All in favor, 7-0. OPEN FORUM There were no public comments. CONSENT AGENDA Case No. 2018-01: Consideration of a Design Permit for signage to be located at 450 Main Street North Suite 130. UNFINISHED BUSINESS Case No. 2017-39: Design Review Permit to operate a Segway tour business from 204 Main Street North, located in the CBD District. Steve Gnan, property owner and James Linden, applicant. City Planner Wittman stated that the applicant has updated his request. The new proposal includes: 1) A 56 square foot (7X8'), wood framed structure sided with 4" OC Pine painted plywood. The structure is proposed to have a 7/12 pitched, Ondura corrugated asphalt roof and a dutch door facing Main Street. The applicant has identified a range of earthtone colors for the siding and trim. He prefers brown or black for the roofing material. 2) Two signs: a) One, five square foot aluminum sign proposed to be affixed to the temporary structure. The sign is shown as black with white and yellow painted or vinyl lettering. b) One, six square foot sidewalk sign. While the applicant is proposing to have a 9x12' aluminum trailer onsite, it will be stationary and parked in a location that is not visible from Main Street. The trailer will be Heritage Preservation Commission Meeting February 21, 2018 used to store and recharge the Segways when not in use. The applicant has indicated he may be able to accommodate the entire business in the wooden structure. If that is the case, the trailer will not be located on the premises. The proposed design and colors of the structure generally conform to the intent of the Downtown Design Review District guidelines. With certain conditions, the signage can conform to the standards for Design Permits and the Downtown Design Review District guidelines. Therefore, staff recommends approval of a Design Permit for Stillwater Segways, with three conditions. Jim Linden, Stillwater Segway Tours, offered to answer any questions. He provided additional color swatches. He would like to use a dark brown roof in corrugated asphalt and an antique gold on the structure itself and prefers paint over stain for maintenance. There would be no public access to the building. He has met with the fire marshall and the state electrical inspector, who approved electrical hookup from Let There Be Light. The wooden structure might be set back further if the trailer is not needed. The wooden structure will be dismantled and removed at the end of the season. Chairman Larson remarked that either vertical or horizontal orientation for the siding should be acceptable. The color should not be metallic. Mr. Linden replied the color will be subdued. Motion by Commissioner Mino, seconded by Commissioner Welty, to approve Case No. 2017-39, Design Review Permit to operate a segway tour business from 204 Main Street North, with the three conditions recommended by staff. All in favor, 7-0. Case No. 2017-40: Consideration of a Design Review Permit to construct the proposed single family structure on the property located at XXX Linden in the RB District. NJC Holdings LLC, property owner and Paul Bruggeman, applicant. City Planner Wittman reported that the applicant has submitted updated plans which include the addition of soffit and corner trim boards on all four sides of the home. The plans also include the addition of a second story window on the east and west facades. The east facade window is located in a bathroom; the west facade window is located in the master bedroom. The window shape and size differ from one another and from those found on the front and rear of the home. Staff finds that the updated plans help carry trim detail to all four sides of the home. The windows, while not consistent in shape and size, contribute to four sided design. Staff finds HPC Case No. 2017-40 is in substantial conformance with the guidelines set forth for the Neighborhood Conservation District and recommends approval with nine conditions. Paul Bruggeman, Bruggeman Builders, offered to answer questions. Chairman Larson asked what happened to the rake board trim underneath the eve of the soffits. Ms. Wittman said the applicant chose to remove it completely - it had been previously proposed only for the front facade. Chairman Larson asked about the water table trim at the base. Mr. Bruggeman said he doesn't like the look of a water table band but if that is required, he will include it. Chairman Larson said he agrees it would be odd to have siding below it, but there is a lot of siding here and a water table board would help break that up. However he doesn't see it as a requirement. Mr. Bruggeman said he would like to add one window on each side of the walkout on the back if the grade allows. Commissioner Welty remarked that the side elevations are still bland. She asked if Mr. Bruggeman would consider wrapping the garage in board and batten instead of lap. Mr. Bruggeman said he is willing to do that. Page 2 of 4 Heritage Preservation Commission Meeting February 21, 2018 Motion by Commissioner Mino, seconded by Commissioner Steinwall, to approve Case No. 2017-40, Design Review Permit to construct the proposed single family structure on the property located at XXX Linden in the RB District, with the nine conditions recommended by staff, adding Condition #10, "board and batten shall be used on all three sides of the garage" and Condition #11, "walkout windows, if proposed, shall be consistent in size, shape and location with the proposed second story corner windows." All in favor, 7-0. NEW BUSINESS Case No. 2018-04: Design Permit for a signage, lighting, and outdoor dining plan for the property located at 402 Main Street South. Elevage, property owner. City Planner Wittman noted that Elevage informed her they would not be able to be present at the meeting. She