All applicable provisions of the Joint Powers Zoning Ordinance as well as any more restrictive provisions of the City of Stillwater concerning this development shall be complied with unless waived by this permit. 2. Witnesseth, that the Contractor and Owner for the considerations hereinafter named agree:as follows: ARTiC,L: I: SCOPE OF WORK The Contractor shall furnish all of the materials and perform all the work shown on the drawing and described in the notes thereon all entitled AUGUSTINE SUBDIVISION PLANS AND SPECIFICATIONS FOR GRADING, EROSION CONTROLS AND TURF ESTABLISHMENT, by Bruce A. Folz & Associates, Stillwater, Minnesota, and shall do everything required by this agreement, the general conditions of the contract and drawings. ARTICLE ii. TIME OF COMPLETION The work to be performed shall commence within five (5) days after the date specified in the notice zo proceed given to him by the Owner to commence work, and the Contractor will complete the work in 90 days. Page 1 of 12 ARTICLE IV. ACCEPTANCE AND PAYMENT. Upon receipt of written notice that the work is ready for ina nspection and acceptance, the Engineer shall promptly make such inspection, and when he finds the work acceptable under the contract and the contract fully performed, he shall promptly issue a certificate, over his own signature, sta- ting that the work provided for in this contract has been completed and is accepted by him under the terms and conditions thereof, and the entire contract sum due shall be paid to the Contractor, at the office of the Owner within thirty (30) days after the date of said final certificate. Before issuance of certificate, the Contractor shall submit evidence satisfactory to the Engineer that all payrolls, material bills and other indebtedness connected with the work have been paid. The making and acceptance of the payment shall constitute a waiver of all claims by the Owner, other than those arising from unsettled liens, from faulty work appearing after final payment, or from requirement of the Specifications and all claims by the Contractor except those previously made and still unsettled. ARTICLE V. CONTRACT DOCUMENTS. The Plans and Specifications, together with thisgreement, form the Contract, and they are as fully a part of the Contract as if hereto attached or herein repeated. ARTICLE VI. CONTRACTOR'S LIABILITY. The Contractor shall have charge of the site and be responsible for the protection of his work during the progress of the construction and until final acceptance. He shall take chargeof and be responsible for any loss or injury from any cause to any materials delivered on or in the vicinity of the work to be used thereon in connection with this contract, prior to its completion. The Contractor shall indemnify and save harmless the Owner, its officers and members, and Bruce A. Folz & Associates, from any and all claims, suits, losses, damages or expenses on account of injuries caused by any act, omission, neglect or misconduct of said Contractor. ARTICLE VII. INSURANCE. The Contractor shall not commence work Rider the Contract until he has obtained all the insurance required herein and such insurance has been approved by the Owner. The Contractor shall deposit with the Owner the original, or a certified copy thereof, as applicable to this project, of all policies required hereunder, except a Certificate of Insurance will be accepted for Workmen's Compensation Insurance. All poli- cies and certificates shall provide that the policies shall remain in force and effect except on ten (10) days written notice to the Owner before concellation evidenced by return receipt of regis- tered letter. THE CONTRACT SUM The final amount of the contract will be determined by multiplying the final measured quantities of the various items actually constructed and installed by the unit prices stated thereof, in the manner prescribed in the specifications._ However, the low bidder shall be determined by adding the sums resulting from multiplying the quantities stated by the unit prices bid therefore. In submitting this bid, it is understood that the Owner retains the right to reject any and al l bids and to wa ive irre(lularities and informal ities therein and to award the contrac1. Workmen's Com ensation and Em to er's Liability Insurance. The Contractor shall carry Workmen's Compensation and Employer's Liability Insurance covering him for all of his obligations under the Workmen's Compensation Act of this State and shall require each Subcontractor to do likewise. Insurance limits shall be statutory. b. Comprehensive Public Liabi 1 iter„ and Prolty pamace Insurance. The Contractor shall take out and maintain such Bodily Injury and Property Damage Insurance as shall protect him from damages for bodily injury, including death, as well as for claimsfor property damage which may arise from operations under this contract. The insurance shall also include "Completed Operations Coverage." The amounts of such insurance are as follows: T. The Contractor shall take out and maintain, during the life of this Contract, Automobile Bodily Injury Insurance in the