The meeting was called to order by President Powell.
The Invocation was given by Mr. Marshall.

1. This was the day and time set to continue the hearing on the request of Bernu
construct;ion Co. for a Special Use Permit to construct a multiple dwelU.ng complex
on South Greeley Street.
The .Mayo~ re-opened t.he hearing.
JAMBS LAMMERS appeared in behalf of the Bernu Const.ruct.ion company, the petitioners,
for this request who are also the owners and developers of this propertl'. It was
his understanding that the Council had referred this back to the Pl.nnil\g CiDllli-
sion and the County Planner for their further consideration..
MS. ~aALL stated that the Pla~~ing Commission at its meeting on Fe~rQary 25th
had tabled this request until their next meeting so that the washington county
plabner, William Schwab, has had a chance to make a recommendation on this
p~o~8al and also they requested a topographical sketch and study of the proposed '-
building ai te.
MR. LAMQRS said that in his review of the proposed plans and the ordinances of
the city that they are in accordance with the codes set forth. He further stated
that. the request for the topographic would be quite costly to get a contaur prior
to knowUtg whether or not the proposal will get approval. He suggested that possibly
montes c()uld be put into escrow to provide for this.
~YOR FmfELL stated that he had looked at the property and found that it is not
nea~ly as high of a slope as was indicated at the last Council meeting.
ROBeRT S'l'EINDORFF said the Planning Conaission seems to be hung up on the elevations
in regar~ to the back hill and Mr. Bernu did provide these and as far as the other
side of the building the Planning Commission members have looked at it.

COUNCILMAN PETERSON questioned Whether or r.ot we are near capacity on the
sanitary sewer line in this area and ~. ELLIOTT said that it was designed to
serve a pc,rtion of Stillwater Township and all of that area which will be
connected to this system is already done and there is room for this addition.
LES STEPAN, 218 Borth Martha street, questioned the drainage for the area and
that there is now a build up of sand at the end of the culvert and with the
addition uf this complex it would compound the problem.
MR. STEINDORFF said there will two acres that will be green areas and the
buildings do not cover the entire site and nDst of the nun-off would go down
into the lake..
MR. STEPAN quoted rulings from the law regarding drainage into lakes passed by
the legislature and MR. ELLIO'l'T said there is new legislation for the implemen-
tation of these types of problems, but that the storm drain here was in existence
before the regulations were put into effect and felt there should be some holding
ponds put in this location.
MR. MARSHAU, stated that one of the reasons for the delay on this request was
to get MR. ELLIOTT1S report on the Lily Lake study which we have now.
MR. KIMMEL stated that the DNR has no regulations as far as storm water is
concerned and this would be a permit for a connection to an existing lake. There
is no requirement of holding pOnds, but they do "3ncourage wer'!' there is a site
is available to develop holding ponds but there is no regulation that you have
to do it. You can I t fill in a pond and you can't dredge in a lake without a
permit.. In order to lUke a storm water connection into the lake we would have
to have a permit from the DNa but this would rain into an already existing storm
drain.
MI. STEPAN said that we are filling in this lake and it won't be fit for swilllDling
and he did enjoy this lake for many years and felt it should be kept that way for
the generations cominq up to enjor - it will soon be in the same condition as
MCK\l8ick Lake.
MRS. mEELl\ND, 206 south owens Street, asked if this project would have federal
funding and MR. MARSHALL said it. 1iOuld be FHA funding but would not be a 236
program _ there would be no subsidized rents and they would rent for about $195
to $210 per mnth which ,,"':u1d be low-middle rental units.
COUNCIU4AN WOHLBRS felt that the council should wait for the next meeting of
the Planning COll'l1lission and get tlteir reeonunendation.
MB.. LAMMERS felt they should consider the recommendation of the Planning CODlllis8ion
and he had no objection to that. The main problem was the request of the planning
COlllllission for the topographical study of the whole area as this would be con-
siderable expense for the de~laper.
MR.. MARSHALL stated that they di.d supply the soil borings since there was some
concern about this area since it \liaS used as a dumpsite for the 1965 dike pilings
and there were also some trees d~ped here and these were satisfactory.
Discussion followed regarding this problem which was considered and on metion
of COUNCILMAN WOHLERS. seconded by COUNCILMAN BALFANZ, the developer was
instructed to stake out the property so that the Planning commission and the
city council can look at the site and then continue this hearing to the March
12th Council meeting (This would be in lieu of the topographical as requested
by the Planning Cotl'l'll.ission as far as the Council was concerned).

On motion of councilman Peterson, seconded by coun~ilman Wohlers the proposal
from Robert Steindorff to sell certain land on the east side of South Greeley
street to the City of Stillwater be referred to the Planning commission. the
city I s Engineer and the city Attorney for their study and recommendaHon and
also to the county Planner. (all in favor)
(This property consists of apprcximate1y eight (8) acres located east of
Greeley Street and across from the Lily Lake Ice Arena and Recreation Cent6r -
pric~ $40,000 cash).

UNFINISHED BUSINESS
1. The award for the contract for the sweeper was deferred until the
March 12th meeting.
2. The Legislative Action Conference will be held on Thursday, February 28,
1974 at the new League Offices.
3. There are errors in the Radle Sunnyslope Addition and Mr. Kiamel stated
that this is the responsibility of the original party and suggested
that a letter be written to these property owners advising them What
has to be clone to get this plat recorded in the proper order.

On motion of Councilman peterson, seconded by Councilman
Thompson. the City Attorney and the City's Engineer were
directed to contact these people by letter regarding re-
platting this area.

1. On motion of Councilman peterson, seconded by councilman Balfanz the

2. On motion of Councilman peterson. seconded by Councilman Wohlers
Northern States Power Co. was permitted to install twelve anacle and
urd cables on Lakeview MellOrial Hospital property to protect the ga.
system.

On motion of Councilman Peterson, seconded by Councilman Thompson a
resolution was introduced -Employing Steven Glaser and Thomas Hubbard
as members of the Stillwater Volunteer Fire Department. (see resolutions).

4. On IIIOtion of Councilman Thompson. seconded by Councilman Peterson the City
Attorney. the City Coordinator, and the Director of Public Works ware

The City Coordinator was directed to send a letter stating there has
been no change in their position on this matter - Council is opposed.

Cl'rY COORDINATOR I S REpORT
1. The Council will hold a special meeting at 3:00 P. M. on wednesday.
February 27th with NSP regarding their proposed rate increases and
also to discuss the ~umper Truck bids.
2. On motion of Councilman Balfanz. seconded by Councilman peterson the Public
Safety Director was authorized to attend the Anbual Police Chiefs I Training
Institute at the Hopkins House, March 13--15. 1974.
3. The city Council and the Planning Commission will hold a joint meeting
at 1:30 P. M. on March 19. 1974 and at the same time they will interview
the applicants for membership on the commission.