explained that the applicant is requesting approval of a Design Permit for a sign plan, lighting plan and patio/outdoor dining plan for the Joseph Wolf block of parcels and buildings located at 402 South Main Street. The sign plan includes: a) One wall sign. The single, 42 square foot wall sign will be located on the backside of the elevated patio area. The 3.5' tall by 12' long sign will be constructed from reclaimed wood and will have gold, pin mounted letters to read "Lora", the name of the hotel, totaling 24" wide. The sign will have a gold casement. The sign is proposed to be lit. No lighting fixtures have been proposed. b) Three projecting signs: i) A 2' tall by 3' wide lit projecting sign. The engraved and painted wood sign will read "The Long Goodbye" with "Libations and Salutations" and "Stillwater, MN" underneath. The sign will have a weathered brass casement. The sign will project approximately 4.5' from the building. No lighting fixtures have been proposed. ii) A 2X2' square lit projecting sign. The burnt wood sign with knockouts will read "Feller" in Gold. The sign will have a weathered core -ten casement. The sign will project approximately 3.5' from the building. No lighting fixtures have been proposed. iii) A 2' diameter, lit circle projecting sign. The sign will be laser cut black metal and white washed wood and will read "Made Coffee". The sign will project approximately 3.5' from the building. No lighting fixtures have been proposed. c. Window signage. Ms. Wittman stated that window signage, as long as it does not exceed 1/3 of each window's area, does not require review and approval by the HPC. However, details of proposed window signage have been included. The exterior lighting plan includes the installation of three first floor outdoor sconces that will be approximately 12" tall. They will contain an aluminum plate with a clear, incandescent bubble bulb. There will also be three third floor outdoor sconces in a similar design, approximately 9" tall. The applicant is proposing several different types of tables and chairs for outdoor dining and relaxing, to be enclosed by black planters, the Lora sign and railings. The middle, non -historic infill portion of the site is proposed to have crawling vines. Staff finds the application is consistent with the Site Alteration Permit standards and recommends approval of a Design Permit for signage, lighting and outdoor patio/dining at 402 Main Street South, with two conditions. Chairman Larson asked for clarification about the electrical cable used for the signs. He would like to know how they will enter the junction box and what the finished detailing will look like. He would like to note that on the historic stone, it is preferable to drill into a joint rather than the face of a stone. Motion by Chairman Larson, seconded by Commissioner Welty, to approve Case No. 2018-04, Design Permit for a signage, lighting, and outdoor dining plan for the property located at 402 Main Street South, with the two conditions recommended by staff, adding Condition #3 stating, "all proposed signs and arm brackets will be set in existing masonry joints to the greatest extent possible" and Condition #4 stating, "sign lighting, fixtures, wiring and junction box details will be submitted for review and approval prior to installation." All in favor, 7- 0. OTHER ITEMS OF DISCUSSION 2040 Comprehensive Plan Historic Resources Chapter Update Consultant selection Page 3 of 6 Heritage Preservation Commission Meeting February 21, 2018 City Planner Wittman reviewed the proposals received in response to a Request for Services. Staff recommends Landscape Research LLC. The firm will review the existing Historic Resources chapter of the Comprehensive Plan with the HPC, the Council and Comprehensive Plan advisory committee, examine whether existing goals and policies are still relevant, look at past work, and draft future goals for 2040 with implementation strategies. 2040 Comprehensive Plan Historic Resources Chapter Update Committee Member selection Ms. Wittman provided names of candidates for the volunteer committee that will help the HPC update the Historic Resources chapter of the Comprehensive Plan. Motion by Chairman Larson, seconded by Commissioner Mino, to recommend that the Council enter into a contract with Landscape Research LLC and to accept the nine committee members. All in favor, 7-0. Small Wireless Zoning Text Amendment Ms. Wittman gave a presentation on small wireless technology and how it will impact zoning. The current right-of-way ordinance is not adequate to regulate small wireless technology. The Planning Commission has discussed permitting and cost, and felt comfortable with the HPC looking at design. Design standards may be established in the zoning code. Small wireless uses are permitted by law in any area that is not an historic district or single family residential neighborhood; in such areas, a permit review may be required. The City may determine what is an appropriate support structure. Ms. Wittman said she has already received an inquiry from AT&T which is looking at installing three structures in Stillwater to close coverage gaps. Staff recommends that in the historic district and neighborhood conservation district, the City should reserve the right to require a Conditional Use Permit, and establish design standards. Commissioners discussed their preferences for more slender fixtures over wide bottom structures. Ms. Wittman said she hopes to have a draft prepared for the next Planning Commission meeting and will bring it back to the HPC also. STAFF UPDATES There were no staff updates. At the time the Commission wanted to see greater detail of the sign lighting. REQUEST The applicant is requesting approval of two types of light fixtures: 1. A