amount of $100,000 per person and $300,000 per accident, and Property Damage Insurance in an amount of not less than $50,000 per accident, covering him not only for the operation of automobiles owned or used by him, but automobiles hired by him, and Non -Ownership Coverage as respects automobiles of employees. d. Owner's Liability Insurance. The Owner shall be responsible for and at his option may maintain such insurance as wily protect him from his contingent liability to others for damages because of bodily injury, including death, which may arise from operation under this Contract and any other liability for damages which the Contractor is required to insure under any provisions of this Contract. The Owner may accept insurance covering a Contractor or a Subcontrac- tor in character and amounts less than the requirements set forth herein where such requirements appear" excessive because of the character of the extent of the work to be performed by the Contractor or Subcontractor. f. Subcontractor's Insurance. Subcontractors shall have coverage the same as the prime Con- tractor and shall furnish Certificates as evidence of that coverage. ARTICLE VIII. ASSIGNMENTS. No assignment by the Contractor of any Principal construct on contract, or any part thereof, or of the funds to be received thereunder, will be recognized unless �.: such assignment has the written approval of the Owner. Such assignment shall specify the amount to be paid, the purpose for which the assignment is given, and shall contain an agreement by the assignee that the funds to be paid are subject to a prior lien for' services rendered or materials furnished for the project. ARTICLE IX. The Contractor and the Owner for themselves, their successors, executors, administrators and assigns hereby agree to full performance of convenants herein contained. WITNESSES: OWNER: BY DATE WITNESSES: CONTRACTOR: BY DATE Page 5 of 12 SPECIAL PROVISIONS - AUGUSTINE SUBDIVISION 1.0 SCOPE OF PROJECT This project provides for the construction of grading, erosion controls and turf establishment for Midland Meadows, Washington County, Minnesota. All work shall be performed by the owner or subcontracted as necessary. 2.0 SPECIFICATIONS WHICH APPLY The Specifications contained herein and the Construction Plans for Midland Meadows together with those portions of the Minnesota Department of Highways "Standard Specifications For Highway Construction" dated January 1, 1972, as indicated by paragraph number (i.e. MHD 2341) shall apply together with all Federal, State, County and Local Laws and requirements which may apply to this work. 3.0 STAKING AND INSPECTION Construction staking shall be performed by Bruce A. Folz & Associates, 14791 60th Street North, Stillwater, Minnesota 55082, Phone 439-8833. Inspection to be performed by Bruce A. Folz & Associates, and SEH Engineers, engineer representing Joint Powers. 4.0 PERMITS, LICENSES AND EASEMENTS The Owner will obtain necessary permits for work on all State Highways, County and Railroad rights-of-way, and where required will supply necessary certified checks and/or bonds therefor. The Contractor shall comply with all necessary and stated conditions contained within said permits where granted. Further, until work on such rights-of-way is completed to the satisfaction of the Engineers, and such regulatory agency involved therefor, the project will not be finally accepted or final payment made thereon. When construction is on private property, the Owner will require necessary easements over such land. The easement widths and boundaries are noted on the plan. It shall be the responsibility of the Contractor to acquaint himself with the easements and to confine his operation to the easement widths or boundaries shown. Any procedures by the Contractor of any sort beyond the limits or boundaries indicated shall be the sole responsibility of the Contractor who shall save the Owner harmless from any claim for damages due to trespass. Investigation of Conditions Contractors are notified to investigate and become familiar with conditions relating to the work to be performed according to the Contract and Specifications and failure on the part of the Contractor to investigate, inspect, take proper measurements or boring, will not be grounds for additional compensation under this Contract. Page 6 of 12 SPECIAL PROVISIONS - AUGUSTINE SUI DIVISION 5.0 PROSECUTION OF WORK NEAR EXISTING UTILITIES All known existing utilities are shown on the plans and the Contractor shall notify all utilities prior to beginning work. All utilities shall remain undisturbed during the course of construction. 6,0 CONSTRUCTION ADJACENT TO PRIVATE PROPERTY Before proceeding with construction adjacent to private property, the Contractor shall verify with the Engineer the right-of-way available for construction. This right-of-way will be staked to establish, in the field, the right-of-way available. The Con- tractor shall confine construction operations to right-of-way available. Existing structures such as fences, private water lines, posts, property irons, mail boxes, culverts, traffic sign, etc. shall be protected during construction. If they are removed to facili- tate construction, they shall be replaced without direct compen- sation therefor. 