RESOLUTION NO. 8231 VACATING A PORTION OF EAST LINDEN STREET WHEREAS, a Petition was presented praying for vacation of a part of East Linden Street in the City of Stillwater, Minnesota, hereinafter described; and WHEREAS, the City Council did determine that the Petition was sufficient; and that the City is a Home Rule Charter City of the Third Class and that it was proper for the City Council to proceed with the vacation pursuant to Minnesota Statutes 440.135; and WHEREAS, at a meeting duly called for that purpose, the City Council did on the 2nd day of January, 1990, determine that the proposed vacation would not interfere or defeat the public interest or adversely affect the public, and that it would be in the best interests of the City of Stillwater that a portion of the street be returned to the tax rolls. o NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, that the petition be granted in the form hereafter set forth and that the following part of Oak Street, presently laid out and platted, be and the same is hereby vacated: All that part of platted Linden Street, as the same is shown on Myron Shepards Perfected Plat of the Original Town, now City of Stillwater, on file and of record in the Office of the Registrar of Titles in and for Washington County, Minnesota, as Torrens Document Number 56897, lying easterly of a southerly projection of the westerly line of Registered Land Survey Number 28, as the same is on file in said Office of the Registrar of Titles. BE IT FURTHER RESOLVED, that a copy of this Resolution duly certified by the City Clerk shall be recorded in the office of the County Recorder, Washington County, Minnesota.