WAC lighting, double adjustable die cast aluminum projecting post in bronze to be located above the Feller, the Made Coffee, and The Long Goodbye projecting signs. The dark bronze finished light fixture would be wall mounted, with no exposed junction boxes or wiring. The cable supporting the fixture would be tied back at an existing grout line/ 2. A RAB, 6" bullet light in bronze to be mounted to the Lora sign. This the light will face up on the sign. ALTERNATIVES The HPC has several alternatives related to this request. A. Approve. If the proposed application meets the Site Alteration Permit standards, the HPC should move to approve the lighting associated with HPC Case No. 2018-04. B. Approve in part. C. Deny. If the HPC finds that the proposal is not consistent with the Site Alteration Permit standards, and the downtown design review district guidelines, then the Commission could deny the request. With a denial, the basis of the action is required to be given. Furthermore, a denial with prejudice would prohibit the applicant from resubmittal of a substantially similar application within one year. D. Table. If the HPC needs additional information to make a decision, the requests could be tabled until the April, 2018 meeting. FINDINGS AND RECOMMENDATION Staff finds the application is consistent with the Site Alteration Permit standards and recommends approval of the lighting plan associated with HPC Case No. 2018-04 for a Design Permit for sign lighting. ZONING: Central Business District COMP PLAN DISTRICT: DMU - Downtown Mixed Use PREPARED BY: Abbi Jo Wittman, City Planner REQUEST The applicant is requesting approval of a Design Permit to make certain changes to the structure located at 232 Main Street South. The proposal includes the installation of a new (approximately) 26' long, fixed metal and canvas awning. The awning will have 17" tall and 20' wide white graphics which will read "The Shirt Factory". The awning is proposed to be 44" tall by 31" deep. For reference, a previous black awning was installed on this structure prior to the current owner's occupancy and rehabilitation of the structure. APPLICABLE REGULATIONS AND GUIDELINES The sign is consistent with the adopted zoning code provisions for wall signage as the total square footage of the sign may not exceed one square foot per one linear foot of the building. Furthermore, the Zoning Code indicates "the gross surface of an awning or canopy sign may not exceed 50 percent of the gross surface area of the smallest face of the awning or canopy to which the sign is affixed". Municipal Code Section 31-209, Design permit states: • The Standards for Review , Sec. 31-509(f) indicates the HPC shall utilize the following standards: o Outdoor advertising: The number, location, color, size, height, lighting and landscaping of outdoor advertising signs and structures in relation to the creation of traffic hazards and the appearance and harmony with adjacent development. o Special design guidelines for areas or districts of the city officially adopted by the city council. The Downtown Design Manual indicates the following (abbreviated) guidelines: Signs and Graphics: General: • Only one sign that contains the business name or graphic logo is permitted per street facing side. The exception is that a window sign may be used in addition to other sign types. • Signage should be located in such a way as to not obscure any architectural features of the building. A projecting sign with two faces is considered one sign. Shape of Signs: • Design the sign shape to fit and fill the available space. Consider using long, narrow signs spanning the full width of the facade. Color: • Choose subdued colors and dark tones in keeping with the Victorian tradition. Property selected combinations of dark brown and green, black, off-white and gold are appropriate. • Choose tones with sufficient contrast to be clearly legible: dark on light or light on dark. Lettering: • Chose a bold and simple type style and use it on all appropriate signs. Installation: • The installation of any signage or graphics must have a minimal impact on the building and must allow the building to return to its original condition upon signage removal. • Reuse of existing mounting brackets, studs or holes is desirable. Awnings • Retractable or operable awning are encouraged. Fixed awnings should mimic the profile of operable units (one to one pitch). HPC 2018-05 March 20, 2018 Page 2 of 4 • The emphasis of the awning should remain one of shelter and protection, rather than signage. In keeping with this, the awning should be loose and flowing, not stretched tight, subtle and subdued in color, not bright, extending well out over the sidewalk, not a mere window dressing. • The width of awnings should fit the geometry of the building facade. They should not extend across multiple storefronts of different buildings, but should reflect the window or door openings below. • The use of water-repellent or vinyl -coated canvas is in keeping with awnings of the time. Plastic or aluminum awnings or canopies are not appropriate. • Fixed, round -headed awnings will be considered only over arched windows or doors, and only if placed below or within the arched lintel. • The awning valance, or skirt, shall be proportioned to the size of the awning But shall not exceed twelve (12) inches in height. • Signing on awnings is permitted (in place of other sign types) on the end panel or front valance only. Use lettering size proportional to the space available. • Back lighting of the awnings is inappropriate, • Use plain or striped fabrics. Large areas of bright colors are inappropriate ALTERNATIVES The HPC has several alternatives related to this requests A. Approve. If the proposed application meets the Design Permit standards, and