P.EGULAR MEETING The meeting was called to order by President powell The Invocation was given by Mr. Marshall. present: Councilmen Balfanz, peterson, Thompson, Wohlers and President powell Absent: None Also Present: city coordinator, Marshall; city Attorney, Kimmel: Superintendent of Public Works. George Kutz, Joseph S. simonet, Gary Thompson and hiS father IHDIVIDUALS-DELEGATIONS-PETITIONS 1. This was the day and time set for a bearing on the petition to vacate a portion of North carnelian Street. The netice of hearing was published on July 5, 12, 19 and 26, 1973 and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing. JAMES ALEXANDER, 1201 North william, who owns a lot behind his bome on william street which is vacant, had hoped the street would be developed and that he would"have a building site, but had no immediate plans to do so. If this portion of the street were vacated he would have a one block area to the South of his home and lot which is down hill which would present some problems with respect to sewer and drainage. He also felt it was undesire- able to have a dead-end street at this point. ~YOR POWELL stated that Stillwater Avenue has been vacated and we could retain an easement for sewer if it was necessary. COUNCILMAN PETERSON questioned how big was his ~ot and MR. ALEXANDER said it was 80 x 100 feet and is a buildable lot. GARY CALVERLEY, 704 West Wilkins street, said he initiated the petition in order to get the necessary setbacks for his proposed garage and all of the property owners had signed the petition and he knew that Stillwater Avenue had been vacated. MAYOR POWELL asked Mr. Calverley if he would object to an easement being granted in the vacated portion of the street if it were needed for Mr. Alexander's lot and he stated as long as the ~ot is put back in the shape that it was before he had no objection. ALEXANDER asked about the lots behind the Nursing Home about their ingress and egress and MAYOR POWELL said these lots are owned by the Nursing Home and they have signed the petition. The Mayor closed the hearing at 7:50 P. M. On motion of councilman peterson, seconded by Councilman Balfanz a resolution was introduced "vacating a Portion of North Carnelian Street", subject to the granting of a twenty foot easement of the property owners involved as determined by the city Engineer. (see resolutions). 2. This was the day and time set for a public hearing on the request of Gary Calverley for a side yard lot variance at 704 West Wilkin street, Case No. 154. (' The notice of hearing was published on July 25, 1973 in the stillwater Gazette. the official newspaper of the city. on July 25. 1973 and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing. GARY CALVERLEY. 704 West Wilkin Street. submitted to the council members a drawing of the proposed location of his garage as revised by the planning commission at their meeting on August 6. 1973. ~~- The Mayor closed the hearing at 7;52 P. M. on motion of councilman peterson. seconded by Councilman Wohlers the council granted the variance to Mr. Calverley subject to the conditions set down by the Planning and zoning COmmission. 3. CHUCK FREDERICI<SON. 1602 MCJ(Usick Lane. asked the council when they plan to have the discussion on the condition of MCKuSick Lake and he was advised that this would be at the August 21st meeting and the residents would be advised when this would come before the council. 4. NEAL CASEY. 107 East Laurel Street. submitted to the Council a petition in the form of a letter to the City Council regarding the removal of trees on East Laurel Street for the improvement of said street. DAN MAC DONALD. 118 East Laurel Street. asked as an alternative that this street not be a State Aid Street and that it be withdrawn from such State Aid Street support as the traffic flow is very low. He asked that the Council give this very serious consideration - couldn't see the need that it be a State Aid Street. DUANE ELLIOTT said as it is presently planned the construction of this street would result in the removal of all of the trees and then replant some of them, which is option No. 1. option No.2 would be to move the street to the South '-~ to leave the trees on the North and replant the trees on the south. option No. 3 would be to remove the street from the State Aid Street program, which would automatically reJrDve Third to Fourth and take two blocks off the system and then designate two blocks somewhere else. MR. KIMMEL sair. we could reduce it to a normal residential street and assess as a normal residential street cost. MAYOR POWELL stated that the city policy on State Aid streets is that they pay a certain amount because it is a City policy no one should get a street for free - we do assess the residents for a regular rate for the better street~ We could have a change order in the construction plan and could save some of the trees. '-- . . \ I . . , . r-- J , ~ o r- I i... ~ I' ~ ~ ... ~ (August 7, 1973 - continued) --" 41 \ COUNCILMAN PETERSON said that we could suggest that perhaps we should refer this to the Consulting