Gentlemen:
We are writing this letter in response to a request from Mr.
Leonard Feely, property owner of the subject development, and a
recent telephone conversation with Mr. O'Donnell. This response
is in regard to the site grading, seeding and erosion control for
the Feely Addition to the City of Stillwater.
We have inspected the grading, seeding and erosion control for the
subject addition and find that all are in conformance with the
grading plan as originally submitted by Lake Elmo Land Surveying.
The seed has taken growth and the strawbales are in place as
indicated with no indication of soil erosion.
The City of Stillwater presently has the utilities and roadways
within the addition under contract with Arcon Construction Co. of
Mora, Minnesota. The contractor is bonded under the city contract
and is responsible for grading and topsoiling and seeding the
boulevard areas immediately adjacent to the concrete curb and
gutter. Since these special conditions of the contract between
the City of Stillwater and Arcon, include a spec reference to
Minnesota Department of Transportation specification 2575, seeding
can only be accomplished between April 1st and June 10th or July
20th and September 15th. As soon as the wearing course is placed
on the streets, the contractor intends to seed the boulevard areas
within the above mentioned date limitations.
The question of planting of boulevard trees within the Feely
Addition was also a matter of concern by Mr. Feely. Since final
development plans for each lot within the addition are unknown at
this time, and since no boulevard trees have been required for

other site developments within the industrial park, it is
questionable whether boulevard trees should be planted at this
time. Since the Joint Powers Committee reviews all individual
site plans and requires a landscaping plan be submitted as part of
the site approval for individual lots, the Committee will be
further assured of trees and shrubbery being provided to enhance
and accommodate the development of each lot separately.
We've therefore approved the site grading in the Feely Addition
and respectfully request that the performance bond which was
provided by Mr. Feely be reviewed and released.
We trust this letter will satisfy the requirements of our review
for the site grading, seeding and erosion control of the Feely
Addition to the City of Stillwater. If there are any further