the Downtown Design Review District guidelines, the HPC should move to approve Case No. 2018-05. Staff would recommend the following minimum condition for approval. a. The sign shall obtain a sign permit prior to the installation of the sign. b. The awning shall maintain the proposed one to one pitch and shall be water- repellent or vinyl -coated canvas. c. Disturbance to the exterior wall face shall be done in a fashion as to prevent excess damage. Utilization of existing openings shall be encourage. The applicant's flat, wood, projecting sign conform to the Zoning Code and Downtown Design Review District guidelines. At their last regularly -scheduled meeting, the City Council reviewed all discussions and direction to date and provided input on the future Zoning Text Amendment. The Council was concerned that not having consistent design standards could result in mismatched infrastructure throughout specific districts and areas as the HPC changes over time. However, there was consensus that having standardized design at this time was not possible due to timing constraints. CURRENT STATUS Staff has completed a legislative version of the Zoning Text Amendment. The entire Zoning Text Amendment will propose to amend six sections of the City Code. In addition to establishing a greater purpose for right-of-way (ROW) management, tying Design Permitting to the HPC, and an overhaul of the existing Towers and Antenna Zoning Code section, there are specific sections pertaining to design review and permitting. A summary of changes are as follows. Please note, underlined text is proposed to be added whereas all other text currently exists in the City Code. Chapter 24: ROW Management Defines Local, state, or nationally -designated, or eligible heritage preservation sites, landmarks and districts as "any area of significant historical and cultural significance which has been designated, or is eligible for designation, by the local, state or national government. These sites, landmarks and districts shall include archaeological sites, conservation areas and overlay districts". Improves the purpose of ROW Management: The rights of way (ROW) serve to protect the public health, safety and welfare. The ROWs provide access to public and properties for motorized and non -motorized vehicles and pedestrians and provide space to facilitate the delivery of vital public and private utility services. In addition, the ROWs in the city provide a critical part of the public realm that helps create the essential character of the community. This is especially true in relationship to local, state, or nationally -designated, or eligible heritage preservation sites, landmarks and districts. It is the intent of this article to facilitate appropriate use of the ROWs for the purposes above while also protecting the public welfare by preventing permanent obstruction, safety hazards, and other use of the ROW that would diminish the historic character of the community. Chapter 22: Heritage Preservation Commission Adds the requirement that the commission shall conduct review of certain types of projects, as outlined in City Code Section 31-209, Design Permit. City Code Section 31-101 (Zoning Code Definitions) Defines Wireless facility as "a tangible asset used to provide wireless telecommunication, voice, and/ or data services, including all antennas, support devices and structures, accessory support equipment including pole and ground mount equipment, associated cables and attachments. Wireless facilities shall include any and all antenna herein". City Code Section 31-512 (Proposed to be retitled to Towers and Wireless Facilities) Improves the purpose to include: Minimize adverse visual effects of towers and wireless facilities by establishing design standards to protect the public health, safety and welfare of local, state, or nationally - designated, or eligible, heritage preservation sites, landmarks and districts Requires a Design Permit for all new Towers and Wireless Facilities. Establishes Review Criteria: • Whether the material, height, scale, mass and placement of the proposed addition, modification or construction are visually and architecturally compatible or complimentary with the site and neighborhood. • The effect of the proposed change on any adjacent local, state, or nationally -designated, or eligible heritage preservation sites, landmarks and districts. • Any applicable provisions of established design guidelines and standards. Separates design standards between General (applicable to all Towers and Wireless Facilities) as well as standards specifically pertaining to Towers or Wireless Facilities. General Design Standards • All towers their and relative accessory structures and wireless facilities must utilize building materials, colors, textures, screening and landscaping that effectively blend the facilities within the surrounding natural setting and built environment to the greatest extent possible. • All support service and accessory equipment or structures, minimized in quantity and size, must be enclosed within an existing building, located and screened so as to be HPC Discussion Small Wireless Facilities May 21, 2018 hidden from public view from the street or above, or be located underground. Any accessory equipment or structures must be compatible with the design and materials of the primary structure and not visible from a public street. • Towers wireless facilities may not be illuminated by artificial means, except for camouflage purposes (designed as a lighted tower for a parking lot or a ball field) or the illumination is specifically required by the Federal Aviation Administration or other authority. • No advertising or identification of any kind intended to be visible from the ground or other structures is permitted, except