The Invocation was given by Mr. Marshall.

1. HAROLD 8UCKEh~IN. 308 West Hickory Street, complained about the sodding that was
torn up. the approach to his driveway and eight feet of curbing that was broken,
and he has received a bill for the assessment of a cost of $680.00 plus he paid $200.00
of his money and there will be an assessment of $150.00 for the sewer separation.
Then the City of Stillwater put up "No parkingll signs for the next few feet on
Hickory Street. He questioned whether or not there had been a hearing on the placing
of these signs and felt he should have been contacted about this sign.
MAYOR POWELL stated that they had a written request for the "No Parking" signs and
it was brought up at the regular Council meeting and the Public Safety Director
recommended that these signs be installed. This matter was brought to the attention
of the Public Safety Committee this evening and they felt that when they receive
requests of this nature, which is restrictive that the abutting property owners
should t~ve a voice in this. In reviewing what he had said, the Council realizes
that it has been many years since that street has been that wide and in that respect
they could improve the method used in ordering the installation of "No Parking"
signs.
(Mr. Buckentin had requested to be heard on this matter since
he had to leave for another meeting)
2. RON LANGNESS from Springsted's appeared before the Council regarding the proposed
Bond Sale for the improvements in the Croixwood Fifth and Sixth Aciditions in the
amount of $400,000.
Also there is a fee charge to cover the cost of the rating and needed Council
approval to order the new rating.
On motion of Councilman Balfanz, seconded by Councilman Peterson
the Council authorized Springsteds to ask for a Moody rating for the
City of Stillwater at a cost of $650.00.
On motion of Councilman Balfanz, seconded by Counc~lman Peterson,
a resolution was introduced "CALLING FOR PUBLIC SALE OF $400,000
IMPROVEMEi.~T BONDS". (see resolutions)

3. CONTINUED HEAR1NG ON LOCAL IMPROVEMENT NO. 117--ASSESSMENT ROLL
MR. MARSHALL explained that Minnie Juhl has a water line and service off Olive
Street since 1939 and then in 1958 was provided with a second water service which
she has ~ever hooked up to and now another service has been brought in. Due to
the confusion he felt that the assessment on Local Improvement No. 117 to her
shuuld be abated. This can be handled in tW0 ways, either by adding $100.00 per

unit more to each property owner on this assessment roll, or the City could absorb
this into the Permanent Improvement Fund.
On motion of Councilman Balfanz, seconded by Councilman Peterson,
the Assessment to Mrs. Minnie Juhl was deleted from the Assessment
Roll for Local Improvement No. 117 and is to be picked up from the
Permanent Improvement Fund.

The Mayor closed the hearing at 7:45 P. M.
On motion of Councilman Peterson, seconded by Councilman Balfanz
a resolution was introduced "ADOPTING THE ASSESSMENT ROLL FOR
LOCAL IMPROVEMENT NO. 117 AS AMENDED", (see resolutions)
4. This was the day and time set for the Public Hearing on the proposed assessments
for Local Improvement No. 109 (State Aid Street Construction).
The nc~ice of hearing w~~ yublished on August 30, 1974 in the Stillwater Evening
Gazette, the official newspaper of the City and mailed to all property owners to be
assessed.
The_t~yor opened the hearing.
ALICE ':l'FatEN, 320 North Second Street, stated that their sidewalk was taken up
dur.ing the improvement and it was put in about five years ago. It was put in because
of the condition of the sidewalk on the other side of the street - it was so bad that
everyone used the west side of the street. She felt that they should have a rebate
for this item.
MR. ELLIDTT - the cost of the street is $100 to $150 and we are only aSSessing the
property owners $15.00 per foot - the balance will be paid for by the State of
Minnesota. Due to grade variations and the widening of the street it was necessary
to take out the old walks and replace them in the new location.
COUNCILMAN PETERSON said we had the same situation on Myrtle Street when it was
improved - it was necessary to tear out the new sidewalk and replace same.
MAYOR POWELL - this doesn't reduce or add to the cost of the job. In order to give
a rebate the Council would have to re-do this assessment roll and it would be unfair.
The opinion of the Council is that because it was torn up a new one was put in there,
it is difficult to make an exception to that.
COUNCILMAN THOMPSON - if you are going to this every time you are going to have a
variation of sidewalks and it would not look right.
COUNCILMAN WOHLERS - he remembe~ed the probl~m very well on Myrtle Street and they
were all torn up and some were only one year old.
COUNCILMAN BALFANZ - the whole construction area has to be looked at and if it
was left in it would be out of grade.
MR. ELLIOTT - because of the slope of the street the curb is considerably higher
and would not be level and could not be left. They did look at the quality of all
of the walks and there were some walls that encroached on the sidewalk and on the
street right-of-way and it was impossible to keep the Q1d walks and confine same to
the right-of-way.
The Mayor closed the hearing at 8:00 P. M.
On motion of Councilman Peterson, seconded by Councilman Thompson
a resolution was introduced "ADOPTING THE ASSESSMENT ROLL FOR LOCAL
IMPROVEMENT NO. 109 AND SETTING THE 1NTEREST RATE AT 5.75% AND THE
PAYMENT PERIOD FOR TEN YEARS." (see resolutions).

