Present: Councilmembers Bodlovick, Kimble, MacDonald and Mayor Peterson Absent: Councilmember Junker Also Present: City Coordinator Kriesel City Attorney Magnuson City Clerk Johnson Press: None Others: Neighbors from the Croixwood Blvd. and Marine Circle neighborhood. CONTINUATION OF DISCUSSION - ASSESSMENTS FOR L.I. NO. 219-1 & 2 Mayor Peterson explained the appeal process in regard to the assessments. He stated a number of appeals have been filed with the City Clerk. City Coordinator Kriesel presented the facts and adjusted figures on these assessments. Discussion centered on the age of the street, collector street, etc. The consulting engineers suggested that the amount to be assessed should be 46% for L.I. 219-1, and 40% for L.I. 219-2. Also, Mr. Kriesel contacted the City Engineer at White Bear Lake and he concurred with the policy Mr. Kriesel proposed. Mr. Palmer, a resident, stated he has a copy of the engineer's report which lists three options. He asked if all options were presented to the Council. Mr. Kriesel stated this information was presented to Council at the Improvement Hearing. Councilmember Bodlovick would like to see something concrete, fair and equitable for everyone in the City of Stillwater. Councilmember Kimble stated that in terms of maintenance, after 20 years, 100% should be charged to the property owners. Council discussed further stipulations for participation in the cost of the assessment by property owner and city. Councilmember Bodlovick suggested picking up 25% of the cost of the assessment. Councllmember Kimble stated it is not fair to expect the resi- dents to pay for the whole project when the street did not last as long as it should; and the same would hold true if it were a collector street. Motion by Councilmember Kimnle, seconded by Councilmember MacDonald to adopt the appropriate resolution authorizing the assessment roll for L.I. No. 219-1 and accepting the Engineer's recommendations for the assessment rate of 46% ($25,355.47) with an interest rate of 10% for 10 years. Nays -- Councilmember Bodlovick Motion by Council~mber Kimble, seconded by Councilmember MacDonald to adopt the appropriate resolution authorizing the assessment roll f!jl" L.I. Nays -- C~uncilmember Bodlovick Mayor Peterson stated that anyone who would wish to appeal the assessment roll as has been modified by Council must do so in writing before this meeting is adjourned. City Attorney Magnuson stated the appeals are first filed with the City and then the resident must file a notice of appeal with the Clerk of Court within 30 days. If they fail to do so, the appeal is dismissed. . Mr. Palmer thanked the Council for consideration on this assessment roll. ADJOURNMENT Motion by Councilmember Bodlovick, seconded by Councilmember MacDonald to adjourn the meeting at 5:53 P.M.
