HomeMy WebLinkAbout2018-125 (Development Agreement for Boutwell Farm) RESOLUTION 2018-125 CITY OF STILLWATER WASHINGTON COUNTY,MINNESOTA A RESOLUTION APPROVING THE DEVELOPMENT AGREEMENT FOR BOUTWELL FARM CASE NO. 2018-26 WHEREAS, Kevin vonRiedel, Sovereign Land Services, LLC made application for approval of the final plat known as BOUTWELL FARM; and WHEREAS, on March 14, 2018 the Stillwater Planning Commission held a public hearing and recommended approval of the preliminary plat; and WHEREAS, on April 3, 2018 the City Council held a public hearing on the preliminary plat and preliminary plans and found them to be compatible with the neighborhood and consistent with the City's Zoning Ordinances, Subdivision Ordinances,Comprehensive Plan,and infrastructure; and WHEREAS, on June 5, 2018 the Stillwater City Council reviewed the final plat and final plans for BOUTWELL FARM and found them to be consistent with the preliminary plat and plans. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby approves the Development Agreement for BOUTWELL FARM with the following conditions: 1. The site shall be developed in substantial conformance with the following plans on file with the Community Development Department, except as may be modified by the conditions herein: • Site Plan Sheet C2.0 Dated 4/20/18 • Site Plan Road Profile Sheet C2.1 Dated 4/20/18 • Site Plan Details Sheet C2.2 Dated 4/20/18 • Grading Plan Sheet C3.0 Dated 4/20/18 • Utility Plan Sheet C4.0 Dated 4/20/18 • Stormwater Utility Plan Sheet C5.0 Dated 4/20/18 • SWPPP Sheet C6.0 Dated 4/20/18 • Tree Pres and Protection Plan Sheet EX-3A Dated 4/20/18 • Tree Replacement Plan Sheet EX-4 Dated 4/13/18 2. All civil engineering plans shall be found satisfactory to the City Engineer, or revised to his satisfaction, prior to release of the final plat from City Offices for filing with Washington County. 3. An escrow for removal of the temporary street connection to Boutwell Road,in an amount found satisfactory to the City Engineer, shall be deposited with the City prior to release of the final plat from City Offices for recording with Washington County. 4. A Development Agreement found satisfactory to the City Attorney and City Engineer must be approved by the City Council and signed by the Developer prior to commencing any tree removal or grading on the site, prior to holding a pre-construction meeting with the City Engineer for the project, and prior to release of the final plat from City Offices for recording with Washington County. 5. A total of$22,500 shall be paid to the City for park and trail dedication fees. These fees shall be submitted to the City prior to release of the final plat for filing with the County. 6. All electrical and communications utility lines shall be buried. This shall be specified in the plans submitted for final plat approval. 7. The Developer will be responsible for paying the Trout Stream Mitigation Fee of$6,100 per developable acre; the Transportation Mitigation Fee of $8,379 per developable acre; and trunk sewer and water fees of$17,481 per developable acre. These fees will be due prior to release of the final plat from City Offices for recording with Washington County. Except that the transportation mitigation fee will be spread on the tax rolls for the lots, rather than be collected at time of plat release 8. The developer proposes that the builder will plant the street trees. To guarantee that this will be done, the developer will be required to escrow the cost of the trees prior to release of the final plat. When the City is satisfied that they have been planted properly on a lot, the escrow amount for those trees will be released to the developer. 9. Materials may not be stored in the critical root zone of trees to be saved, nor may equipment or materials be leaned or stacked against trunks of trees identified to be saved. 10. The easement for the existing City trail will be signed by the landowner prior to release of the final plat from City Offices for recording at Washington County. 11. The sidewalk along Boutwell Farm Road should not be constructed. Enacted by the City Council of the City of Stillwater, Minnesota this 5th day of June, 2018.
