AGENDA 1. Approval of the April 23, 2018 Minutes 2. Open Forum - The Open Forum is a portion of the meeting to address the Board on subjects which are not a part of the meeting agenda. The Board may take action or reply at the time of the statement or may give direction to staff regarding investigation of the concerns expressed. Friends of Stillwater Area Dog Park Water Request Information Items Commission Items/To iics CITY OF STILLWATER PARKS AND RECREATION COMMISSION MEETING April 23, 2018 Present: Chairwoman Linda Amrein, Commissioners Scott Christensen, Rob McGarry, Bill McGlynn, Sam Nelson (arrived at 7:06), Sandy Snellman; Council Representative Mike Polehna Absent: Commissioner David Brandt Staff: Public Works Superintendent Tim Moore APPROVAL OF MINUTES Possible approval of March 26, 2018 meeting minutes Motion by Commissioner Snellman, seconded by Commissioner McGlynn, to approve the March 26, 2018 meeting minutes. All in favor, 6-0. OPEN FORUM There were no public comments. ACTION ITEMS Pioneer Park Restroom Public Works Superintendent Moore introduced architect Mark Balay. Mr. Balay reviewed two options for a Pioneer Park restroom building. Both resemble the Lowell Park restroom. The larger option is 646 square feet and the other is about 75 square feet smaller, more square with a hip roof. He stated that the square building will cost less to build. The larger building has a similar entrance arrangement to the one in Lowell Park with men and women on the same side and a water fountain in middle. The smaller option has men's and women's entrances on different sides. Chairwoman Amrein asked if the stall doors and the building doors will have push buttons for handicapped accessibility. Mr. Balay replied the doors are required to swing out but he doesn't believe this facility triggers the requirement for push button doors. Public Works Superintendent Moore clarified that the requirement relates to the amount of force it takes to open the door. Push buttons are for heavy doors that can't be otherwise easily opened. Councilmember Polehna said he would prefer both entrances be on the same side so parents can watch their children. From a maintenance standpoint there would be more storage in the larger building. He prefers the larger building option. Mr. Moore stated that construction is scheduled to start after Labor Day. The restrooms will be closed throughout the fall. Parks and Recreation Commission Meeting April 23, 2018 Commissioner Christensen asked how best to prevent vandalism. Mr. Balay replied many things can be done such as using more durable equipment and creating an environment where vandals would be seen. He thinks the location lessens the likelihood of vandalism because there's no place to hide around the building. Mr. Moore stated a public informational meeting will take place at the May 21st Commission meeting. After gathering public comments, the Commission will be asked to make a recommendation to the City Council for approval on July 3rd. Northland Park Pro'ects Public Works Superintendent Moore reported that horseshoe pits are being replaced at Northland Park with help from the Horseshoe League. He led discussion of other potential improvements, including: enlarging the outdoor pleasure rink and paving the trail entrance into the park on Bayberry Avenue. He reported there is $40,000 in the 2018 Parks Capital Outlay budget that could be used for these projects. Commissioner Snellman expressed concern that putting dark surfaced asphalt on the Bayberry entrance would create safety problems for sledders that frequent the hill, due to melting in the center. Mr. Moore replied that a trail could be put to one side and wouldn't take up much room. Commissioner Snellman also questioned whether the Bayberry and Hawthorne entrances are too steep for a trail. Mr. Moore responded that to meet ADA requirements, some landings may need to be graded into the trails. Commissioner Snellman said she doesn't think paving is needed. Councilmember Polehna suggested putting the money into a 72nd Street trail near the Jackson Wildlife Area to connect with Liberty and Legends neighborhoods. Commissioner Christensen agreed but added that more than $40,000 would be needed. Mr. Moore stated it could be done in phases. Commissioner Christensen brought up past discussions about making Northland Park more of a gateway entrance to the City. If a trail is not the answer, maybe something else could be done. Commissioner Snellman and Chairwoman Amrein agreed. Mr. Moore stated he will look at other options for spending the budgeted funding. INFORMATION ITEMS Bridgeview Park and Downtown Trail Update Public Works Superintendent Moore updated the Commission on construction of the south loop trail from Sunnyside to the southern boundary of Stillwater. Construction will start this week. A portion of Highway 95 will be closed for up to three weeks to do storm sewer work. The trail from Nelson to