RESOLUTION NO. 7907 r RESOLUTION VACATING PART OF WATER STREET WHEREAS, a Petition was presented praying for vacation of a part of Water Street in the City of Stillwater, Minnesota, hereinafter described; and, WHEREAS, the City Council did determine that the Petition was sufficient; and the City is a Home Rule Charter City of the Third Class and that it was proper for them to proceed with the vacation pursuant to Minnesota Statutes 440.135; and WHEREAS, at a meeting duly called for that purpose, the City Council did on the 3rd day of May, 1988 determine that the proposed vacation would not interfere or defeat the public interest or adversely affect the public and that it would be in the best interests of the City of Stillwater and the abutting owners that the portion of street be returned to the tax rolls. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the Petition be in the same is hereby granted, that the following parts of Water Street as presently laid out and platted, be and the same are hereby vacated: r All that part of North Water Street lying northerly of the northerly line of East Mulberry Street and lying southerly of the southerly line of East Laurel Street, as set out in a resolution and attached plat and survey recorded in Book 74 of Deeds, Page 122, on file and of record in the Office of the County Recorder of Washington County, Minnesota, said Mulberry and Laurel Streets being dedicated public roads as shown on Myron Shepards perfected plat recorded as Doc. No. 416069 in said Office of the County Recorder, except and reserving to the City of Stillwater a 20 foot easement for utility and walkway purposes over the easterly 20 feet thereof, which easement shall be appurtenant and to run with and bind the land. BE IT FURTHER RESOLVED, that a copy of this Resolution duly certified by the City Clerk shall be recorded in the office of the County Recorder of Washington County, Minnesota.