5. This was the day and time set for the public hearing on the proposed assessments
for Local Improvement No. 110 (Residential Street Reconstruction).
The notice of hearing was published in the Stillwater Evening Gazette. the official
newspaper of the City on August 30. 1974 and notices were mailed to all property
owners to be assessed.
The Mayor opened the hearing.
MR. ELLIOTT - there were about four miles of residential streets constructed in
this project and it was geared to the separation work. There are seven ton axel
streets with varying widths from 30 to 34 feet. The cost per foot is $13.5482 per
foot. The original estimate was $14.50.
Letters were received from Merrill Stahl and Neal Casey in
reference to these assessments.
NEAL CASEY, 107 East Laurel Street, had written a letter and also appeared in
reference to the south side of East Laurel Street which has never received a
curb or boulevard which in his opinion is a potential hazard situation that endangers
the safety of ~he pedestrian, especially children using the unprotected sidewalk.
He feels it is especially dangerous in the case of the motorcycles that use this
street. There is curb and boulevard n~ the north side of the street and feels
that the same should be put in on the south side to make it conform.
MAYOR POWELL - in ordering the improvement we were concerned about removing the
Maple trees on this street and this had something to do with the manner in which
this street was completed.
MR. ELLIOTT - The fifty foot right-of-way was removed from the State Aid project
and it was constructed as a residential street. The easterly portion of that
street is 26 feet which is basically for two lanes of traffic. This should be a
street where no parking is permitted. The curb has a minor effect as to setting
a grade for the street.
MR. CASEY - he had appealed to the Council to save the trees and he is the only
resident that lives in the middle of the block - all of the others are on the
corner. He had no need for a boulevard and no need to park out in front of hi3
house. People who do park there do pull up on the sidewalk - he does not like
the looks of it.
MR. MARSHALL suggested that possibly that this could be a Change Order to Local
Improvement No. 124 - they could rip out the asphalt dnd put in dirt and sod _
it would mean about 150 feet of curb.
COUNCILMAN PE~RSON asked when there were band concerts did many cars park there
and MR. CASEY said there were a lot of cars and it was impossible to get through
that street - they were parked on both sides and up on the sidewalks.
MAYOR POWELL - asked what it would involve to remove that portion that abuts the
sidewalk and then put in an asphalt curb.
MR. ELLIOTT - The curb design elevation wise would be somewhat above the sidewalk-
about four inches and the boulevard would slope. We would have to take some
elevations and order the bituminous dug out to get the curb in there. This street
is only 26 feet wide which is just enough for two driving lanes and no parking.
MR. CASEY said if the cars continue to drive over this curb, if put in, they will
break it up.
MAYOR POWELL suggested that Mr. Elliott and Mr. Shelton bok at the situation and
if it is going to be a big undertaking they would be more reluctant to do this.
RUSSELL MEISTER, 1019 South Fifth Street, said there are many variations in the
street projects and especially on South Fifth Street between Churchill and Hancock
and requested that it be put back to what it was before. They failed to take out
one manhole and the appearance is very bad. They replaced eight feet of sod and
used no black dirt. The water runs down the middle of the street and the catch
basins have no grates and they are a child hazard without the screening.
MR. ELLIOTT - Stillwater has a variety of catch basins and in the separation
project there were over 400 catch basins involved, some of which were 50 to 80
years old and they were in relatively good state of repair. The cost of new catch
basins are about $500 and with over 400 of them this would be a $100 item for each
one, so in most instances they left in the old basins, but did replace the slab
on the top. Some catch basins were left untouched to get the drainage off the
sanitary system.