applicable warning and equipment information signage including name, location identification, and emergency contact information required by federal, state or local authorities. Use of the smallest and lowest visibility RF warning sticker and/or node ID sticker allowed by government or by utility regulations shall be the same color as the pole, Placement shall be away from adjacent residential structures and out of direct sight lines. ■ Non -reflective, matte and anti -graffiti painting shall be required on all antenna, brackets, cables, risers, PVC, shrouds, etc. shall be required. ■ All towers, wireless facilities and support service and accessory equipment shall comply with City Code Section 38-3, Noise control and regulation. Wireless Design Standards ■ Wireless facilities shall have an integrated or concealed design. • Wireless facilities placed on the exterior of a structure must be camouflaged as an architectural element and located in a symmetrical, balance design. • All wireless facilities must be designed and situated to be visually unobtrusive, not be multicolored and screened as appropriate. • A wireless facilities placed on a primary structure may be no taller than 10 feet above the primary structure. COMMISSION DISCUSSION At the meeting, staff will brief the Commission on all discussions to date, using the legislative changes as a guide. The Commission's discussion of the future Zoning Text Amendment will focus on final ordinance amendments necessary prior to scheduling public hearings. R T N P 1.. 4 T; E 91 F MINNFSOITA HERITAGE PRESERVATION COMMISSION MEETING DATE: March 21, 2018 REGARDING: 2040 Comprehensive Plan Update PREPARED BY: Abbi Jo Wittman, City Planner As the Commission in aware, the City is in the process of updating its Comprehensive Plan (the Plan). The Comp Plan Advisory Committee (CPAC) met on February 28. Schedules for the full Plan update are attached for Commission review. Since the HPC's last meeting, the City Council has approved a contract for services with Landscape Research LLC. This is the consulting firm that will be assisting the HPC with the update of the Historic Resources chapter. As a reminder, the update will be done in conjunction with an HPC advisory committee. Landscape Research LLC is preparing a final work schedule. As the grant programs requires all work to be completed by July, we will have an aggressive update schedule. Given this, staff has also attached the existing Historic Resources chapter for the Commission and Committee's review. It is anticipated the HPC and its committee will be meeting with the consultants in April, prior to the HPC's regularly -scheduled meeting. Plan Update Activities to Date In mid -February the City started to use Polco, a citizen engagement application designed to gauge public interest on a variety of topics. It was determined the use of Polco for preliminary public engagement efforts was a good online platform to try; at this time there is no cost to the City to use this platform. It is anticipated the City will continue to use Polco for ongoing public opinion matters (e.g. "how did we plow your snow last night"). Questions from the 2006 community survey were the basis for the questions currently being asked. Three different sets of questions have been released on Polco. The question topics range from capital improvements and taxes to perceptions of public safety, walkability and community character. All questions have been posted and the survey will be remain active for an additional two weeks. Staff has attached a list of groups/individuals who have been directly contacted about Polco. To the date of memo development, there are 350 users. Polco staff has indicated this 'slow and steady' increase of users is common but, as Stillwater has only been utilizing the platform for less than one month, the total number of participants is very good. Staff has attached three questions the HPC might be interested in reviewing. HPC and Advisory Committee Involvement While the City will be conducting additional public education and outreach efforts, staff is asking all Commissioners promote the use of Polco.us/Stillwater, encouraging your friends and neighbors to join and participate. The aggregate data received will help shape portions of the 2040 Comprehensive Plan. Additionally, staff is requesting review of the attached 2030 Comprehensive Plan Historic Resources chapter. As Commission and Committee members review the chapter, staff recommends thinking about what preservation efforts should look like in the future. Some questions to think about are: ■ What areas, structures, sites, cultural artifacts and/or traditions are worthy of preserving? ■ Are there actions that can be taken to help promote preservation of areas, structures, sites, cultural artifacts and/ or traditions? ■ Who are the stakeholders in preservation efforts? • Are there agencies, organizations, individuals and/or groups who should be a part of future preservation efforts? • What are barriers the community currently faces in protecting its historic and cultural resources? • What are opportunities to help promote the preservation, restoration, rehabilitation and reconstruction of historic and cultural resources in the community? As City staff and Landscape Research staff finalize the timeline for the Historic Resources chapter update, staff will provide Commissioners and Committee Members with more materials. HPC: March 21, 2018 Page 2 of 2 Chapter 5 - Historic Resources Introduction THE abundance of historic resources is a vital component of Stillwater's character. The preservation, protection and use of historic properties is a public necessity due to their importance to the city's sense of place and legacy. The city has worked over the past several years