Engineer and the City Attorney and they present a recommendation at th~ next Council meeting with some kind of concrete report. On n>tion of Councilman Wohlers, seconded by councilman Balfanz, a resolution was introduced instructing the city Engineer and the city Attorney and the city Coordinator to work out a change order for the construction of East Laurel Street between North Second and North Third Streets. (see resolutions) MR. MAC DONALD requested that they just put the street back into shape and have no curbing, but the MAYOR stated that when this is done it breaks off and it will be rolled curbing (bituminous), if it is done to residential specifications. MR. ELLIOTT stated it would be recommended that there be no parking and no curb and that he will come up with a recommendation for the construction of this street.. 5. GEORGE KDTZ appeared before the Council giving the full history of the Lily Lake Beach and the events that occurred when he was on the Recreation Commission, and also some facts about the Brown's Creek area. Mr. Blekum had received quotations on the various aspects of the improvement of the Ramsey-Grove Park as follows: Electrical - Linner Electric (overhead) $1,493..00 - Greeder Blectric (underground) 82,140.00 Landscaping - David Junker 83,864.50 - Joe Bjorkman $3,339.00 Blacktopping - Junker Landscaping $4,250..00 - TOwer Asphalt Co. $2,500.00 Tables and SWing Set 8 250.00 Fencing 8 300_00 Miscellaneous S 650.00 Total $8,532.00 Discussion followed on these proposed improvements with the possibility of using seeding instead of sodding and to make use of City street lights for the park.. On motion of Councilman Balfanz, seconded by Councilman Wohlers the Council authorized the quotes under the top soil, seed, fencing, picnic tables, swing set, landscaping (with top soil and seed) and to contact the Northern States Power Co. in reference to using regular street lights for lighting in this area. ,,/ . . . . . . 42 \ . On motion of Councilman Peterson, seconded by Councilman B<,lfanz a resolution was introduced "Authorizing the Increase from $200.00 to $400.00 per year for the retirement benefits for the Volunteer Firemen" (see resolutions) 3. On RDtion of Counc.ilman Peterson, seconded by Councilman Wohlers a resolution was introduced for a Change order on L. I. No. 108 omitting sidewalks on Laurel Street near the intersection of Owen and adding the south side of West Willard Street fr~m South Third to South Fourth. (see resolutions). Lake. Minneapolis General Renewal John A. Dalsin & Son 2421 Bloondngton Avenue. Minneapolis Roofing Renewal COMMUHI:CATIONS None CI'l'Y' COORDINATOR'S REPORT 1. There will be a meet.ing on August 16, 1973 at White Bear Lake (Holiday House) on the Metro League ominibus Bill and asked that the Council plan to attend. 2. The matter of garbage disposal containers on the downtown City streets and sidewalks was discussed at great length regarding the liability in the case of an accident. Garry Thompson and his father were present to discuss this matter with the council. Jack Shelton and Ray Marshall are to work out some solutions to the problem regarding these containers especially on Water Street by Hooley's. the w. C. Fields pub, and Vittorio's Restaurant. 3. Mr. Marshall announced that there would be a meeting of the City Council regarding salaries for 1974 at 3 o'clock on Friday afternoon. August 10. 4. Mr. Elliott reported that it is possible that if the weather continues that the contractor will complete the storm water separation work this fall. 2. There have been complaints about the dust on the streets that are under construction and he will alert the contractor about putting chloride down on these streets. c'tTY ATTORNEY'S REpORT 1. Mr. Kinmel informed the council that Donald wagner is suing the city of stillwater in Conciliation court for $500.00 for a breach of contract on the Building Inspector position. The council directed the city Attorney to proceed with the case in conciliation Court on Monday. August 20.. 1973. 2. There is a temporary restraining order on the property which is in the city in the ,pending annexations. COMMI'l"'l'EE REPORTS PUBLIC. SAFE'1'Y 1.. The Fire protection contract for the Lower St. Croix will be reviewed by the City At~rney and the city coordinator and be presented at the next raeetinq for action. 2.. The Fire inspections will begin in the downtown area again. 3. There is a problem with a leaky roof in the fire hall and it will be taken care of.. PUBLIC WORKS 1. on notion of councilman peterson, seconded by councilman Thompson the council followed the recommendation of the committee and ordered the installation of a street light at 1904 North Fifth Street (Northerly Dead End of East poplar street). 2. Mr. Shelton advised that the sealcoating project is underway and that 25% is left to be done. 3. on notion of councilman peterson, seconded by councilman Balfanz a resolution was introduced "At1rUORIZING THE INSTALLATION OF NO PARJ(ING SIGNS ON THE SOUTH SIDE OF WEST ANDERSON STREET FROM SOUTH GREELEY TO 50mB EVERETT STREETS".