COUNCILMAN PETERSON questioned the waves in the boulevards and MR. ELLIOTT
said in widening the intersections it was difficult here and something had to
be d0~e with the design. The east side was quite low and the West side was much
higher. The City is responsible to convey drainage from private property into
the stleet - the crown of the street is also shifted to take care of some of this.
MR. MEISTER said he would be willing to pay extra to straighten out this matter.
MR. ELLIOTT said there were some dollar limitation in this project and other
projects are good design, and there should be some grating over the mouth of
these basins. and he will look at all of the old ones and replace the grating.
COUNCILMAN WOHLERS asked who is responsible if someone slams into one of these
and MAYOR POWELL said this could be rectified when the street is done at some
future date.
MR. ~3ISTER complained about no black dirt under the sod and MR. MARSHALL said
tha~ he had gotten calls because of dirt in the street and knew the contractor
had put some in.
y~. PETER LETIZIO, 1008 South Fifth Street, said he had checked this out and
it wasn't black dirt that was put in there and MR. ELLIOTT said that it was
tested by Twin Cities Testing and he has a copy of the report in his office.
ERNEST BRISETTE, 1308 North Martha Street, complained about the water which runs
into his driveway and they also buried a water shutoff in the curb - two foot of
curbing was broken off in front of his lot and wanted something done about it.
Also the street sign was taken down and never put back up.
MR. SHELTON will contact the telephone company about t~lS sign and will also
check with the Street Department.
GEORGE SEIM. 1219 North First Street, complained about the water from the paved
streets coming down into his yard when it rains and comes into his basement. Mr.
Elliott and Mr. Marshall examined this and something has to be done as there is
too much water coming down from those side streets and it swings around into his
driveway.
MR. ELLIOTT said he has been aware of it for sometime and it is evident that with
a heavy downpour that the gutter capacity is very low. This comes out of the
parking lot from the golf course and the pipe that was installed there some years
ago at Third and St. Croix Avenue. The first solution would be taking this out;
secondly we could install a catch basin north of Mr. Seim's driveway which would
intercept much of the flow from Second and St. Croix.
MR. MARSHALL - possibly something can be worked out with the contractor for Local
Improvement No. 124 and there is no way to stop it without putting up a dam on
his property. We should look at the whole problem and do something this fall.
On motion of Councilman Balfanz, seconded by Councilman Peterson
a resolution was introduced "INSTRUCTING THE ENGINEER TO PREPARE
A CHANGE ORDER FOR LOCAL IMPROVEMENT NO. 124 TO PROVlDE FOR A CATCH
BASIN FOR MR. SEIW'. (see resolutions).
MR.. MERRILL STAHL, 1223 North Fourth Street, filed a formal complaint "Notice
of Objections to the Proposed Assessment for Local Improvement No. 110-1973"
and presented photos to the Council of the problem.
MR. MARSHALL - the center line of the street is in the yard of the house across
the street, and it would have completely destroyed this property on the east
side if it were put in that way. It was resurveyed and we cut off 1% feet on the
west side.
COUNCILMAN PETERSON - the traveled portion was then encroaching on Mr. Stahl's
property.
MAYOR POWELL - Would it be possible for the Council to meet here at 4 o'clock
tomorrow and look at the Laurel Street Stairs and also Mr. Stahl's property and
Mr. Seim's property and let the news media know about this.
PETER LETIZIO, 1008 South Fifth Street complained about the crack left in his
driveway by Orfie's men. Mr. Shelton and Mr. Becker said it would be taken care
of and nothing has been done. Also the approach needs to be fixed as he has to
back out at an angle in order to make it without going on the grass, He is also
going to have a tough time getting up his driveway in the winter time. Also his
front sidewalk has about a 12 inch pitch and his daughter slipped and fell - it
is a safety factor and he is not going to go along with this.

MR. ELLIOTT -cracks in bituminous are not uncommon and this crack was so
remote from Orfie's work and if the contractor did drive up there it should be
an insurance claim.
MR. SHELTON said that the contractor will take out Mr. Letizia's sidewalk
tomorrow.
MR. ELLIOTT said that he could show this gentleman the cross-section map of
this street and they did not change his driveway and the grade entrance.
THE MAYOR DECLARED A RECESS FROM 8,53 TO 9,D5 P. M.

