HomeMy WebLinkAbout2018-132 (findings of fact denying the final plat for Heritage Ridge) RESOLUTION 2018-132 RESOLUTION ADOPTING FINDINGS OF FACT, CONCLUSIONS AND ORDER RELATED TO HERITAGE RIDGE FINAL PLAT AND DEVELOPMENT AGREEMENT CPC CASE NO 2018-24 BE IT RESOLVED, by the City Council of Stillwater, Minnesota that the Findings of Fact, Conclusions and Order related to the Final Plat and Development Agreement for Heritage Ridge at 1902 William Street North are hereby approved and authorizes the Mayor and City Clerk to sign the said Findings of Fact, Conclusions and Order. Ward, City Clerk STATE OF MINNESOTA CITY OF STILLWATER COUNTY OF WASHINGTON BEFORE THE CITY COUNCIL In Re: The Application of Fairway Development FINDINGS OF FACT CONCLUSIONS AND CPC Case No. 2018-24 ORDER The City Council convened the meeting scheduled for 7:00 p.m. on June 5, 2018 at the Council Chambers in City Hall on the Application of Fairway Development ("Applicant") for approval of a Final Plat and Development Agreement for Heritage Ridge (formerly known as Hazel Place), an 8 lot single-family development. At the meeting, the City Council considered the report of Bill Turnblad, City Community Development Director, and testimony and exhibits submitted by the Applicant. NOW, THEREFORE, based upon the documents that have been made a pan of this file, upon the testimony of all those who offered it, and upon all the files, records and proceedings berein, the City Council makes the following: FINDINGS OF FACT 1. This site is located south of the property at 1902 North William Street and is legally described on Exhibit "A." 2. The Applicant is requesting consideration of a Final Plat and Development Agreement for an 8 lot single-family development. 3. On September 5, 2017, the City Council adopted Resolution No. 2017-163 which indicated"the total number of lots is limited to seven public one stormwater outlot"was a condition of approval of the Preliminary Plat. CONCLUSION OF LAW 1. That this matter was properly before the City Council pursuant to the procedure set forth in the City Code. 5. That based upon the findings, the Final Plat and Development Agreement fail to meet the Preliminary Plat approval conditions set forth by the City Council. 6. That the owner remains with reasonable use of the property. ORDER IT IS HEREBY ORDERED 1. The Final Plat is denied. 2. The request for the Development Agreement is denied.