to record this valuable history. During the course of public visioning and goal setting, the public and city restated goals and objectives from the 1995 plan with updated program and implementation efforts to continue the work of preservation and public education towards this critical effort. Goals, Objectives, Policies & Programs Goal 1: Safeguard the heritage of the city by preserving historic properties which reflect Stillwater's cultural, social, economic, political, visual, aesthetic or architectural history. Goal 2: Protect and enhance the city's appeal and attraction to residents, visitors and tourists, using historic properties as a support and stimulus to business and industry. Goal 3: Enhance the visual and aesthetic character, diversity and interest of Stillwater. Goals 4: Foster civic pride in the beauty and notable accomplishments of the past. Objectives Preserve the Downtown Stillwater Commercial Historic District and adjacent historic properties through the design review process and other means as they become available. Policies Policy 1: Continue conducting historic preservation surveys based on historic contexts to identify and evaluate the significance of all historic properties within the city limits. Policy 2: The city will continue to review site alteration permits for the downtown commercial historic district, the downtown plan and such other locally designated districts and properties in order to assure the preservation and restoration of historic properties. Policy 3: The city and citizen advisory groups will coordinate local efforts to preserve and protect cultural, natural and historic resources in the community. Policy 4: The Heritage Preservation Commission will continue to work to educate the community at large on cultural values and economic benefits of historic preservation. Policy 5: The city will develop new standards for public improvement projects (i.e., streets, sidewalks, lights, utilities) which will be sensitive to historic neighborhoods. Policy 6: The plan for preserving Stillwater's historic resources will be developed in accordance with the Secretary of the Interior's Standards for Preservation Planning. Policy 7: The city shall encourage cooperation from local lending institutions for financing a building renovation grant or loan program to assist in the rehabilitation and restoration of historic properties. " ❑❑ PLAN OF STILLWATER ❑❑ 5-2 Chapter 5 : Historic Resources Heritage Preservation Commission The Heritage Preservation Commission was formed by the City of Stillwater in 1980. The city was designated a Certified Local Government by the State Historic Preservation Office on January 29, 1988. The purpose of the Commission is two fold. First, to safeguard the heritage of the city by working toward the preservation of historical sites and structures. Second, to promote the community's rich architectural and cultural history through research and education. The Commission is responsible for review of applications for new development or renovations to existing sites in the Downtown Historic District and the Neighborhood Conservation District. This review is to ensure conformance to design guidelines in each of these areas. Additionally, the Commission acts as the city's Architectural Review Board for the West Stillwater Business Park and the Village Commercial area in Liberty on the Lake. In its research and education roll, the Commission has completed two context studies, 10 neighborhood studies, and one working report since 1989. The Commission has also completed the first phase of the "Heirloom and Landmark Sites Program", which is an effort to honor property owners who maintain the historical character of their building or site. The purpose of the program is to safeguard historic resources while protecting and enhancing Stillwater's appeal and promoting preservation. Through the years, the City of Stillwater in cooperation with various federal and state partners, has completed reports on the history of Stillwater neighborhoods and commercial areas. The first effort was the 1989 intensive National Registry Survey that resulted in the establishment of the 1992 "Stillwater Commercial Historic District." This area encompasses the Stillwater Commercial Historic District as show on Figure 5.1 Downtown Historic Resources. The downtown/commercial historic district contains 57 contributing buildings, two contributing sites, three contributing structures and one contributing object. To protect this area the city developed a design manual for the Commercial Historic District and the surrounding Central Business District as is shown on Figure 5.1. In 1993 the Heritage Preservation Commission contracted with Robert Vogel, historian, to prepare a study that initiated a comprehensive historic preservation planning process for the City of Stillwater. Vogel's historic context document was compiled in accordance with the Secretary of the Interior's Standards for preservation planning, which call for the establishment of historic contexts and the use of these contexts to develop goals and ultimately register those that qualify on the national or local historic register. The context study divided Stillwater into 16 neighborhoods, each was suggested to be surveyed later in detail. Each of these has extensive guidelines and recommendations for new development and redevelopment and require a design review approval by the City. The Commercial Historic District also requires design review by the City on the renovation of existing sites in the district. Commercial Historic District Design Manual The Design Manual for the Commercial Historic District was prepared to guide the new development and renovation of buildings and sites in the Commercial Historic District and surrounding downtown