1) All applicable provisions of the Joint Powers Zoning Ordinance as
well as any more restrictive provisions of the City of Stillwater
concerning this development shall be complied with unless waived
by this permit.
2) Upon agreement between the Zoning Administrator, City and Town of
Stillwater and the Joint Pourers Committee, no building permit w'
be issued prior to the issuance of the Special Use Permit.
3) Sanitary sewer and water improvements shall be constructedir�u u+
ized in accordance with the standards and approval from the Cily
Stillwater Engineer and Water Deapartment.
4) On-site drainage shall comply with the grading plan as approved by
Short -Elliot -Hendrickson. Internal grades within the development
shall be a minimum of 1%.
5) Design and location of all drives and parking areas shall comply with
site plan dated April 16, 1981. (attached)
6) Applicant shall provide for four (4) additional parking spaces if
need arises.
7) Concrete curb and gutter within the parking lot and driveways shall
be constructed to meet the requirements of design B618 set forth in
the State of Minnesota Department of TraLsportation Standard Plates
Manual: Standard Plate No. 7100E or approved concrete curbing alter-
native.
8) Existing curb and gutter on the pub! -IL.,- street at the driveway
entrances shall be removed and replaced with curb and gutter that
meets the specifications of State of Minnesota Department of
Transportation Standard Plates Manual: Standard Plate No. 7035
and attached as Exhibit 2.
9) The public street shall be repaired according to the specifications
of Exhibit 3 in any and all locations :be. st-ent is disturbed.
10) Recommendations contained i, the July 10, 1981 letter from
Short -Elliot Hendrickson consulting engineers shall be followed.

11) Any plant materials indicated on Exhibit 4 that do not survive
must be replaced as needed.
12) All turfed areas on the parcel that have been disturbed or destroyed
during the construction phase of this project shall be graded with
topsoil and sodded in accordance with the recommendations of the
Zoning Administrator.
13) All waste materials and refuse shall be stored insJLde a fenced or
screened area or inside a structure.
14) The parking lot shall be lighted according to the standards of the
Joint Powers Zoning Ordinance.
15) Design, locations and specifications of signs shall conform with the
Joint Powers Zoning Ordinance and are subject to the approval of the
Zoning Administrator. All signs shall require a sign permit to be
issued by the Zoning Administrator.
16) Any alterations to any of the attached Exhibits shall be reviewed
and approved by the Zoning Administrator and shall require an amended
Special Use Permit.
17) The conditions of this permit shall apply to the land described and
shall not in any way, except herein noted, be affected by any subse-
quent sale, lease or other change from the current ownership.
18) Non-compliance with the conditions and attachments of this permit
shall be considered a violation of said permit and may result in
revocation of said permit.
19) Construction shall begin within one (1) year after the issue date of
this permit or t h o permit becomes void.
20) A $13,197.00 finanical guarantee attached as Exhibit'5 shall be
retained by the Zoning Administrator to insure compliance with
the conditions of this permit.

We are submitting herewith our review of the proposed Abrahamson
Nurseries Development grading plan.
We find the grading plan in general conformance with the overall
grading within the area adjacent to Washington Avenue and Tower
Drive. Since Tower Drive has not been improved on the west side
of Washington Avenue, the developer has utilized the proposed
street grades in his grading plan. Since Tower Drive is not
complete at this time; and the developer proposes to outlet
surface drainage in the southwest corner of his proposed develop-
ment, it is necessary to construct a temporary ditcri for drainage
until such time as Tower Drive is completed. We suggest that the
ditching be provided outside of and parallel to the south curb
line flowing to the existing westerly curb of Washington Avenue.
This will provide a temporary waterway for the surface drainage to
an existing street and not allow drainage southerly onto private
property.
Upon reviewing the internal grades in the development in accord-
ance with the suggested engineering standards submitted to the
Joint Powers Committee on August 13, 1980, we find that some
grades do not meet the requirement of a 1% absolute minimum
gradient. Basically the grade southerly across the parking area
in front of the building, the grade in the northwest corner, and
the grade immediately north of the drainage outlet. We feel it is
possible for the developer to correct these grades and provide a
1% minimum.

The grading plan also does not indicate a finished elevation for
the ramp down on the west side of the building. Drainage
facilities for this ramp also are not indicated on the preliminary
grading plan.
The developer indicated to the undersigned that their projected
traffic needs would be approximately 20 to 25 cars per day and one
7 ton truck. With this traffic projection and estimating the
soils to be AASHTO designation A-6 we feel their structural
section of 2" of 2341 bituminous mixture and 6" of Class V
aggregate base should meet the criteria for structural section.
Since a driveway entrance was not provided on Washington Avenue
for this parcel, the existing curb should be removed in the
vicinity of the proposed entrance and new curb and gutter and
entrance constructed in accordance with Mn/DOT Standard Plate
7035J. We are enclosing a copy of the proposed grading plan
submitted to us with the proposed grades indicated in red. We are
also enclosing a copy of Mn/DOT Standard Plate 7035J. We are a_Lso
returning the original contour drawings and the bituminous
estimate sheet which you transmitted to us with the original
information.
We trust this letter will satisfy the requirements of our review
of the Abrahamson's Nursery proposed development in the northwest.
corner of Washington Avenue and Tower Drive in the Stillwater
Industrial Park. If there are any further questions please do not