7.0 TRAFFIC PROVISIONS Local traffic shall be maintained on all existing streets subject to the provisions as follows: The Contractor shall prosecute his work in a manner which will allow access to all areas within the project by fire and police equipment, The work schedule shall be so organized to cause a minimum inconvenience to local traffic and provide access to abutting property, The Contractor shall provide sufficient barricades, and/or electric flashing lights when construction conditions require. The Owner will not furnish traffic control signs or barricades where such signs and barricades are required; these shall be furnished and placed by the Contractor in accordance with the manual on Uniform Traffic Control Devices for Streets and Highways published by the U.S. Department of Transportation, Federal Highway Administration. 8.0 EXISTING DRAINAGE FACILITIES Unless affected by the work of this project or noted to the contrary on the plans all existing culverts, drainage structures, storm sewers, and ditches shall be protected and either left in their present condition or replaced at original location and elevation. Page 7 of 12 Project„Technical Specifications - 1 Grading, Erosion Controls, and Turf Restoration I. Scope of Work The work to be done under this contract shall include the furnishing of all materials, labor, tools, and equipment to construct complete in place rough grading, replace topsoil, seed and mulch. Included under this Contract, the Contractor shall do the excavating and compacting of all kinds of material encountered; protect, repair, relocate, maintain and restore all subsurface, surface and overhead structures directly or indirectly disturbed, injured or affected by his operations, and furnish all other appurtenant items and services necessary or specified. In the following Specifications, reference is made to "M.H.D. Specifications", which shall mean the "Standard Specifications for Highway Construction" of the Department of Highways of the State of Minnesota, dated January 1, 1972, and any subsequent amendment. 2. €xisti�ny Underground Utilities Every efford has been made to position and dimension all existing underground utilities on the Plans. This infor- mation was obtained from the respective utility companies, and.the.surveyor does not guarantee the locations as shown on the Plans. It is the Contractor's responsibility to ascer- tain the final location of these utilities and to notify the utility companies when construction commences in each area. The Contractor is responsible for the protection of all un- derground utilities which are located in the field or are shown on the Plans. 3. Construction Stakes All work under this Contract shall be constructed in accor- dance with lines and grades shown on the drawings and as established by the Surveyor. These lines and grades may be modified by the Surveyor as necessary. Page 8 of 12 3. Construction Stakes (Continued) The Contractor shall render such assistance to the Surveyor as may be required for setting lines and grade stakes, batter boards, templates, patterns, platforms, reference points, or other marks, or points of line or grade for proper execution of the work. The Contractor shall give the Surveyor sufficient notice (48 hours) of his need for the establishment of line and grade so that the Surveyor may have time to provide same., After lines and grades for any part of the work have been given by the Surveyor, the Contractor shall be held responsible for the proper execution of the work to such lines and grades and all stakes or other marks given shall be protected and preserved by him until authorized to remove them by the inspector. The Contractor shall, at his own expense, correct any mistakes that may be caused by their unauthorized dis- turbance or removal. The Surveyor may require that work be suspended at any time when for any reason, such marks cannot be properly followed. 4. Excavation and Embankment Excavation and embankment construction shall conform to M.H.D. specification 2105 and shall also conform to City or County requirements if more restrictive than M.H.D. specs. All cuts and fills shall be balanced on the subject property. Excess cut disposal areas shall be designated by the surveyor �= in the field and placement shall conform to his instructions. All topsoil shall,be stripped and stockpiled where designated by the Surveyor and shall be respread following rough grading. All excavations and embankments shall be maintained in a well drained condition at all times. This shall include the installation of planned,drainage facilities concurrently with the embankment construction or the installation of temporary drainage facilities as directed by the Surveyor. No material shall be stockpiled in a manner that will restrict surface drainage. If, during prosecution of the work, it is necessary to interrupt existing surface drainage, sewers, or under drain- age, the Contractor shall, at his expense, provide