CITIZEN'S COMMENDATION Mayor Abrahamson presented Awards of Commendation for the rescue on the St. Croix River in January to Donald Anderson, Thomas Anderson, Gordon Seim, and Daniel Mosiman. (All in favor) 1 r Stillwater City Council Minutes Regular Meeting April 21, 1987 INDIVIDUALS & DELEGATIONS 1. Debbie Payson, Chamber of Commerce, Lumberjack Days - Ms. Payson briefly explained the plans for Lumberjack Days scheduled for July 23 through 26, 1987. Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to approve the request of the Stillwater Chamber of Commerce for the exclusive use of Lowell Park, with confi9uration as presented, and scheduled events at Pioneer Park and Lily Lake Recreation Area; the temporary liquor license, and beer permit during Lumberjack Days, July 23 through July 26, 1987. (All in favor) STAFF REPORTS 1. Finance- Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to approve McGladrey, Hendrickson, and Pullen to complete the study for Handicapped Accessibility Regulations in the City of Stillwater as required by the Office of Revenue Sharing. (All in favor) r Motion by Councilmember Bodlovick, seconded by Councilmember Farrell, to adopt the appropriate resolution appointing City Coordinator Kriesel as Assistant Treasurer. Public Safety - Motion by Councilmember Opheim, seconded by Councilmember Farrell to approve the refurbishing of the Police Dept. at an approximate cost of $10,244. (All in favor) 3. Comm.Dev.Director- Motion by Councilmember Bodlovick, seconded by Councilmember Opheim to waive the building permit fee for the building of canopies over picnic tables by the Junior High School students. (All in favor) r 2 r Stillwater City Council Minutes Regular Meeting April 21, 1987 Motion by Councilmember Opheim, seconded by Councilmember Farrell to approve the attendance of Commmunity Development Director Russell at the Annual Minnesota Planners Conference in Maplewood on May 7 and 8, 1987. (All in favor) 5. Parks & Recreation - Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to approve two Permits to Consume at Pioneer Park: Peggy Ellis, wedding reception, July 11, 1987; and the French-Canadian Society of Minnesota, July 12, 1987. (All in favor) 6. Consulting En~ineer - Mr. Davis explained the request by Mn/DOT for a resolution ho ding the State harmless against claims for allowing the narrower street for Churchill and Pine Streets. Mr. Magnuson explained the ramifications if the resolution is adopted. Motion by Councilmember Farrell, seconded by Councilmember Opheim to adopt the appropriate resolution indemnifying the State of Minnesota for granting a street width variance request. (Resol ution No. 7728) (\ Ayes - Councilmembers Bodlovick, Farrell, Opheim, and Mayor Abrahamson. Nays - None Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to authorize the submission of a letter to Mn/DOT of the City's intent to install lighting at the intersection of Churchill and First Street South. (All in favor) 7. City Coordinator - The City Council scheduled a special Meeting for Tuesday, April 28, 1987 at 6:30 P.M. to discuss the update of the Comprehensive Sewer Plan and the proposal for the Minnesota Zephyr. Mr. Kriesel explained there is another parcel of land that is 50% or more surrounded by the City and suggested annexation of this land from Stillwater Township. Motion by Councilmember Bodlovlck, seconded by Councilmember Opheim to send a notice of intent to Stillwater Township of the proposed annexation of land to the City of Stillwater. (All in favor) 8. This is the day and time for the public hearing on Case No. V/87-10, Variance request for a seven ft. variance to the sideyard setback requirement for construction of a three season porch at 1208 No. Broadway in the RB Residential Duplex Dist. Marge Knowlton, applicant. Notice of the hearing was published in the Stillwater Gazette on April 10, 1987 and copies were mailed to affected property owners. Ms. Knowlton explained she would like to construct a three-season porch on the side of her house because the house does not have a door leading from the back. Mr. Fontaine stated the Planning Commission approved the request, subject to the condition that the existing trees not be disturbed. Dick Zappa, Sussell Construction, was also present to comment on the request. Ms. Knowlton stated she would save the pine trees. Mayor Abrahamson closed the public hearing. Myrtle St. in the RB Duplex Residential Dist. Lynn and Sandra Monson, applicants. Notice of the hearing was published in the Stillwater Gazette on April 10, 1987 and copies were mailed to affected property owners. The Monson's explained they wish to purchase this property, and operate an interior design studio in their residence. There would be minimal traffic. Mr. Fontaine stated the Planning Commission unanimously approved this request. Mayor Abrahamson closed the public hearing. Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to approve the Special Use Permit for a Residential/Interior Design Studio at 320 W. Myrtle St., with the sign conditions proposed, for Lynn and Sandra Monson, 320 W. Myrtle St. (All in favor) 3. Troyer and Satu Suominen-Troyer, applicants. Notice of the hearing was published in the Stillwater Gazette on April 10, 1987 and copies were mailed to affected property owners. Mr. Troyer stated he wished to divide his property into two parcels and sell one of the parcels. The Planning Commission approved this request with the conditions that the new lot is suitable for a septic system and the final plat is approved by the City within six months of approval. Mayor Abrahamson closed the public hearing. Mr. Ron Schoenborn explained he would like to place the signs on the building for the various tenants and further explained the style and type of lettering to be used. The Planning Commission approved the request with conditions regarding size, style, color of signs, and that no signs shall face the apartments near by. Mayor Abrahamson closed the public hearing. Discussion followed by Council regarding amount of signage allowed, and placement of signs on building. Motion by Counci1member Bodlovick, seconded by Counci1member Opheim to approve the Variance request for a sign program including seven roof signs at 1060 Curve Crest Blvd. for LDR Company, subject to Planning Commission recommendations. (Ayes - 3; Nays - 1, Councilmember Farrell voted Nay). 5. Mr. Gullickson was not present to explain his request. r 5 r Stillwater City Council Minutes Regular Meeting April 21, 1987 Mary Webber, 205 W. Chestnut St., stated she a9reed with the Planning Commission's recommendation to deny this request. Kathy Oertle, who lives next door, stated she does not want an additional house built on the lot. Jerry Fontaine, Planning Comm. Chairman, stated the Planning Commission denied the request because it is not appropriate to build this type of structure at this location. r Jerry O'Brien, 201 So. 6th St., stated a thirty-foot structure is too tall for this location. Mayor Abrahamson closed the public hearing. Motion by Councilmember Bodlovick, seconded by Councilmember Opheim to deny the request for a Conditional Use Permit for construction of a 30 ft. tall Carriage House/garage with dwelling unit above, with a rear yard variance of 6 ft., 25 in. at 206 So. 5th St., by Ronald Gullickson. (All in favor> 6. This is the day and time for the public hearing on Brick Pond/So. Greeley/Forest Hills, Frontage Road, Street and Land Use Plan as an amendment to the Comprehensive Plan. Notice of the hearing was published in the Stillwater Gazette on March 6, 1987 and copies were mailed to affected property owners. Mr. Russell explained an area plan was drafted because of proposed development near by. Public facilities and land use for the area was studied. He further explained the current zoning, street configurations, drainage basins, and sewer and water plans. The Planning Commission recommended Plan No.5 be followed. Jeff Davis briefly reviewed the utilities for the area, including storm sewer, sanitary sewer, water services, and traffic configurations. Glen Van Wormer further explained the traffic situation. Robert Morrow, 1601 Morningside Rd., speaking on behalf of the Forest Hills residents, supported Alternate Plan 5. He stated concerns regarding the water pressure in Forest Hills and drainage with collection ponds. Gary Swager, a developer in the area, reviewed his request for rezoning. He made further statements regarding the fact that the property is not landlocked, he has access to sewer and water and dedicated street. He requested Council delay this item until the next meeting in order to present further plans. Scott McDonald, an attorney for the Augustine brothers, stated they are opposed to the plan and it will affect their investment. r , 6 r Stillwater City Council Minutes Regul ar Meeting April 21, 1987 r Mr. Fontaine stated a concern about a large structure being built on top of the hill and stated the height