to be torn up and replaced since the grade of the str~et was changed and he was informed that he was not assessed for the sidewalk but only for the street costs. 27~.\ · \ ,. . . / I (December 10, 1974 - continued) . 280 . Councilman Peterson made a motion that the request be denied as he could not see where the City benefited from this sidewalk. (The motion died for the lack of a second) Councilman Wohlers felt it would set a precedent because other people have had the same problem. For the lack of a motion, no action was taken on this matter. 5. Secondly. Mr. O'Brien asked about the allowance for the removal of the plug in the storm sewer and he was informed this request was turned over to the City attorney at a previous Council meeting. UNFINISHED BUSINESS 1. On motion of Councilman Peterson, seconded by Councilman Balfanz the Council followed the recommendation of the Public Works Director and denied the request for a street light at the entrance to Lakeside Terrace and he was instructed to inform the people why this was denied. (The Council felt that the lights at this location were decorative and ornamental rather than functional and should not pick up the lighting costs of same.) 2. On motion of Councilman Peterson, seconded by Councilman Wohlers a special meeting was scheduled with the Public Works Committee to review the applicants for the Street Foreman Position, and the additional man for the police Department, said meeting to be held on Friday, December 13. 1974 at 7,00 P. M. 3. On motion of Councilman Balfanz, seconded by Councilman Peterson the City Attorney was instructed to take the necessary steps to destroy the Schuster home on Carnelian Street which has become a health hazard. THE MAYOR DECLARED A RECESS FROM 8, 3S TO 8, 4S P. M. 4. On motion of Councilman Balfanz, seconded by Councilman Wohlers the Engineering Department was instructed to submit the proposed plan for designated State Aid Streets to the Minnesota Highway Department for their approval. Proposed changes--Additions-Orleans between South Greeley and County Road No. 5 -West Wilkins from North Owens to North Fourth -North Fourth from West Laurel to West Wilkins -West Churchill from South Greeley to South Fourth Street Delete--East Olive from Main to South Second --South Second from East Olive to East Chestnut --East Laurel from North Second to North Fourth --North Second Street from East Hazel to East Willow NEW BUSINESS 1. The Resolution "Employing Gary LaMotte as an additional Policeman was delayed until the Council could interview the three highest scorers for this position before making a final decision. 2. The matter of $53,000 Federal Grant for Emergency Employment was deferred until December 17th since there was the possibility that the City will be liable for unemployment payments if these parties who become a part of the program are unable to secure employment when the funds have been expended and Mr. Marshall will do some further checking on this matter. 3. On motion of Councilman Peterson, seconded by Councilman Balfanz that Stillwater Township's Engineer and the City's Engineer figure out an equitable amount for the sewer oversizing near the Bud Kern property on Hy. #212 and get a dollar figure they expect us to contribute and report back at another meeting. 4. On motion of Councilman Balfanz, seconded by Councilman Thompson the Council approved Change Order #3 to Local Improvement No. 120, Austin P. On motion of Councilman Peterson, seconded by Councilman Balfanz a resolution was introduced "STATING INTENT TO PARTICIPATE IN COOPERATIVE COMMUNITY DEVELOPMENT FUNDING" (funding for housing and park acquisition). (see resolutions). 6. On motion of Councilman Balfanz, seconded by Councilman Peterson a resolution was introduced "DIRECTING THE PAYMENT OF THE BILLS". COMMUNICATIONS From Mrs. Charles Thompson thanking the Stillwater Police officers for their quick and efficient response to her call for help on the morning of her husband's death and their kind and considerate condolences. From Mr. McRae, District Highway Engineer. regarding the traffic control on Omaha Avenue and Highway 212. From Gordon C. Moosbrugger. attorney for Stillwater Township, regarding the Model Agreement for Operation of Sewer and Water Systems in Stillwater Township. From Joseph F. O'Brien, 302 North Second Street, regarding the water assessment for Lot 6 adjacent to his property - this property was not assessed and the reason is that this party is serviced with sewer and water off Mulberry Street. On motion of Councilman Peterson, seconded by Councilman Thompson the City Coordinator was directed to inform Mr. O'Brien the reason Mr. McKnight's property was not assessed for watermains on North Second Street. CITY COORDINATOR'S REPORT 1. Mr. Marshall informed the Council that there will be a League meeting on Thursday, December 12, 1974 at 7:30 P. M. on the Legislation Program for the 1975 session. 2. The City received a Dividend check in the amount of $2,062.00 rebate on the premium for the City's Workmens Compensation Policy. 3. On motion of Councilman Peterson, seconded by Councilman Balfanz the City Coordinator was instructed to send letters immediately to the Federal Labor Board and the Congressmen in regard to the new rule governing overtime pay for the Volunteer Fire Fighters. 4. Mr. Marshall reported on his findings on the owners of the property in the Brown's Creek Area which the City of Stillwater and Stillwater Township would like to acquire. On motion of Councilman Peterson, seconded by Councilman l~ompson the City Coordinator was instructed to contact Stillwater Township and tell them that we are interested in doing something in the Brown Creek's area in conjunction with them and with their approval and that the City Coordinator report back at the next regular meeting on this matter. 5. On motion of Councilman Peterson, seconded by Councilman Balfanz the Clerk was directed to advertise for two trucks - one for the Street Department and the second one for the Parks Department. 2. ,'-" On motion of Councilman Balfanz, seconded by Councilman Wohlers the contract for the rental of trucks for snow plow hauling was awarded to Michael J. Raleigh. P. O. Box 261, Stillwater at the rate of 70~ per yard, per hour for two trucks (20 yard) 3. The Burlington Lease is still pending and Mr. Marshall received a call that they have reduced the charge from $2,800 to $2,200 and Mr. Marshall will check with Muller1s Boat Works regarding the possibility of increas- ing their rate for the portion that they use. 4. Mr. Marshall was instructed to send a letter to Mrs. Mina Driscoll informing her that she does not need a special use permit to sell antiques from her home at various intervals throughout the year. 5. Mr. Arthur Palmer felt that the City should do something about cleaning up the entrances to the City of Stillwater. CITY ATTORNEY'S REPORT 1. Mr.Kimmel reported to the Council regarding the Jagusch Case. ORDINANCES None RESOLUTIONS The following resolutions were read and on roll call were unanimously adopted: 1.
