Final approval of Phase I development of Millbrook, a residential subdivision on TH 96 west of Neal Avenue. This case includes Final Plat approval for 59 single family homes in Phase I; Final PUD approval for Phase I; and a PUD amendment relating to townhome design; and any variances related thereto. US Home, applicant 4.02 Case No. 07-09. A preliminary Planned Unit Development for a 50 lot development on 25.28 acres located at 12525 75th St N and 12620 and 12550 72nd St N; a preliminary plat creating 50 single family lots; and a zoning map amendment to rezone the property from AP, Agricultural Preservation to TR, Traditional Residential and LR, Lakeshore Residential; and any variances related thereto. OTHER BUSINESS CITY HALL: 216 NORTH FOURTH STREET • STILLWATER, MINNESOTA 55082 PHONE: 651-430-8800 • WEBSITE: wwwdstillwater.mn.us Stillwater City and Town Joint Board December 27, 2006 Present: David Johnson and Linda Countryman, Stillwater Township David Junker, City of Stillwater Others: Stillwater Community Development Director Bill Turnblad and Stillwater City Attorney David Magnuson Chair Johnson called the meeting to order at 7 p.m NEW BUSINESS Case No. ANN/06-61 A request by Kemal Schankereli for annexation of his property located at 7979 Neal Avenue North. Mr. Turnblad briefly reviewed the annexation request. He noted that the property is located in the Phase IV Annexation Area. And though the annexation date for the Phase IV area is 2015, annexation can occur earlier if a number of conditions are met. Those conditions are met by the Schankereli request. If the annexation is approved, then Mr. Schankereli will make application for subdivision of his property. That subdivision application will need to come back to the Joint Board for review. Mr. Junker moved approval of the annexation request. Mrs. Countryman seconded the motion, which passed on a vote of 3-0. Case No. 07-01 A request by Rick Carlson for final plat and final PUD approval of a subdivision known as BROWN'S CREEK RESERVE. Mr. Turnblad explained that the final plans are consistent with the preliminary plans approved by the Joint Board earlier this year. Though, two issues are still unresolved. They will need to be finalized prior to City Council approval of the final plat. The first issue is that the DNR gave preliminary approval of the PUD for the project, but must still give final approval of it. The main concern here is that the open space in the rear yards of each lot need to be kept free of all impervious surface. The second issue relates to the trail alignment and surface type. At the insistence of the Brown's Creek Watershed District the preliminary plan showed the trail further away from the wetlands on the property. However, that alignment would place the trail close to the rear of the houses on the west side of the property. Consequently, the developer asked Brown's Creek Watershed District if the trail could be closer to the wetland buffer area on the site. The watershed district indicated they may approve the new location if the trail surface was pervious rather than impervious bituminous. Prior to City Council approval of the final plans, the watershed district and City Park Board need to review the revised trail plan. Mr. Junker moved approval of the final plat and PUD with the 16 conditions found in the staff report. These conditions include receiving DNR approval of the PUD and resolving the trail Stillwater City and Town Joint Board December 27, 2006 issues prior to City Council action on the final plans. Mrs. Countryman seconded the motion, which passed on a vote of 3-0. OTHER ITEMS Steve Kochendorfer Request — Mr. Turnblad stated that the septic system on Steve Kochendorfer's property at 8080 Neal Avenue N has failed. He has picked up a petition for annexation of his property, but it will take approximately 3 months for the annexation to work its way through the process. Therefore, he has asked if he could connect to City sewer prior to approval of the annexation. Since the annexation request if for property that likely would have the annexation request approved, City staff finds the request acceptable, as long as Mr. Kochendorfer agrees to make application for the annexation as soon as possible. Mr. Johnson mentioned that care should be taken when the sewer and water services are installed so that they are not located where future homes are likely to be built on the property. He also stated that he is in favor of the request. Mr. Junker moved to recommend approval of the utility extension request prior to annexation, as long as Mr. Kochendorfer agreed to submit his petition for annexation as soon as possible. Mrs. Countryman seconded the motion, which passed on a vote of 3-0. ADJOURNMENT Mr. Junker moved to adjourn the meeting. The motion was seconded by Mrs. Countryman and it passed on a vote of 3-0.