Chestnut will be done before Memorial Day weekend. Page 2 of 3 Parks and Recreation Commission Meeting April 23, 2018 COMMISSION ITEMSITOPICS Council items Councilmember Polehna reported that Council is looking at constructing a small boat launch near the pump station utilizing $400,000 surplus DNR funding. He also informed the Commission that the Council is requesting $1.6 million from the state legislature to re -do the shoreline from the Dock Cafe to Sunnyside. The shoreline has eroded and is close to City sewer line. The plans include cantilevering the trail from the Shoddy Mill to the Dock Cafe. Commissioner Christensen asked how it came to be that vehicles can drive on the trail. Councilmember Polehna replied the trail is on City property but the other part is not; he is not sure how the arrangements were done originally. Mr. Moore pointed out that St. Croix Boat and Packet owns property along there too. It's a compromise solution. Chairwoman Amrein thanked Councilmember Polehna for his efforts in organizing the recent parade recognizing state champions. During this time we have focused on creating a preliminary layout and design for the bathroom facility. Attached are concept plans that have been developed to date. The concepts provide a variety of ideas that could be implemented and are by no means meant to limit what could be developed within the project area and many of the elements are interchangeable between the plans. A public information meeting/open house will be held on Monday, May 21, 2018 from 7 PM to 8 PM in the Council Chambers with the Park and Recreation Commission to present the plans to the public and seek input. Mark Balay along with staff from the City of Stillwater will be on hand to answer questions and receive public input. Notices of the meeting have been sent to IBA, CVB, Chamber, Council and Heritage Preservation Commission. A year ago the Friends of Stillwater Area Dog Park made a request to the city for the installation of a water storage tank and a way to fill the tank for use at the dog park. Staff reviewed the request at that time and denied the request because of sanitary conditions of the water and not having proper equipment for transfer and filling of the tank. There are 10 city parks that have a drinking fountain: Pioneer, Washington, Lowell, Lily Lake, Northland, Staples, Creekside, Settlers, Heritage and Teddy Bear Park. DISCUSSION There are two possible sources to provide water service to the dog park. (See attached map) The first is from the waterman located on the south side of Myrtle Street approximately 600 feet from the dog park. This would require boring underneath Myrtle Street and installing the service in an area where there is a land use restriction from the Minnesota Pollution Control Agency. The MPCA and the possibly Department of Health would have to review any work in this area prior to installation. The second location would come from the water service that serves the Jaycee Ballfields and is owned by the Stillwater School District. This service comes from Meadowlark Drive and serves the bathroom facility near the ballfields. This location is located about 550' from the dog park. An agreement would have to be made with the school district for this connection and further exploration would need to be made on the soil conditions and what the boundaries are on the MPCA restrictions for the site. Included in this memo is a copy of the agreement with the Friends of Stillwater area Dog Park for your review. Representatives from the Friends of Stillwater area Dog Park will be at the meeting to give a presentation and answer any questions you have. RECOMMENDATION The Parks and Recreation Commission should review the request from the Friends of Stillwater area Dog Park, and direct staff on how to proceed, and discuss who would be responsible to fund this proposed project. Currently park users are hauling in our own water using milk and water jugs. This method is cumbersome, time consuming and back breaking. These jugs are also unsightly and unsanitary. Other City Parks have fresh running water available for human and pet consumption. We believe this should be extended to the Dog Park as well. Running water will also allow for the planting of trees, and grass, enhancing the function and appearance of this popular park. Friends has been formed by individuals from the community with an interest in obtaining a portion of the necessary funding for the development of the Dog Park. The City and Friends wish to agree to cooperate in this effort, and to set forth their respective responsibilities with regard to the fundraising efforts. NOW THEREFORE, for valuable consideration, the parties hereto agree as follows: 1. That Friends has the authority to make representations to donors only as authorized by the City. 2. That funds solicited shall be made payable to the City of Stillwater, and retained in trust by the City for capital funding for the Dog Park and other expenses of organization or promotion if the expenses are approved by the Board of Directors of Friends and requested in writing. 