MRS. CLIFFORD AKEY. 1302 North Second Street complained about the steep bank
on the St. Croix Street side of their property and that the sod 1s slipping off
and nobody has been back to do anything about it.
MAYOR POWELL - The City staff has noted this complaint and they will check same
out tomorrow afternoon.
DENNIS GALOWITZ, 1020 South Fifth Street, complained about the job in the street
and the sod and the storm sewer and he had been promised that this would be
taken care of and up to this time he has not seen anyone. He asked if the City
Engineer felt that all the work has been done.
MR. ELLIOTT - There was no gravel base on any of the streets in this project _
the condition was such that it was not necessary to put in a new base for same.
The Mayor closed the hearing at 9:10 P. M.
MR. KIMMEL - The problems are between the City and the property owners and the
corrections can be made after the assessment is levied and he recommended that
the Council act on the assessment this evening.
On motion of Councilman Peterson, seconded by Councilman
Thompson a resolution was introduced "ADOPTING THE ASSESSMENT
ROLL FOR LOCAL IMPROVEMENT NO. 110, Setting the Interest Rate
at 5.75% and the term of payment for ten years". (see resolutions)
6. Me KUSICK LAKE SIUDY
COUNCILMAN PETERSON - Mr. Marshall should get in touch with the fellow who is
doing this study and if we don't have this report by next week he is not going
to get paid.
CHUCK FREDERICKSON, 1602 McKusick Lane, said that he brought up this matter to
the Council a year ago, and he was told that the study was underway and also told
that when it was completed that all of the property owners would be notified and
they could attend a meeting so that they could get the results of the study. He
was also disturbed because he did not know the person who was making the study
is qualifie'd.
A question was raised about the dredging of the lake and MR. KIMMEL said it is
a question of legal responsibility of the City - there would be a civil damage
liability against the City.
MR. FREDERICKSON, asked about the request that the City was going to make for
funds to take care of this work and MR. MARSHALL said the request was made over
two years ago and to date we have no response, but he will check out the files
and make some calls on the matter.

On motion of Councilman Balfanz, seconded by Councilman Peterson the request
for a street light on West Lake Street was referred to the Public Works Depart-
ment for their study and recommendation at the next meeting.
8. MR. ARVID DETERS, 2319 Oakridge Road, appeared before the Council again regarding
his drainage problems which he feels is due to the filling in of two natural
ponds in his area and in the last rain he lost his garden. There is quite a
little silt that washed in and he wants some relief - he has been promised some-
ting for four years.
MR. KIMMEL felt it was p matter between the property owners and there is no
permit required to grade your property and it was his recollection that is what
the City told him the last time he WaS here. The City does not control grades
of property.

MR. DETERS said that when Fairmeadows No. 3 was developed they were 8f1:sured
that their drainge problem would be taken care of.
MAYOR POWELL felt it would be reasonable for the City Council to look at
this problem as he would like to see how the drainage could affect someone's
garden.
MR. DETERS also complained about the traffic to the Croixwood on Oakridge
Road and that they have no respect for speed limit and the children. He
would like a stop sign there to help alleviate the problem.
MR. SHELTON said that Croixwood Boulevard is torn up and this compounds the
problem, and the other entrance is on a gravel street.
COUNCILMAN PETERSON requested that the Police Department check out the
speeding.
MAYOR POWELL said we could put up a stop sign and he will confer with our
Public Safety Director about placing such a sign on Oakridge Road.
9. GARY FIEDLER, Fourth and Cherry, stated that there is no record of his water
hookup and as it turned out he is connected into North Fourth Street and has
no need for the connection on Cherry Street.
On motion of Councilman Peterson, seconded by Councilman
Balfanz the assessment to Gary Fiedler for Local Improvement
No. 112 was abated in the amount of $934.50.
10. Discussion was held regarding abatement of a portion of the assessment for
the improvement of North Second Street for Wade Green. It was agreed that
this was not a buildable lot. It was suggested that we abate 35% and treat
the same as his long side and MR. KIMMEL said this would be consistent with
what we have done in the past and also that the other alternative is to
assess him on an average residential lot. Also the same consideration should
be given to Harry Peterson.
On motion of Councilman Peterson, seconded by Councilman
Thompson, the COlmeil approved the reduction in the assessment
to Wade Green and Harry Peterson for the improvement on North
Second Street.
Wade Green - reduced - $612.64
Harry Peterson - reduced - $564.97
UNFINISHED BUSINESS
1.
The matter of the claim in the amount of $44.00 from John Pominville
for a sewer backup. The $44.00 was what the insurance company refused
to pay which was a lower figure for the luggage claim and labor for his
daughter.
Mr. Pominville still insisted that it was his understanding that
what the insurance company did not pay that the City would pay.
On motion of Councilman Peterson, seconded by Councilman
Thompson that the Council reject Mr. Pominville's claim
in the amount of $44.00. (all in favor)
2. A claim from T. L. Casper of the J. A. Goggin Candy Co. for damage to
supplies from a sewer backup during the rainstorm of July 29, 1973 in
the amount of $405.78.
Mr. Kimmel said that the property has to give some proof of
negiligence in the arca. The problem occurred on July 29th and the
letter was written on October 19th and now we are over a year beyond
the July 29th date in which he should have brought action. He should
have signed a written claim within sixty days and started action within
one year.
Mr. Elliott stated that their own system of roof drains added to
their problem in this case.
On motion of Councilman Peterson, seconded by Councilman Balfanz
the City Attorney was instructed to contact Mr. Casper and advise him
what his opinion is and why the City cannot pay and that he could bring
action against the City in Conciliation Court.