area of Stillwater. The guidelines are designed to be flexible to allow for creative and imaginative design while preserving the historic attributes and maintaining the pedestrian character of downtown Stillwater. All exterior renovation projects require a design review permit that is reviewed and approved by the Commission. The design guidelines touch on all aspects of a site and structure including setbacks, building facades, roofs, materials, color, lighting, signs and graphics and landscaping. The design manual is comprehensive and includes a background for each topic describing the intent along with narrative and graphic details for each of the design elements. Stillwater Neighborhood Conservation District Design Guidelines A residential Neighborhood Conservation District has been established to help protect and preserve the unique character of Stillwater's historic residential neighborhoods, by regulating and providing design guidelines for new infill development within the district. Its purpose is to conserve the traditional neighborhood fabric, guide future infill development and discourage unnecessary demolition of structures that contribute to the district's character. The following Figure 5.3 Neighborhood Conservation District displays the boundaries of the district. Guidelines require any new construction projects to be reviewed using standards that emphasize compatible development in terms of size, massing, and relationship to the larger neighborhood context. However, additions and alterations to existing buildings are not yet subject to design review. It is hoped, however; by some members of the community, that the design guidelines will eventually be used for all additions and alterations given that such changes and improvements may impact adjacent residences, the streetscape and the neighborhood. The Design Guidelines are comprehensive in nature covering all aspects to infill including massing, setbacks and placement on the lot in regards to existing trees, slopes, etc. Design aspects of the entire home are covered including building height, roof design, location of the garage, front porches, facade design, windows, building materials, etc. Review and approval must be made by the Commission prior to issuance of a building permit. The district contains 57 contributing buildings, two contributing sites, three contributing structures and one contributing object. The National Register of Historic Places is a listing of historic properties maintained by the National Park Service upon recommendation by the State Historic Preservation Office (SHPO) and the city. The goals of the program are to: • Acknowledge property owners who have voluntarily preserved or restored their historic home, building or site. • Showcase historic homes on Stillwater's Heirlooms Homes and Landmark Sites Program website. • Educate the general public about historic properties in Stillwater. • Help property owners learn how to preserve their historic homes by providing technical assistance that shows homeowners how to maintain the historical character of their homes while also updating them to meet the demands of the twenty-first century. • Preserve Stillwater's historic neighborhoods to ensure that the community maintains its identity and appeal as a historic river city and tourist destination. So far 69 homeowners (as of August 2008) are participating in the program and their locations are shown on Figure 5.5 Heirloom Homes. In total approximately 776 homes are potentially eligible to be listed in the Heirloom Homes program. Resources are available to assist homeowners focus on best practices when considering renovations and restoration of a home. This includes discussion on materials, siding, window, roofs, porches and room additions. These externally visible elements of the home are important historical features to repair correctly in order to maintain the integrity of the design. Extensive information and resources are available on the city's website to make home owners research and decision making easy. The city will continue to market this valuable program and help provide city-wide recognition to owners preserving their homes but also keep the public interest high in supporting this effort. Building Demolition Ordinance The city has implemented a demolition ordinance in order to protect the historic and aesthetic qualities of the city by preserving, rehabilitating or restoring, when reasonable, buildings or structures which constitute or reflect distinctive features or architectural or historical resources of the city. Currently, all structures or portions of structures, which are 50 years of age or older that are proposed to be demolished are required to be reviewed by the Commission prior to the city issuing a building permit. Not only does this ordinance promote the protection of the city's historic and aesthetic qualities but it also protects some of the city's most affordable housing. Stillwater Cultural Landscape District During the cultural resource review for the St. Croix River Crossing Project, the Stillwater Cultural Landscape District was identified as a resource eligible for listing on the National Register of Historic Places (NRHP) in 1999. The Stillwater Cultural Landscape District is located primarily within Stillwater, but also partly within St. Croix County, Wisconsin. It is approximately 260 acres in size. In Minnesota, the boundaries of the district essentially coincide with the 1848 Original Town Plat (O.T.P.) for Stillwater and an adjacent strip of land along the waterfront extending south of town. On the Wisconsin side of the St. Croix River, the Stillwater Cultural Landscape District boundaries follow the boundaries of Kolliner Park. The Cultural Landscape District also includes the Lift Bridge