Present: Councilmembers BOdlovick, Farrell, Kimble, Opheim and Mayor Abrahamson Absent: None Also Present: City Coordinator Kriesel City Attorney Magnuson Public Safety Director Mawhorter Community Development Director Russell Recording Secretary Schaubach Press: John Gillstrom, Stillwater Gazette Julie Kink, st. Croix Valley Press Others: Officer Leo Miller, Officer Bruce Klosowsky, Edward Simonet, Jr., David Meister, Steven Hooley, Ernie Feile, Kevin Pettee r PUBLIC HEARING This is the day and time for the Hearing to determine whether the liquor license of Meister's South Hill Liquor Store should be revoked or suspended for up to sixty (60) days or whether the City Council should impose a fine for failing to comply with Minnesota statutes prohibiting the sale of alcoholic beverages to a minor. Notice of the Hearing was mailed to Mr. Meister on March 9, 1989. Council heard testimony regarding the sale of alcoholic beverages to a minor by an employee of South Hill Liquor Store on February 14, 1989. City Attorney Magnuson called the following witnesses: Officer Leo Miller and Officer Bruce Klosowsky, the arresting officers, and Michael Brown, the minor who made the purchase at South Hill Liquor Store. Mr. Brown testified that he has never been in possession of a false identification card. r Edward Simonet, Jr., representing David Meister, called the following defense witnesses: David Meister, owner of South Hill Liquor; Steven Hooley, South Hill Liquor Store employee who sold the alcoholic beverages to Mr. Brown; Kevin Pettee and Ernie Feile, employees of South Hill Liquor Store. The defense witnesses testified that Mr. Brown had in the past shown an identification card indicating he was of legal age. Karl Ranum, 817 South 4th Street, spoke as a concerned citizen and stated that he has observed the carding process at south Hill Liquor store on several occasions. 1 r Stillwater City Council Minutes Special Meeting March 28, 1989 Motion by Councilmember Kimble, seconded by Councilmember Bodlovick to continue the hearing to 4:30 p.m. on Tuesday, April 4, 1989, and to allow the record to remain open to admit additional evidence, and to direct the Public Safety Director to investigate whether a Minnesota identification card was issued to Michael Brown. (All in favor) (Council took a five-minute recess and reconvened at 6:50 p.m.) REOUEST FROM RIVERTOWN TAXI Martin Withuski of Rivertown taxi, presented a request to use the building located at 823 South 4th Street as a temporary dispatching office during the month of April, until the Planning Commission has an opportunity to review the request. Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to approve a 30-day permit for use of the building located at 823 South 4th Street as a dispatching office for Rivertown Taxi. (All in favor) r-' PROPOSAL FOR DOWNTOWN BUILDING Don Nolde and Tim Nolde presented a proposal for a seven- level structure for the north end of Main Street. The first three levels would be enclosed parking, the next two levels would be executive hotel, and the top two levels would be either senior housing, or condominiums. The Noldes' requested Council members to indicate whether they would be in favor or not in favor of such a project. Motion by Councilmember Kimble, seconded by Councilmember Bodlovick to indicate to the Noldes that Council _e~ld ka~e HB provide more parking than is currently available at the site. (All in favor) OTHER BUSINESS ProDosed aoolication fee for downtown develooment - 0. ~ '- Motion by Councilmember Kimble, seconded by Councilmember Farrell to adopt the Community Development Director's recommendation for a $3,000 application fee for new development downtown. (All in favor) r-' I ~ Joint meetina with Oak Park Heiahts Citv Council - Council directed the City Coordinator to write a letter to the Mayor Sommerfeldt indicating the Council's desire to meet with the Oak Park Heights Council at 7:30 p.m. April 27, 1989. 2 approved the project concept only, but did not give any assurances that final approval or provi.sion for financial assi.stance would be given; and the project should r r (' Stillwater City Council Minutes Special Meeting March 28, 1989 Amendments to Emolovment Aareements Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to amend the employment agreements of Stephen Russell and Dave Mawhorter as recommended by the City Coordinator. (All in favor) Metro Prooertv Tax Coalition Luncheon Motion by Councilmember Kimble, seconded by Councilmember Farrell to recommend that Councilmember Opheim and City Coordinator Kriesel attend the luncheon sponsored by the Metro Property Tax Coalition on April 4, 1989.
