Present: Councilman Balfanz, and President Powell Councilman Peterson, Thompson and Wohlers Absent: Also Present: City Coordinator, Marshall Consulting Engineer - Duane Elliott Director of Public Works - Jack Shelton MAYOR POWELL announed that due to the fact that there was not a quorum of the Council present no official action could be taken but since the notices were mailed out for this continued hearing, the people that were present would be heard at this time. CITIZENS, Mr.& Mrs. Peter Dielentheis, James Mulvey, Jack Dielentheis, Vernon Borst. Marie Fazendin. Mr. & Mrs. Roger Hoffman. Delegation from West Linden Street. UNFINISHED BUSINESS This was the day and time set to continue t~ hearing on the proposed improve- ments on West Elm Street and South Second Street. The Mayor re-opened the hearing. MR. DUANE ELLIOTT briefly reviewed his presentation of July 23rd. He stressed the fact that the cost of rep~ing a broken watermain or service is paid by the party or parties invoaed. In this project on Elm Streeet there are 302, 306 and 214 West Elm and 313 and 321 Elm and 820 North Fifth Street for water services (Also 206, 211 and 213 Elm Street). JACK DIELENTHEIS said there are three services into Lots 7, 8 and 9 from Martha last year and there would evidently be two from Elm. He said his mother would prefer nothing or all things if the Council orders the improvement. MR. ELLIOTT said there are two services on Martha Street and one service for the other lot. DON JOHNSON, said there are two homes on Fifth Street that will have to be main- tained on this private line (816 and 820 North Fifth Street). DUANE ELLIOTT said the service would be provided for the property at 820 North Fourth Street. MAYOR POWELL said that the Council did allow private lines at one time and now they have a hodge-podge in some areas today and they no longer allow this. He asked Mr. Elliott about time on this project and Mr. Elliott said that they are about a month late on it. MAYOR POWELL said that if it is going to be done it is better to do it today because it is not going to get cheaper. DON JOHNSON was in favor but he has a new street on Martha and he would have anothe~ assessment against him this year - MAYOR POWELL added that he would only pay for 52~ feet on Martha and full assessment for the street work on Elm Street plus the watermain. Questions were raised about the proposed sewer on Elm Street and it is possible that they are served from North Fifth Street and this will have to be checked out by Mr. Shelton. MR. MULVEY wants matting and would go along without the water if that is what the other people want. Questions were raised about the services for 816 and 820 North Fifth Street and then the Mayor polled the people in attendance and 7 wanted no water and 2 were in favor of the water improvement. Since there were unanswered questions regarding this improvement, Mr. Elliott and Mr. Shelton were directed to check them out and the hearing would be continued on August 13. 1974 at 8:00 P. M. . r- '~ . . . . . . ~ f") i...."',.,,, ....,1 . ._~ August 8, 1974 - continued SOUTH SECOND STREET Mr. Shelton recommended that the City install a bituminous curbing on East Walnut Street between South Second and South Third Streets to take care of the erosion problem from the hill behind St. Michael's Church before the improvement of South Second Street is done. This was satisfactory to Roger Hoffman and Marie Fazendin and this bprovement will be ordered at the Council meeting on August 13, 1974. The meeting adjourned at 7:55 P. M.
