RESOLUTION NO, 8177 r ADOPTDlG ASS:ESSMEllT 1fOODLA!lD LAKES DEVELOPMEHT EROSION CONTROL WHEREAS, pursuant to proper notice duly given as required by law, the City Council met, heard and passed upon all objections to a proposed assessment for the service charge due to the City of Stillwater for erosion control measurers undertaken on the Woodland Lakes Development site in accordance with a development agreement entered into by and between the City of Stillwater and Robert Scott Companies, Inc. on the 30th day of December, 1986, and WHEREAS, on the 24th day of June, 1988, the City adopted Resolution No. 7928, a resolution adopting an assessment for that project duly certified to the Auditor of Washington County by certificate dated June 24, 1988, and WHEREAS, certain charges relating to this erosion control were unknown by the City at the time the assessment roll was adopted and, since certain charges were based upon estimates rather than costs of work, and, WHEREAS, it is necessary ,for the City to assess the full cost of the erosion control in accordance with the development agreement and in accordance with City Ordinance No. 38.01, HOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF !BE CITY OF STILLWATER, MIHNESO'lA: 1. The proposed assessment is hereby accepted and shall constitute a special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefitted'by the proposed improvement in the amount of the assessment levied against it; the assessment is as follows: r Parcel No. 9032-2610 Parcel No. 9032-2612 Total Interest Rate: 8.5\ $ 8,164.58 $ 5,912.28 $14,076.86 2. The assessment shall be payable in one annual installment, the installment to be payable on or before the first Monday in January, 1990, and shall bear interest at the rate of 8.5 percent per annum from the date of the adoption of this assessment resolution. To this installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1990. 3. The clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County.