and main- tain temporary drainage facilities as approved .by the Surveyor until the permanent facilities are completed and opera- tive. Before placing embankment on an existing slope steeper, than 4 horizontally to 1 vertically (4:1), the Contractor shall, Page 9 of 12 4. Excavation and Embankment (Continued) at his option: (a) flatten the existing slope to the extent that it will not be steeper than 4 to 1; or (b) construct steps in the slope, with the back surface being as nearly vertical as practicable and with the horizontal cuts being t made as close together as the slope permits, but with no r. step being less than one foot in width. All work required by these provisions shall be considered to be incidental work for which no direct compensation will be made, Roads shall be subcut to a depth of eight (8) inches. Before backfilling building pads that are two and one-half feet or less in depth, the upper 6 inches of soil below the bottom of the excavation shall be compacted to 95 per cent of Maximum Density. Embankment material shall be deposited and Spread in relatively uniform layers approximately parallel to the profile grade, and extending over the full width of the.embankment, layers in the.upper 3 feet of the building pad foundation elevation shall be not more than 8 inches in thickness (loose measurement) and those below the upper 3 feet shall not be more than 12 inches in thickness (loose measurement). 5. Compaction Compaction shall conform to proceedures in M.H,D. 2105.3F "Roadbed" shall also be interpreted to mean any areas where home foundations will be on compacted fill; i.e. the building pad. Compaction in these areas shall extend forty (40) feet from the front yard building setback line and a minimum of five (5) feet outside the side yard building setback lines. Unless otherwise specified the specified Density method shall be used in all filled building pad areas but not on street sections in fill. Ordinary compaction may be used in Filled Street sections and all other areas. 6. Finishing Finishing operations shall conform to M.H.D. 2105,3D. All excavation, embankment and areas involved in or disturbed by the construction shall be finished in reasonably close conformity with the established lines.and grades, including any tolerances specified. The Subgrade shall be finished and maintained as required by the applicable provisions of 2112. Page 10 of 12 6. Finishing (Continued) When compaction was obtained by the Ordinary Compaction Me- thod, the final shaping of the Roadbed shall be done when, in the opinion of the Engineer, the moisture content of the upper portion of the Roadbed is suitable for that work. If necessary, in conjunction with the final shaping, the Con- tractor shall, at his expense, scarify the Roadbed to a depth of 6 inches and recompact it. Earthwork finishing and.topsoil covering operations shall be conducted concurrently with the grading operations so as t.o permit prosecution and completion of erosion control items at the earliest practicable time. Topsoil covering operations shall be carried out as soon as possible after the sub -soil hasbeen finished to grade on any significant area. At the time the topsoil covering is placed, the subsoil shall be in a loose, friable condition for a uniform depth of at least 3 inches, and there shall be no erosion rilles or washouts in the subsoil surface exceeding 3 inches in depth. Scarification of the subsoil prior to topsoil place- ment will be required as directed by the Engineer, wherever the subsoil has been compacted by equipment operation or has become dried out and crusted, and where necessary to obliterate erosion rilles. Scarification of the subsoil shall be accomplished with suitable equipment and to such an extent as will provide not less that three inches of uni- formly loose, friable soil below the topsoil covering. All depressions resulting from structure removals, debris burying, grubbing operations, and other causes, shall be back-filled with suitable material to the designated contour and so as to conform with any pertinent requirements. All debris and any stones exceeding 3 inches in greatest dimension, that appear on the Subgrade surface or the surface of areas covered with topsoil, at the time of perfroming the final blading operations, shall be removed therefrom and disposed of in accordance with the provisions of 2104.3C. Subgrade shall be left within + 0.2 feet of subcut finish grade. 7. EROSION CONTROLS Erosion controls shall be adhered to as per Washington County Soil Conservation District requirements and as per these plans and specifications. Erosion controls consist of: 1. Field located earthen berms to confine runoff, 2. Double staked haybales in all drainage channels to remove silt and reduce flow velocities. (Incidential item with grading contract). 