REGULAR MEETING The meeting was called to order by President Powell The Invocation was given by Mr. Marshall. Present: councilmen Balfanz, Thompson, Wohlers and President Al:aent: councilman Peterson Al.,o Present: city Coordinator, Marshall: city dent of Public works. INDIVIDUALS-DELEGATIONS-PETITIONS 1. EARL BRUCE appeared before the city council and turned over to the Mayor some shotgun shells which were found in the dump boxesbehind city Hall and asked that signs be posted or have an attendant there to watch these boxes. 2. This was the day and time set for a public hearing on the proposed assessments for Local Improvement No. 104 (owen street). The notice of the hearing was published in the Stillwater Evening Gazette, the official newspaper of the City on August 3, 1973 and copies were mailed to all property owners liable to be assessed. The Mayor opened the hearing. MR. MARSHALL read the proposed assessment roll for the benefit of those h. attendance. He stated that he had met with their attorney last May regarding the sidewalk which would be on the East side only but the cost would be shared by all of the owners. The contractor charged the County the same unit price and this has to be checked out to see if it was justified. If this is correct, then there was no real advantage to the property owners to eliminate the side- walk on the West side. originally the total was to be $12.50 including the sidewalk ann now the breakdown is -- Street Sidewalk Water Services Sewer Services $10.36 $ 2.19 $240.00 $233.00 The total should have been around $11.00 per foot eliminating half of the sidewalk if there was a corresponding decrease in the sidewalk cost. Base on these costs the assessment is $12.55 per foot. . // f 48 . (August 21. 1973 - continued) MAYOR POWELL said it can be lower than the $12.50 estimate but it canlt be higher. MR. MARSHALL recommended that the Council postpone adoption of this assess- ment roll until we can get a rebate from the County on the overcharge or have the city pick up the overcharge. MR. KIMMEL said that the people that were in the audience this evening should be heard at this time. DAVE MAGNUSON. attorney for the residents on Owen street said he was represent- ing 100% of the abutting property owners on both sides of the street. He said he met with Mr. Kimi.nel and Mr. Marshall and they talked about this stretch of road which was involved in project No. 32, sanitary Sewer separation and in project 65 and 66 in 1965 for the watermains and the resurfacing project No. 98 on st. Croix Avenue with interest around 6%. He said ITDnthly payments on their assessments are about $60.00 per DDnth. He urged that this work be done as reasonably as possible and in their negotiations they arrived at an understand- ing of possibly having a longer term to pay these assessments, especially on the stub-ins that they would not be assessed until they are put into use. In the agreement there was to be a bicycle path put in to the City LLmits which would eliminate $4.00 per foot from the project cost for the sidewalks that were eliminated and a smaller cost for the bicycle path which would hookup to the County's Trail. Part of the agreement was that they would pay half the price and get one sidewalk - 100 feet at $2.00 per foot is a substantial aIMunt of lOOney and he urged the Council that these property owners not bear this extra burden. MAYOR POWELL said that if we had done the project and paid the contractor we wou.:'ci have been aware of this fact, but this was done by the county. The sewer and water improvements were petitioned for - the rest of the project was done by the Cotmty. This council feels that because a resident lives on a county or State Aid Street that they should not get a free street, and that they WDuld be assessed the cost of an average residential street but in this particular instance we did not do this as the average residential street is now about $16.00 per foot. MR. MAGNUSON urged that on an average 100 foot lot which has been assessed about $3,000 since 1966, that some consideration should be given to some concession as it is hard to see that the property has been benefited to that extent. MAYOR POWELL suggested that this hearing be continued until such a time as the Council can secure the information regarding the cost of the sidewalks. MR. MARSHALL asked that it be continued to september 11th so that he could get in touch with the County on this matter. On ITDtion of Councilman Balfanz. seconded by Councilman Thompson the city Coordinator was requested to check out the cost of the sidewalks on the owen street project and request a refund if the contm ctor overcharged for them and continue the hearing on september 11, 1973. OLD BUSINESS 1. On IMtion of councilman Wohlers, seconded by Councilman Thompson the Mayor and the Fire Chief were authorized to execute the Mutual Aid Fire protection Agreement with the Lower St. Croix valley Fire Department. NEW BUSINESS 1. On motion of Councilman Wohlers, seconded by cruncilman Thompson a resolution was introduced "AUTHORIZING THE SALE OF $320,000 IMPROVEJ.'l.ENT BONDS". On motion of councilman Balfanz, seconded by Councilman wohlers a resolution was introduced "AWARDING THE BID FOR WeAL IMPROVEMENTS 117 arn 118 to JOHNSON BROS., MINNEAPOLIS AT A BID PRICE OF $277,535.00 (see resolutions). 3. On motion of Councilman Balfanz, seconded by Councilman Thompson a resolution was introduced "AUTHORIZING INTER-FUND TRANSFERS AS RECOMMENDED BY THE 1972 AUDIT". (see resolutions). 4. On motion of Councilman wohlers, seconded by councilman Thompson the council approved the contract for the Audit Agreement with DeLaHunt \'oto & Co. for the 1973 Audit with the thinking of possibly making a change to a local firm for 1974. 5. There will be 34 trees taken down during the 1973 construction work and with the use of state Aid lOOney they propose to plant about 100 trees (seedless Locust, ashes, sugar maples, etc.). The cost will be ~bout $120.00 per tree or about $12,000.00. On root ion of Councilman Wohlers, seconded by councilman Balfanz the City Coordinator was directed to draw up specifications for the replacement of trees and submit it to the State Highway Department and if approved, advertise for bids returnable on such trees by September 11, 1973. 