NEW BUSINESS
1. On motion of Councilnan Balfanz, seconded by Councilman Peterson the
License Bond for Moelter Construction Co., Stillwater in the amount of
$5,000.00 was approved.
2. On motion of Councilman Balfanz, seconded by Councilman Peterson the
request for a stop sign at Fifth and Hancock was referred to the Public
Safety Committee.
3. On motion of Councilman Peterson, seconded by Councilman Balfanz the
City Coordinator was instructed to notify the abutting property owners
for a proposed "No Parking" on East Walnut Street between Second and
Third and action to be taken at the first meeting in October.
On motion of Councilman Peterson, seconded by Councilman Balfanz the
Council approved Change Order #2 for Austin Keller for the utilities
improvement in the Croixwood Fifth and. Sixth Addition.

5. On motion of Councilman Peterson, seconded by Councilman Thompson a
resolution was introduced for a Highway Easement for Washington County
and the Mayor and the City Coordinator were authorized to execute such
an agreement. (see resolutions)
6. On motion of Councilman Peterson, seconded by Councilman Wohlers a
resolution was introduced "EMPLOYING KEVIN CHARLSEN AND KEVIN MOELTER
AS MEMBERS OF THE STILLWATER VOLUNTEER FIRE DEPARTMENT. (see resolutions)
7. On motion of Councilman Peterson, seconded by Councilman Thompson a
resolution was introduced "CONFIRMING THE APPOINTMENT OF THOMAS HUBBARD
ADN STEVEN GLASER AS VOLUNTEER FIREMEN". (see resolutions).
8. On motion of Councilman Balfanz, seconded by Councilman Thompson the
Council accepted the resignation of Margaret Knutson as Police Secretary
anci the Mayor was directed to send her a letter thanking her for a job
well done and also that the position be advertised.
On motion of Councilman Peterson, seconded by Councilman Thompson a
request from Jack Lay for a Loading Zone on Main Street was denied
and the City Coordinator was directed to inform Mr. Lay of the Council's
action on this matter.

10. On motion of Councilman Balfanz, seconded by Councilman Peterson the
Council approved the abatement of $302.50 to Elbert Field, 913 North
William Street on Local Improvement No. 98, since Mr. Kimmel advised
that at this late date we cannot assess the former owner and we can't
assess the new owner. (TheE was a discrepancy in the recording of the
deed on this property and he was assessed for 25 feet which was not his).
11. The matter of the increase in the Volunteer Fire Department Pension was
held over until we could get an Attorney General's Opinion on the Police
Pension Fund (Reserves).
Mayor Powell suggested that the City Attorney work with the
Police Reserves on the possibility of some type of disability
insurance.

The Final Estimate from Orfei Construction, Inc. was delayed for action
pending the settlement of two insurance claims which have not been paid.
The Assessment Abatement for Gerald Groth was held over for a future
meeting.
14. On motion of Councilman Balfanz, seconded by Councilman Thompson a
resolution was introduced "DIRECTING THE PAYMENT OF THE BILLS" (see
resolutions)

The matter of the One-Way Pair Preliminary Plan for the downtown area was
held over for the meeting to be held on September 18th.

CITY COORDINATOR'S REPORT
1. Work on the budget 1S almost complete and there will be a special meeting
shortly.
2. Plans are being made for a preliminary salary meeting.
3. Fencing off the well area at the Croixwood Park will be taken care of
in conjunction with the Board of Water Commissioners and Mr. Marshall is
to contact Harold Foster on this matter.
CONSULTING ENGINEER'S REPORT
Further discussion was held regarding the final estimate from Orfei but there
was no change in the COl. ~cil' s decision on the payment of this final billing.

1. On motion of Councilman Peterson, seconded by Councilman Thompson thp
City Coordinator was directed to write a letter to thanks to the Slow
Pitch League for the scoreboard.
2. A questions was raised about the cutting of the grass by the Old Prison
and the Highway Department property - the City will continue to cut same.
3. On motion of Councilman Peterson, seconded by Councilman Balfanz the
Council approved Change Order #1 for the replacement of the wall at the
house at Lily Lake Park in the amount of $492.36 for E. & H. Construction Co.