and the earthen causeway that connects the bridge to the Wisconsin shore. The Stillwater Cultural Landscape District contains 250 properties that contribute to its significance, including residences and commercial buildings as well as public stairways, parks, and an archaeological site. A subset of the Stillwater Cultural Landscape District is the Stillwater Commercial Historic District. Among the 250 properties that contribute to the Stillwater Cultural Landscape District, the Stillwater Commercial Historic District includes 12 properties that are individually listed in the National Register of Historic Places, and 82 properties that are considered contributing properties. The Stillwater Cultural Landscape District also includes 187 properties that are noncontributing to the district's significance. (Program 1) Through June of 2010 the city plans to continue to expand the Heirloom Home program. Starting in June of 2010 through June of 2011 the city plans to develop the Landmark Sites Program. Once the Heirloom and Landmark Sites program is completed, the city plans to consider developing a local historic designation district for the eastern residential district. Continue conducting historic preservation surveys (reconnaissance, followed by intensive identification and evaluation activities) of Stillwater neighborhoods. This includes the completion (or resurvey) of the following neighborhoods: • 2011: Sabin's Addition and HR Murdock's Addition • 2012: Wilkin's Addition • 2013: Churchill Nelson 2nd Addition and Marsh's Addition • 2014: South Hill • 2015: North Hill • 2016 and beyond: Forest Hills, Lily Lake, Sunny Slope, Fairmeadows, Croixwood, Oak Glen and Deerpath HPPAs. (Program 2) Revise the Neighborhood Conservation District Design Guidelines to be applicable to existing home renovations, additions and repairs to ensure historic integrity is maintained. Seek funds, public or through private lenders, to be used to repair/restore architecturally significant homes or sites. STRONGLY SUPPPORT: I support historic preservation to a sensible degree, if it is so tightly regulated it does not allow creative re -use of a building, and causes it to be left in increasing disrepair, there would need to be a re-evaluation of policy. Policies would ideally provide incentive for people to make respectful and tasteful preservation choices. SUPPORT: I think protecting the history of Stillwater is S00000 important, but the HPC makes it very difficult for new homes and businesses to get started, yet we have homes in the city that can look like a junkyard. It feels a bit contradictory. STRONGLY OPPOSE: Historic preservation regulations come at a cost. Someone needs to pay for the requirements to upgrade and maintain old buildings. We should maintain connections to our past but there needs to be a consideration of costs vs benefits. Sometimes we may need to tear down an old structure. I would never buy an old house/building in Stillwater because of the concerns that local government will tell me how to maintain the property. fflwater 6' . R T N P 1.. 4 T; E 91 F MINNFSOITA HERITAGE PRESERVATION COMMISSION MEETING DATE: March 21, 2018 REGARDING: 2018 Commission Appointments and Chair Elections PREPARED BY: Abbi Jo Wittman, City Planner In June, 2017, the Planning Commission (CPC) requested staff provide the Commission with advance notice of the 2018 chair appointments/elections. This is to happen at all Commission meetings in May. The CPC further asked for guidance on what the election process should be as well as who should be able to be elected. Staff is bringing this to the HPC as any FYI. Term Expirations and New Applications The seats of Chairman Larson (appointed in 2012) and Commissioner Krakowski (appointed in 2009) will expire. Commissioner Krakowskis has expressed an interest in continuing to serve. Two new applications have been received to date. The deadline for application submission is Friday, March 16. Application Review and Appointments Once applications have been accepted, Chairman Larson and Councilmember Junker will interview all applicants. It is expected this will occur prior to the Commission's meeting in April. After interviews, the two will make a recommendation to the City Council. The City Council is expected to make appointments at their first regularly -scheduled meeting in May. This will occur on May 1, 2018. As per City Code, if Chairman Larson has an interest in continuing to serve on the Commission, he is to be interviewed by two members of the Council. Commission Officers and Nominations As a reminder, the Commission has a Chair and a Vice -Chair. The City has no formally adopted process for Commission chair elections. While the Administration Department is working on a Councilor/Commissioner handbook, it has not been adopted at this time. It is anticipated handbook will help establish a formal process for elections. At this time it is suggested Commissioners conduct elections for Chair and Vice -Chair in the same manner the Vice -Mayor is elected: 1. Any individual who has an interest in serving in the chair or vice chair position expresses their interest. 2. A motion for a chair is made. The motion must be seconded prior to the vote. If there is no second, the motion fails for a lack of a second. The process repeats itself until a motion passes. 3. A motion for a vice -chair is made and the process follows at outlined, above. At the Commission's regularly -scheduled meeting in April, the Commission may want to discuss the elections process. Those who may be interested in serving may want to express their interest at that time. However, as the Commission is aware, the final Commission appointments will not occur until May; there may be new appointees who have an interest in serving, as well.
