HomeMy WebLinkAbout8104 (Res.) r r r RESOLUTION NO. 8104 LOCAL IMPROVEMENT NO. 251 WHEREAS, the plans and specifications for Local Improvement 251 have been duly approved by the Stillwater City Council and the improvement ordered, and a contract entered for the construction of the improvements; and WHEREAS, it appears from a report from the City Attorney and City Engineer that efforts to negotiate necessary easements from property owners have not been immediately successful; and WHEREAS, it appears necessary that the City will be required to purchase certain easements, NOW, THEREFORE, BE IT RESOLVED, that 1. The City Attorney is authorized to obtain appraisals for the drainage easements necessary for the project for the Zantigo, Burger King, Smith, Tomaszek and Borovsky properties. He is further authorized to offer as compensation to these property owners the amount of the City Appraiser's estimate of damage and if necessary, to begin the process of Eminent Domain, in order that the easements necessary for the completion of the project be obtained in a timely manner.
