RESOLUTION NO. 7824
RESOLUTION ADOPTING ASSESSMENT
FOR LOCAL IMPROVEMENT NO. 220
PINE AND CHURCHILL STREETS
CITY OF STILLWATER. MINNESOTA
WHEREAS. pursuant to proper notice as required by law, the Council has met
and heard and passed upon all objections to the proposed assessment for the
following local improvement:
The Construction and reconstruction and resurfacing of a portion of
Church1ll and Pine Streets, including sidewalks, according to municipal
state aid standards; the repair and reconstruction and replacement of
san1tary sewer including the replacement or rehabilitation of manholes;
the repair of water mains and water serv1ces where needed; the
replacement, rehabilitation and repa1r of storm sewer facilities within
the project area including manholes, catch basins and catch basin leads;
the replacement, repair and rehabilitation of retaining walls where
needed; and other work that dur1ng the project is found to be necessary
to protect the health, safety and welfare of the abutting property.
NOW, THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER,
MINIlESOTA:

1. The proposed assessment, which is made a part hereof, is hereby
accepted and shall constitute the special assessment against the
lands named therein, and each tract of land therein included is
hereby found to be benefited by the proposed improvement in the
amount of the assessement levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of 10 years, the first of the installments to
be payable on or before the first Monday in January, 1988 and shall
bear interest at the rate of e1ght and three quarters per cent
(8-3/4%) per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the
entire assessment from the date of this resolution until December 31,
1988. To each subsequent installment when due shall be added
interest for one year on all unpa1d installments.
3. The owner of any property so assessed may, at any time prior to
certification of the assessment to the County Auditor, pay to the
City Treasurer the entire assessment or any portion thereof on such
property, w1th 1nterest accrued to the date of payment, except that
no interest shall be charged if the payment is made w1thin 30 days
from the adoption of this resolution; he may thereafter pay to the
county treasurer the installment and interest in process of
collection on the current tax list, and he may pay the remaining
princ1pal balance of the assessment to the c1ty treasurer. Such
payment must be made before November 15 or interest will be charged
through December 31 of the next succeeding year. Should a partial
prepayment be made, the remainder of the assessment shall be spread

in equal payments for the remainder of the life of the original
assessment at the rate of interest established by this resolution.
Partial prepayments are authorized by Stillwater City Code Chapter
56.06.
Under Minnesota Statutes Sect10n 435.193 to 435.195 and Stillwater
City Code, Chapter 56.05, the Council may, in its discretion, defer
the payment of this special assessment for any homestead property
owned by a person 65 years of age or older or retired by virtue of a
permanent and total disability for whom it would be a hardsh1p to
make the payments.
The option to defer the payment of special assessments shall
terminate and all amounts accumulated plus applicable interest, shall
become due upon the occurrence of any of the following events: (a)
the death of the owner, prov1ded that the spouse is otherwise not
e11gible for the benefits hereunder; (b) the sale, transfer or
subdiv1sion of the property or any part thereof; (c) if the property
should for any reason lose its homestead status; or (d) if for any
reason the taxin9 authority deferring the payments shall determine
that there would be no hardship to require immediate or partial
payment.
Any assessed property owners meeting the requirements of this law and
the ordinance adopted under it may, upon adopt10n of the assessment,
apply to the City Clerk for the prescribed form for such deferral of
payment of the special assessment on the property.
5. The Clerk shall forthw1th transmit a certified duplicate of this
assessment to the County Auditor to be extended on the property tax
lists of the County, and such assessments shall be collected and paid
over in the same manner as other munic1pal taxes.