3. Immediate seeding; seeding and mulching, or sodding as per seasonal requirements and the plans, 4. Maintenance of all control devices until growth of grass Page 11 of 12 and completion of storm sewer ponds and sewer systems permit. Maintenance shall also include cleaning of all silt and sand from the roadway, ditches, ponds and sewer system until final acceptance by the governing body. 8. TURF ESTABLISHMENT All grading areas shall be topdressed with 4 inches of topsoil and seeded. All slopes in excess of 13% shall be seeded and mulched. All graded drainageways, including road ditch bottoms exceeding 4% slope shall be sodded. Seeding shall conform to the provisions of 2575 except as modified below: Topsoil shall be sandy loam with a pH factor 7.0 to 7.5 salvaged.from site and replaced to a minimum depth of 4". If original material is below pH 7.0, the pH isto be corrected by incorporating sufficient ground limestone or dolomite. If original material is above pH 7.5, the pH is to be corrected by adding acid peat. Areas to receive topsoil and seed are miscellaneous berm fill and slopes throughout the project. Seeding construction requirements and acceptance shall be as follows: A. Preparation of Seeded Areas 1. Stones larger than 1", clods, roots and other undesirable matter will be removed. 2. The Contractor shall loosen and rake uniform the top 4" of topsoil. B. Seed Placement 1. The seed must be watered the same day it is placed. 2. Seed will not be placed between June 10 and August 10. 3. Seed shall be MHD 3876 mixture designation 7 applied at 100 pounds per acre. 4. Mulch shall be MHD 3882 Type 1 applied at a minimum of 3000 pounds per acre and shall be disked into the ground with an approved device. 5. Fertilizer shall be a 12-12-12 formula spread at 200 pounds per acre as per MHD 3881. C. Maintenance 1. The Contractor shall water the seed once on each of three (3) consecutive days following placement, excluding Sunday and periodically throughout the maintenance period as required. 2. The maintenance period shall be until the turf is established. 9. SOD Sod material shall conform to MHD 3878 and shall be placed in accordance with MHD 2575. The Augustine property is generally located north of trunk highway 36 and south of the Forrest Hills Addition to the City of Sti'lllwater and westerly of the warehouse market and extends to Mr. Lloyd Anez's property. The developer proposes to grade the entire site which is approximately 17.6 acres. The developer proposes to create a minor subdivision on one tract of the parcel to provide for limited land use and development. A report on drainage facilities and roadway alignment was provided for the City of Stillwater for the Augustine plat. This report was dated August 15, 1980, our file number 79146. An alignment was proposed for 61st Street such that it would satisfy the require- ments of Oak Park Heights and Mr. Anez's property to the west. 61st generally would be an east west street terminating on Greeley Street to the west (County Road 66) and Oren Avenue to the east. Our original report proposed limited storm sewer on 61st Street and two ponding areas to be located within the Augustine plat. Preliminary street grades were also established for 61st Street as a part of the drainage study. The ponding areas were proposed to be located south and north of 61st Street. The proposed ponding areas would be located in existing natural ponding areas. The southerly pond would be connected to the north pond by a pipe providing discharge from the south pond to the north pond. The north pond was proposed to discharge through storm sewer to Rainbow Court in Stillwater and connected to an existing storm sewer. We find the proposed grading plan to be generally in conformance with our preliminary grades as established for the afore mentioned drainage study. Since the developer intends to develop only the single tract adjacent to trunk highway 36, the storm sewer system is not proposed to be constructed at this time. Since an out- let for this pond will not be provided at this time, we calculated the effect that a 100 year frequency storm would have on this ponding area. We find that the proposed ponding area would be sufficient to provide storage for a 100 year frequency storm. The northerly pond is proposed to provide storage to a peak elevation of 880. A final contour of 880 is shown adjacent to the existing homes in the Forrest Hills Addition. We recommend that the developer provide a berm to elevation 882 adjacent to the back lot lines of these existing homes. This will provide a 2' freeboard for storm ---water storage. It is recommended that the storm sewer and necessary ponding outlets be provided before any further development of the site. Sanitary sewer and watermain are extended to the easterly line of the proposed tract A minor subdivision. The sanitary sewer and watermain facilities are part of the City of Oak Park Height's system. The developer will have to coordinate sanitary sewer and water service connection with the City of Oak Park Heights. -We have enclosed a copy of a portion of the proposed grading plan indicating the location of the recommended berm on the north edge of the northerly pond. We find the proposed grading plan to conform generally with our preliminary grades and recommend the site grading proposal be approved with the recommended restrictions as stated in this letter.
