REGULAR mETING The meeting was called to order by President Powell The Invocation was given by Mr. Marshall. Present: Councilman Balfanz, Peterson. Thompson, Wohlers and President Powell Absent: None Also Present: City Coordinator, Marshall; City Attorney, Kimmel; Superintendent of Public Works, Shelton, Public Safety Director, Abrahamson: Director of Parks and Recreation, Blekum; Consulting Engineer, Elliott Press: St. Paul Dispatch - James Broede Stillwater Evening Gazette - Douglas Seitz Citizens: Alan Davidson, John DeCurtins. David Junker, Ann Bodlovick. Bill Hahn. Jerry Mahoney. Dennis Murphy INDIVIDUALS-DELEGATIONS-PETITIONS 1. ALAN DAVIDSON appeared before the Council regarding a long range program of planning for the City of Stillwater and legislation regarding Townships and fele that the City of Stillwater should control both sides of Highway 96. He presented the Council with a written copy of his proposal for annexation of his property along with attached maps, all of which were referred to the City Attorney for study and recommendation. 2. On motion of Councilman Peterson. seconded by Councilman Balfanz the request for a street light on Lakeside Drive was referred to the Public Works Committee for their study and recommendation at the next meeting. UNFINISHED BUSINESS None NEW BUSINESS 1. On motion of Councilman Balfanz, seconded by Councilman peterson the followinr Change of Escrow was approved: $10,000 U. S. Treasury Bills due 4/24/75 YieId - 7.35% 2. On motion of Councilman Peterson, seconded by Councilman Balfanz the City coordinator was instructed to inform the City of St. Paul that they felt that they should work through the League of Municipalities in any form, shape or manner on the matter of a rate increase by N5P. 3. On motion of Councilman Peterson, seconded by Councilman Thompson The City Coordinator was instructed to write a letter of intent to the Urban Renewal Agency for participating funds for the proposed Downtown By-Pass and the Minnesota Highway Department for a Federal- Aid-Urban Project. 275 . . . . . (~~~6 ! . \ November 26. 1974 - continued On motion of Councilman Peterson, seconded by Councilman Wohlers the date of the second regular meeting in December was changed from the 24th to the 17th and then the date of December 30. 1974 was set for a Special Final meeting for the year. On motion of Councilman Peterson, seconded by Councilman Balfanz a resolution was introduced "ADOPTING THE TAX LEVY FOR 1975". (see resolutions) On motion of Councilman Peterson, seconded by Councilman Wohlers a resolution was introduced "ADOPTING THE BUDGET FOR 1975". (see resolutions) 7. On motion of Councilman Peterson, seconded by Councilman Wohlers a resolution was introduced "REDUCING CERTAIN MANDATORY LEVIES FOR 1975". (see resolutions) 4. 5. 6. APPLICATIONS On motion of Councilman Balfanz, seconded by Councilman Wohlers the following "OFF SALE LIQUOR LICENSES AND DRAM SHOP LIABILITY INSURANCE WERE APPROVED FOR 1975, John L. Hinz. J. L. Stillwater Kinsel Liquor Store 2nd and Chestnut Street, Stillwater Barry Leigh Torgerson 210 South Main Street, Stillwater Renewal Renewal Renewal On motion of Councilman Balfanz, seconded by Councilman Wohlers the following "3.2 Off Sale Beer License was approved: Jack Felix 413 South Greeley Street, Stillwater Renewal seconded by Councilman Thompson the following Dram Shop Liability Insurance were approved On motion of Councilman Peterson, "Club On Sale Liquor Licenses and for 1975,. American Legion Club 103 South Third Street, Stillwater Fraternal Order of Eagles No. 94 227 South Main Street. Stillwater Stillwater Country Club North Fourth Street, Stillwater Stillwater Lodge No. 179 B. V. O. E. 110 South Main Street. Stillwater Renewal Renewal Renewal Renewal COMMUNICATIONS From Senator Mondale with attached reply from the Corps of Engineers regarding the flood problems on the St. Croix River at Stillwater. From Minnesota Conservation Federation regarding assistance on evaluating the worth of wetlands. The City Attorney requested copies of sample ordinances governing wetlands. From the Minnesota Municipal Commission regarding the matter of the petition for annexation of Certain Land to the City of Stillwater - Orrin Thompson and A. B. From Gordon Moosbruger regarding the taking over of the sewer lines. ~ On motion of Councilman Peterson, seconded by Councilman Balfanz this matter was referred to the City Attorney to see that their suggestions and recommendations and the manner of billing are acceptable and he is to report back to the Council at the next regular meeting. CITY COORDINATOR'S REPORT 1. Mr. Marshall informed the Council that he has had two requests for the use of City Hall facilities. 