1. All applicable provisions of the Joint Powers Zoning Ordinance as
well as any more restrictive provisions of the City of Stillwater
concerning this development shall be complied with unless waived
by this permit.
2. Upon agreement between the Zoning Administrator, City and Town of
Stillwater and the Joint Powers Committee, no building permit will
be issued prior to the issuance of this conditional use permit.
Any alteration of the existing structure shall require a building
permit.
3. On-site drainage shall comply with the grading plan as indicated
on Exhibit D.
4. Design and location of all drives and parking areas shall comply
with Exhibts D and E.
5. Concrete curb and gutter within the parking lot and driveways shall
be constructed to meet the requirements of Exhibit D.
6. Existing curb and gutter on the public street at the driveway en-
trances shall be constructed according to the specifications of
State of Minnesota Department of Transportation Standard Plates
Manual: Standard Plate No. 7035 and attached as Exhibit G.
7. All parking spaces shall be delineated with four (4) inch wide
painted stripes.
8. The proposed establishment shall not open for business until the
parking lot has been paved and curbed according to Exhibit D and Eand
inspected and approved by the Zoning Administrator.
9. Any plant materials indicated on Exhibit C that do not survive
shall be replaced as needed.
10. All turfed areas on the parcel that have been disturbed or destroyed
during the construction phase of this project shall be graded with -
topsoil and sodded prior to June 1, 1981 in accordance with the
recommendations of the Zoning Administrator.
11. All waste materials and refuse shall be stored inside a fenced or
screened area or inside the structure.
12. Outdoor display of merchandise shall Wprohibited.
13. The parking lot shall be lighted according to the standards of the
Joint Powers Zoning Ordinance.
14. Design, locations and specifications of signs shall conform with
the Joint Powers Zoning Ordinance and are subject to the approval
of the Zoning Administrator. All signs shall require a sign permit
to be issued by the Zoning Administrator.
15. Any alterations to any of the attached Exhibits shall be reviewed
and approved by the Zoning Administrator and shall require an amended
conditional use permit.
16. The conditions of this permit shall apply to the land described and
shall not in any way, except herein noted, be affected by any subse-
quent sale, lease or other change from the current ownership.
17. Non-compliance with the conditions and attachments of this permit
shall be considered a violation of said permit and may result in
revocation of said permit.
18. Construction shall begin within one (1) year after the issue date
of this permit or the permit becomes void.
19. A $8,170.00 financial guarantee attached as Exhibit F shall be
retained by the Zoning Administrator to insure compliance with
the conditions of this permit.

In response to a request from Mr. Koehler dated April ly 1981,
we are submitting herewith our review of parcel 8-194 (Joyce
Melton or MJM Motors property); proposed improvement.
The proposed use for the property would entail the use of the
existing parking lot in front of the existing building. This
parking lot generally is located on the southwest corner of the
intersection of the frontage road to Trunk Highway'36 and
Industrial Boulevard. The parking lot in question is presently
surfaced with crushed limerock. The undersigned visited the site
on this date to attempt to determine the depth of existing crushed
rock on the parking lot. Since the developer proposes to use 2-1/2
inches of bituminous, a total of 5 inches of crushed rock would
be necessary for the structural section. It appears that there
is sufficient crushed limerock on the site at present. The
developer proposes to grade the lot and add crushed rock as
needed. If the total crushed rock section is compacted 5 inches
before placing the 2-1/2 inch bituminous wearing course, the lot
should have sufficient structural section for the proposed use.
The proposed site plan indicates grading the lot to a drainage
swale approximately 10 feet from the easterly edge of the lot
and thence out the driveway entrance onto Industrial Bouelvard.
The fall or gradient indicated on the proposed grading plan is
sufficient to provide adequate drainage.
We find the grading and surfacing plan to be generally in conformance
with the standards as submitted to the Joint Powers Committee. We