should be kept low. Steve Wolff, 701 Harriet Drive, stated the Augustine brothers never attended any of the Planning Commission meetings where this item was discussed. The residents would like lower density development. He has a concern with the north/south Street which is the only buffer between his house and any proposed development. Gary Swager stated he will withdraw his request for rezoning; that he did not want to build Industrial/Commercial, but rather Multi-family units. Further discussion followed regarding the merits of continuing the public hearing and the City Attorney commented on the market value question. Mr. Swager stated that if Council does not act on his request for continuance, he will ask them to consider medium density for fifteen units per acre. Mayor Abrahamson closed the public hearing. Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to approve Alternate Plan No.5 for Brick Pond/So.Greeley/Forest Hills, Frontage Road Street and Land Use Plan as an amendment to the Comprehensive Plan. (All in favor). Council recessed for five minutes and reconvened at 8:40 P.M. UNFINISHED BUSINESS 1. David Majeski - Continuation of discussion regarding request for sewer assessment removal. Mr. Majeski reviewed his request for removal of a sewer stub-in and assessment at 801 W. Sycamore Street. Considerable discussion followed. Mr. Majeski also requested Resubdivision of his property. Council referred the request for resubdivision to the Planning Commission. 2. Final Approval - Case No. PUD/87-9, Modifications & Refinements to PUD for Woodland Lakes project. City Attorney Magnuson reviewed the request, stating its approval is subject to a Findings of Fact which he presented. Mary Senkus from the Oppenheimer firm was present on behalf of the Woodland Lakes project. Since the Council was short one member this evening, this item was tabled until the Special Meeting on April 28, 1987 at 6:30 P.M. 3. Possible Second Reading of Ordinance amending Chap. 22.01 - Council Meeting Times. o 7 r Stillwater City Council Minutes Regul ar Meeting April 21, 1987 Motion by Councilmember Bodlovick, seconded by Councilmember Farrell for a second reading and approval of Ordinance 660, Amendin9 Chap. 22.01, regarding Council Meeting times. Ayes - Councilmembers Bodlovick, Farrell, Opheim, and Mayor Abrahamson. Nays - None Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to adopt the appropriate resolution setting Council Meeting times at 4:30 P.M. and 7:00 P.M. for the first Tuesday of the month and 7:00 P.M. for the second Tuesday of the month. (Resolution No. 7727) Ayes - Councilmemers Bodlovick, Farrell, Opheim, and Mayor Abrahamson. Nays - None 4. Final Resolution for $3,500,000 lOB Refunding (Oak Glen). Motion by Councilmember Farrell, seconded by Councilmember Opheim to adopt the appropriate resolution for $3,500,000 lOB Refunding for Oak Glen. Resolution indemnifying State of Minnesota for street width variance (Pine and Churchill Streets). See Consulting Engineer's report. NEW BUSINESS 1. Special request for Special Use Permit for Land Reclamation at 260 Deerpath Ct. in the RA Dist. - Dennis Strohkirch, All Construction, appl icant. Mr. Strohkirch was present to explain his request. Mr. Russell stated a permit is required when lots are filled because of drainage problems. Mr. Davis further explained the drainage for the area. Doug Plunkell, 254 Deerpath Ct., stated he is agreeable to a swale, but has a concern about the grading and asked who will pay the costs for this. City Attorney Magnuson stated this will be a condition of the approval and will be paid by the applicant. Another man living on Deerpath Ct. had a concern regarding a permanent easement across Lot 7 and the permanent location of a swale. (" 8 ~ Stillwater City Council Minutes Regular Meeting April 21, 1987 Motion by Councilmember Farrell, seconded by Councilmember Opheim to approve the Special Use Permit request of Dennis Strohkirch, All Construction, for land reclamation of two lots located east of 254 Deerpath Court, subject to the recommended conditions. (All in favor) 2. Street Vacation Review - Mr. Russell presented this review, recommending Planning Commission input for these requests and a fee be established to cover publication and staff costs. Motion by Councilmember Bodlovick, seconded by Councilmember Opheim to approve a review of requested street vacations by the Planning Commission and the establishment of a $50.00 street vacation application review fee.