1. School Recreation Dept. for quilting classes - January 29 to March 5. 1974 (~ 2. Washington County Welfare Food Stamp - three times a month The School District would expect to use same without charge and the Washington County Welfare offered to pay for janitorial fees. On motion of Council an Peterson, seconded by Councilman Balfanz the City Coordinator was instructed to inform the School District and the Washington County Welfare Department that the building would be available to them for their uses providing the use would not conflict with the City's uses of the facilities and that they would be expected to cleanup following said uses. 2. On motion of Councilman Peterson, seconded by Councilman Balfanz the Council approved the moving of the starting date for employment for Shirley MOntbriand to June I, 1972 for Sick Leave Benefits since she did work full time prior to her employment as Clerk-Typist for the Inspection Department. 3. Mr. Marshall reported that the trucks for the City's Street Department are to be put into production in December. 1974. 4. On motion of Councilman Peterson, seconded by Councilman Balfanz the compensation for the voting machine custodians was increased $1.00 per hour and Mr. Marshall was directed to make this retro-active for the 1974 Primary and General Elections for Stanley Larson and James Stevensen. CONSULTING ENGINEER'S REPORT 1. Mr. Elliott reported on the progress of the new City Map which will have mu1ti-pu1~ose uses. 2. Mr. Elliott reported on the water pressure situation and especially how it will affect the Hooley property which was recently annexed. .:;) Mr. Elliott reported that the Keller Construction about completed with their work in the Croixwood Fifth and Sixth Additions and that they did put a temporary surfacing on Mid Oaks Avenue 3. 4. Mr. Elliott put a map on the screen which designated the State Aid Streets in the City of Stillwater and proposed additions to same. The City can add approximately two miles and he would like to meet with Mr. Shelton and Mr. Marshall to come up with some alternate proposals for the Council to consider. " \" November 26, 1974 - continued ADMINISTRATIVE No report PARKS AND RECREATION No Report PUBLIC WORKS 1. On motion of Councilman Peterson, seconded by Councilman Wohlers the Council approved the installation of a street light on the east side of South Third Street by the Junior High School Driveway. 2. On motion of Councilman Balfanz, seconded by Councilman Peterson the Engineering Department was instructed to check into the request from Warren Murphy regarding abatement of his assessment for Sewer Separation and come back to the Council with a recommendation. (721 South Martha Street). 3. On motion of Councilman Balfanz. seconeed by Councilman Peterson. the request for reimbursement from James F. O'Brien. 320 North Second Street, for removal of a steel plug in the storm sewer be referred to the Public Works Committee and the City Attorney to include this in the appeal made by Mr. O'Brien on his assessments. CITY ATTORNEY'S REPORT 1. Mr. Kimmel informed the Council that he had received a copy of the Attorney General's Opinion regarding the purchasing of annunities for the Police Reserves which the City cannot do according to this opinion. 2. Mr. Kimmel reported that he just received the franchises for Gas and Electricity from NSP and this matter has to be accomplished by Ordinance and he will review same and report at a later date. ORDINANCES None RESOLUTIONS The following resolutions were read and on roll call were unanimously adopted: 1. ~dopting the Tax Levy for 1975. 2. Adopting the Budget for 1975. 3. Reducing Certain Mandatory Tax Levies. ADJOURNMENT On motion of Councilman Peterson. adjourned at 9:05 P.