6.-7. Mr. Marshall informed the Council that the coun,ty will be improving owen Street (Wilkins to Olive) and Myrtle street from owen to about Birchwood Drive next year and there will have to be a hearing held this fall on this improvement. (no action). 8. On motion of councilman Thompson, seconded by Councilman Wohlers the Council authorized the extension of the trailer permit for Joseph Naidyhorski, 121 North Greeley Street for an additional ~ixty days. 9. On motion of Councilman wohlers, seconded by couneilman Thompson a resolution was introduced "ACCEPTING THE QUOTATION OF THE JENNY EQUIP- MENT WASHER AT A PRICE OF $1,120.00 TO BARRY-SEWALL". (see resolutions) 10. On motion of Councilman Balfanz, seconded by Councilman Wohlers a resolution was introduced "ORDERING A HEARING ON THE IMPROVEMENTS FOR THE HOOLEY-FEELY PROPERTY" (Harold is to look into the matter and get it straightened out before we order the hearing - hearing date to be September 11, 1973.) (see resolutions). 11. Discussion was held on the condition of MCKusick Lake and the dam on the West side. Mike Kasun whn lives on the Lake said the lake is definitely a problem _ there no flowing water. He said we need a study of the lake by people who make a living at such work. MAYOR POWELL said the darn coves the water down. JEFF lVERS,'lN said there is scum on the bay on McKusick Lake and the level is down about a fool. There are bullheads and small sunfish in the lake. On motion of Councilman Balfanz, seconded by councilman Wohlers, Jack Shelton and Ray Marshall were directed to call the Department of Natural Resources to get some feedback and send a representative over to study the situation. LOCAL IMPROVEMENT NO. 118-1973". (see Resolutions) (Also acknowledging Receipt of the Feasibility Report). APPLICItTIONS on motion of Councilman Balfanz, seconded by councilman Wohlers the following contractor's Licenses were approved: H. R. S. Company 5045 sunnyside Road New Brighton. Paul, Minnesota 55112 Excavators (newl on motion of. councilman Wohlers, seconded by Councilman Thompson a License for the Disposal of Liquid waste Materials, ordinance No. 501 was granted to Kenneth seefert (pinky's croixland Rooter and cesspool Service). 1003 Mendel Road North. stillwater. Discussion was held regarding the dumping permits for these licenses and the city coordinator was directed to write a letter to these parties informing them of the cost of the dumping permits which they are suppose to obtain before dump- ing their loads into the sewage system. On motion of Councilman wohlers, seconded by Councilman Thompson an annual Dance Permit was granted to Jerry Bildstein (Stoneroller). 123 East MYrtle street. Stillwater (W. C. Fields Pub), with the stipulation that they keep the windows closed and that a police officer be in attendance at all times. (Mr. Kimmel commented on the matter of issuing dance permits to places with an On-sale Liquor License if they charge admission or have a cover charge). COMMtIN':ICATIONS From Garry B. Thompson of Thompson Disposal Service. Inc. regarding the possibility of bidding or providing refuse reRDval jobs for the Cit~- of Stillwater. (no action). From A. Dwayne Nelson, South Second and Churchill Street regarding extensive blasting work which could result in some damage to gas pipes or mains and asking what safeguards the city is taking regarding possible leaks and resulting explosions. Mr. Marshall was directed to write a letter regarding these possible leaks. From Bud Fraser. 512 North Main Street regarding the vehicle driveway entrance to cedar Street from North second Street. (no action). CITY COORDINATOR I S REPORT 1. Mr. Marshall reported the addition of a sidewalk t.o Fourth street. by the Library Door to the street to be added to the Sidewalk project No. lOB. f') on rootion of Councilman Balfanz, seconded by councilman wohlers the sidewalk for the library was added to Local Improvement No. 108. 2. on rootion of councilman Balfanz, seconded by councilman Thompson the council approved the request of the city coordinator to attend the Manager's convention in Boston, september 23 - 27, 1973. (Total cost about $325.00). "'" i'or4 CONSULTING ENGINEER 1. Mr. Elliott informed the council that he would be sending them a lengthy report as to the status of the work being done listing some of the concerns. He said that orfei might possibly complete the storm sewers this year. There are some problems regarding the completion of the intersections at Laure 1 and owen and Mulberry and owen. On motion of councilman Balfanz, seconded by councilman peterson the Engineer and the city coordinator were instructed to meet with the county officers and try to agree to make these connections. 2. Mr. Elliott requested that the city Attorney prepare an ordinance pro- hibiting the connection of storm drains to the sanitary sewers - the roof drains are a significant part in this system). l~ - 3. Thursday afternoon at 2,00 p. M. there is a meeting with the contractors. As of last Friday the street resurfacing had progressed to the point where the bituminous contractor could not do any additional streets because the utility companies were behind. '..I 4. on motion of councilman Balfanz, seconded by councilman wohlers a resolution was introduced "ACCEPTING PETITION FOR WATERMAIN IMPROVEMENT, WAIVING HEARING, ORDERING CHANGE ORDER TO LOCAL IMPROVEMENT NO. 112." (see resolutions) (North Fifth street) 5. Mr. Elliott said the current schedule calls for sewer openings to precede street work by 3,000 feet and as the construction season draws to an end this space will become closer. - . Mr. Abrahamson submitted a letter of recommendation for the police Department and the Council was requested to attend the Public Safety comri\ittee meeting at 6:30 P. M. on September 11th. 2. Mr. Abrahamson reported that the Fire Department has started the inspections - they have completed the downtown area from NSP up to Kolliners and the balance will be completed in about a month. On motion of Councilman Balfanz, seconded by Councilman Wohlers the city Coordinator was authaized to set up a meeting with Stillwater Township Board and their engineer regarding the storm sewer drainage from the Croixwood Addition across private and County owned property.