3. That in the event the City and Friends mutually agree that efforts have not raised enough funds to ensure capital funding of the project, the funds will be returned to the donors without interest and will not be retained by the City or used for any other purposes inconsistent with the construction of the Dog Park. 4. That in the event another government subdivision of this State or another state, or a non-profit corporation reorganized by the IRS a s qualified under §501(c)(3), proposed to build or equip a Dog Park, the City will at the request of Friends, and upon assurances that the project will be built, transfer the Funds to the to the entity for the building of the project. ("FRIENDS") a Minnesota non-profit corporation. INTRODUCTION 1. The City has established a Municipal Dog Park located on the map attached as Exhibit A, and the Friends have been established as a Minnesota non-profit corporation for the purpose of fundraising and promoting the development and maintenance of a dog park in the City or adjacent cities. 2. The Board of Directors of the Friends is comprised of a broad spectrum of representatives from the pet owners and propose to provide volunteers to advise and assist the City with the development of Rules and Procedures for the Operation of the Park. 3. The City desires to encourage the assistance of the Friends and for that purpose agrees to be responsible for maintaining liability insurance coverage on the Park and its operation and to indemnify and hold the Friends and its members harmless regarding claims that may arise relating to the management and operation of the Park. 4. An initial copy of the Rules and Procedures for the Operation of the Park is attached as Exhibit B. 5. The following conditions are set forth as conditions of approval on the Special Use Permit granted to Friends of the Dog Park and made a part of this license as follows: a. A 5-6 foot fence with a double (or triple) gated entry shall be installed. b. A waste bag dispenser must be installed. c. Rules of operation must be posted and maintained in good order and visible to users of the Dog Park. Prior to installation of any signs, a sign permit must be obtained. d. Hours of operation must be between 8 am and sunset. The hours of operation must be clearly posted. e. The City will be responsible for plowing and removal of snow from the parking lot and emptying the dog waste receptacles. All other maintenance of the facility will be the responsibility of the Friends. f. Dogs on the site are required to be on a leash whenever they are not within the fenced area of the dog park. g. Though the dog park is to be improved and maintained by the Friends of the Stillwater Area Dog Park, the facility must be open for use by the general public. h. Upon receipt of verified complaints of substance, the City will schedule a public hearing to review the Special Use Permit. The Friends and neighboring property owners will be notified of the review hearing, and upon cause, conditions may be modified or added, or the Special Use Permit may be revoked by the City. i. Should the dog park fall into disrepair, lack of use, or misuse, in the City's sole opinion, the Special Use Permit will become null and void. 6. S. Children under the age of 10 in the OLRA, must be supervised by an adult (18 and older). 9. Dogs in heat, slek dogs, and puppies under tour months old are not allowed in the OLRA. Stillwater Dog Park Safety Tips & Etiquette: • Make your first visit without your dog to familiarize yourself with the site (parking, access gates, etc). Make your initial doggie visit at a time that is not as busy. Daytime hours during the week And late afternoons on the weekend are generally quiet times at the dog park. • Remember that many dogs who visit the dog park am not socialized to children. Koep ❑hUdren close and allow no running, screaming or food. Do not allow your children to approach a dog without permission from the dog's handler. • Know your dog! Not all dogs are good candidates for off -leash dog parks. Ifyour dog has nothad regular interaetion with other dogs, it may lack the necessary social skills to make your visit safe and enjoyable. Check for training schools that officer remedial socialization classes for adult dogs or for trainers who will work with you at the offleash dog park. Sociialize young puppies (8-16 weeks of age) at a puppy kindergarten class, not at the dog park. • Let your dog off -leash as soon as you arrive within the transitional corridor of the park .Mixing leashed and unleashed dogs commonly causes problems. Leashed dogs often feel threatened.by the fide doge and will display provocative body language and deftsive behavior. If you are uncomfortable about letting your dog off -leash, do not visit the off -leash padL EXHIBIT B
