Findings and Resolution Authorizing Expenditure
of Funds from Tax Increment District No. 1,
Within Development District No. 1
WHEREAS, Development District No. 1, within Development District No. 1 was
established by Resolution of the City Council on May 7, 1985 for the purpose of funding
necessary activities and improvements within TIF District No. 1 in accordance with what was
then MN Statutes Chapter 472, and;
WHEREAS, land bordering on the St. Croix River bounded on the North by Nelson
Street, and the South by the City Limits, and on the West by State Highway 95 was included
within TIF District No. 1 since the land was mostly vacant and consisted of under used and
partially abandoned railroad right of way, (the Project Area) and;
WHEREAS, the Project Area also contains a municipal sanitary sewer main that
conveys most of the sewage generated in the City from a lift station just north of Nelson Street
to the Regional Sewer Treatment Plan just South of the City Limits, and;
WHEREAS, the Project Area has also been designated as the location of a regional
pedestrian and bicycle trail system that will be constructed to connect the downtown of Stillwater
to the regional trail system that will be located on the former lift bridge, and the regional trail
system recently constructed by the Minnesota DNR on the North border of the City, and;
WHEREAS, a Shoreline Restoration Project is being considered to repair erosion and
stabilize land to protect the transportation corridor and the sewer main, and in order to qualify for
Minnesota State assistance for the project it is necessary to fund one half of the estimated project
costs and that half is estimated at$1,615,000.00,
NOW THEREFORE, the Stillwater City Council adopts the following Findings of Fact:
1. That the Project Area is within TIF District No. 1.
2. That the TIF Financing Plan for TIF District No. 1 (the "Plan") sets forth the
objectives and the purposes for which funds generated by the District may be used.
3. That Objective 35, as set forth in the Plan, states that it is permissible to: "make
expenditures to facilitate the constriction of private parking facilities, flood walls,
pedestrian walkways, a transportation corridor, including rail land, bicycle
transportation, and right of way for sewer and storm sewer facilities.
4. That the Project is necessary to stabilize the shoreline and prevent damage to the
Sanitary Sewer Trunk line that runs the length of the Project Area, and the collapse of
damage to the Trunk line that is now partially exposed would create a danger to the
public and to the St. Croix River, a National Wild and Scenic River.
5. That the Project will make possible the development of the Project Area as a
transportation corridor for pedestrian and bicycle traffic between the new Interstate
Bridge and the Downtown business district.
6. That the Project addresses the conditions that allowed the designation of the area as
part of a redevelopment district since the area contained abandoned and underutilized
railroad right of ways that are now in need of protection and development as a
pedestrian and bicycle transportation corridor that will link the Downtown Central
Business District with the greater metropolitan area and the State of Wisconsin.
NOW THEREFORE, BE IT RESOLVED, that tax increment funds from TIF District No.
1, in the amount of$1,615,000.00 be made available for the Project as matching funds to equal
the amount allocation to the Project by the State of Minnesota.
Enacted by unanimous vote of the City Council this 3rd day of April, 2018.
