A RESOLUTION APPROVING THE DEVELOPMENT AGREEMENT FOR
HEIFORT HILLS ESTATE
CASE NO. 2018-07
WHEREAS, Todd Ganz of Integrity Land Development, Inc. made application
for approval of the final plat known as HEIFORT HILLS ESTATE; and
WHEREAS, on January 10, 2018 the Stillwater Planning Commission held a
public hearing and recommended approval of the preliminary plat; and
WHEREAS, on January 30, 2018 the Stillwater City Council held a public hearing
on the preliminary plat and approved it with conditions; and
WHEREAS, on March 6, 2018 the Stillwater City Council reviewed the final plat
and final plans for HEIFORT HILLS ESTATE and found them to be consistent with the
preliminary plat and plans.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Stillwater hereby approves the Development Agreement for HEIFORT HILLS ESTATE
with the following conditions:
1. The site shall be developed in substantial conformance with the following
plans on file with the Community Development Department, except as may
be modified by the conditions herein:
• Preliminary Plat Revision date 1/15/18
• Tree Survey L1 Revision date 1/15/18
• Tree Tabulation L2 Revision date 1/15/18
• Tree Canopy Area Plan L3 Revision date 1/15/18
• Landscape Pan Dated 1/17/18
• Grading Plan Dated 1/17/18
• Sanitary Sewer and Water Plans/Profiles Dated 1/17/18
• Storm Sewer Plan Dated 1/17/18
• Neal Court Plan/Profile Dated 1/17/18
• Neal Avenue Plan/Profile Dated 1/17/18
• Stormwater Pollution Prevention Plan Dated 1/17/18
• Signage and Lighting Plan Dated 1/17/18
2. All civil engineering plans must be found satisfactory to the City Engineer, or
revised to his satisfaction prior to release of the final plat from City Offices for
filing with Washington County.
3. A municipal water service must be extended to the eastern property line for
future development.
4. Development impact fees must be paid to the City prior to release of the final
plat from City Offices for filing with Washington County. This includes fees
for parks, trails, transportation adequacy, trout stream mitigation, trunk
sewer and trunk water.
5. A trail must be constructed by the developer on the east side of Neal Avenue
as an extension of the existing trail to the south. The trail is to be extended to
State Highway 96. Any costs for the trail and necessary retaining wall that
exceed the developer's park and trail fee obligation will be paid for by the
City from its Parks and Trails fund.
6. The developer must determine whether wetland mitigation will be required
for the construction of the new trail segment along Neal Avenue
7. Stormwater and grading plans must be approved by the Brown's Creek
Watershed District and Carnelian Marine St Croix Watershed District prior to
release of the final plat from City Offices for filing with Washington County.
8. The developer is to construct Neal Avenue to the urban standard specified by
the City Engineer. The costs of these developer improvements will be
credited against the Transportation Adequacy Fee included in Item 4 above.
9. All electrical and communications utility lines shall be buried.
10. The boundaries of the wetland buffers must be signed according to Brown's
Creek Watershed District rules.
11. The rezoning will not become effective until after the final plat is approved by
the City and filed with Washington County for recording.
12. The landscaping plan requires 39 more trees to meet City standards. Prior to
release of the final plat from City Offices for filing with Washington County,
either a revised landscape plan that includes 39 more trees must be submitted
to the City, or a cash equivalent must be paid to the City.
13. The Development Agreement must be signed by the developer prior to
release of the final plat from CityOffices for filing with Washington County
Enacted by the City Council of the City of Stillwater, Minnesota this 6TH day of March,
2018.
