HomeMy WebLinkAbout2018-123 (Development Agreement for Nottingham Village)RESOLUTION 2018-123 CITY OF STILLWATER WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING THE DEVELOPMENT AGREEMENT FOR NOTTINGHAM VILLAGE CASE NO. 2018-28 WHEREAS, Greg Johnson, Chief Manager, McKusick Road Properties, LLC made application for approval of the final plat known as NOTTINGHAM VILLAGE; and WHEREAS, on December 13, 2017 the Stillwater Planning Commission held a public hearing and recommended approval of the preliminary plat and preliminary plans; and WHEREAS, on January 2, 2018 the City Council held a public hearing on the preliminary plat and preliminary plans and found them to be compatible with the neighborhood and consistent with the City' s Zoning Ordinances, Subdivision Ordinances, Comprehensive Plan, and infrastructure; and WHEREAS, on May 15, 2018 the Stillwater City Council reviewed the final plat and final plans for NOTTINGHAM VILLAGE and found them to be consistent with the preliminary plat and plans. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby approves the Development Agreement for NOTTINGHAM VILLAGE with the following conditions: 1. The site shall be developed in substantial conformance with the following plans on file with the Community Development Department, except as may be modified by the conditions herein: • Site Layout, Lighting and Signage Plan Sheet C3 Dated 4/27/18 • Grading Plan Sheet C4 Dated 4/27/18 • Erosion Control and Site Restoration Sheet C5 Dated 4/27/18 • Utility Plan Sheet C6 Dated 4/27/18 • Sanitary Sewer and Water Main Sheet C7 & C8 Dated 4/27/18 • Storm Sewer Sheet C9 Dated 4/27/18 • Street Plan and Profile Sheet C10 Dated 3/1/18 • Landscape Plan Sheet L1 Dated 5/30/18 2. All civil engineering plans shall be found satisfactory to the City Engineer, or revised to his satisfaction, prior to release of the final plat from City Offices for recording with Washington County. 3. Removal of the existing temporary cul-de-sac on 87' St North will be required of the developer. The letter of credit, or other public improvement security as approved in the Development Agreement for the project, will not be released until this work is completed. 4. An escrow will be required for the future extension of the 35 feet of street to the east property line, as well as removal of the temporary street connection to McKusick Road. The amount shall be found satisfactory to the City Engineer, and be deposited with the City prior to release of the final plat from City Offices for recording with Washington County. 5. Only 35% of each lot is permitted to be covered by impervious surfaces. 6. The Development Agreement must be found satisfactory to the City Attorney and City Engineer and executed by all parties prior to commencing any tree removal or grading on the site, prior to holding a pre -construction meeting with the City Engineer for the project, and prior to release of the final plat from City Offices for recording at Washington County. 7. A total of $35,000 shall be paid to the City for park and trail dedication fees. These fees shall be submitted to the City prior to release of the final plat from City Offices for recording with Washington County. 8. All electrical and communications utility lines shall be buried. 9. The Developer will be responsible for paying the Trout Stream Mitigation Fee of $26,692.68; the Transportation Mitigation Fee of $34,702.29; and trunk sewer and water fees of $50,334.96. These fees will be due prior to release of the final plat from City Offices for recording with Washington County. Except that the transportation mitigation fee will be spread on the tax rolls for the lots, rather than be collected at time of plat release. 10. The Letter of Credit required by the Development Agreement shall cover the cost of all landscaping and replacement trees that are to be planted on the site. When planted and inspected by the City, the Letter of Credit amount will be allowed to be reduced by the corresponding amount. 11. Site construction traffic and home construction traffic must gain access to the site via McKusick Road and may not drive through the 87th Street neighborhood. The only exception is for the model home which will be built on Lot 7, Block 1. Enacted by the City Council of the City of Stillwater, Minnesota this 5th day of June, 2018.
