HomeMy WebLinkAbout1981-03-18 JPC MINMinutes of the Joint Powers Committee March 18, 1981 MEMBERS PRESENT Ray Senkus, Cathy Buck, Ann Bodlovick, and William Lundquist STAFF PRESENT Dan Koehler, Doug Swenson, and Jeanne' Plourde OTHERS PRESENT Leonard Feely, Jack Lux, Dick Moore, Dan Sandager, Dick Stout, and Bruce Folz CALL TO ORDER Buck chaired the committee and called the meeting to order at 5:35 p.m. PUBLIC HEARING: ZONING ORDINANCE AMENDMENT Koehler explained the proposals in his memo of March 4, 1981, regarding the Zoning Ordinance Amendments on planting islands in parking lots. The two amendments presented for approval included: (1) Parking Stall Deline- ation. Parking lots with a nonporous surface shall be delineated with four (4) inch stripes painted the entire length of the parking stall, and (2) Park- ing Bays. Parking bays that do not head into a lawn area at least six (6) feet wide and parking bays designed with angle parking of less than ninety degrees (9011) shall be defined with vertical markers at each end of the bay. Vertical markers may include concrete curbing, bermed planting islands with six inch (6") concrete curbing, lighting standards, sign posts, guard rails at least three feet (3') high or other devices approved by the Zoning Admin- istrator. The different vertical markers are designed to give developers more options. This amendment eliminates the requirement that parking islands must be in- stalled every 3,000 square feet of lot area. Dick Moore stated that the amendment would be more workable. Mr. Stout has submitted a site plan to Koehler, copies of which were forwarded to Committee. Mr. Stout proposes to construct up to a 5 -court indoor tennis building. The building may vary in size from 3 to 5 courts depending upon how many member can be recruited. Mr. Stout's site plan meets the requirements of the ordinance in terms of setbacks and parking provided. Before Stout prepares the final plans of the proposed tennis club he wants to get a firm idea from the Committee as to whether or not they would approve the proposal. He has not yet obtained an engineering report because he is waiting for the Committee's answer as to how to proceed. If the Committee should approve of the tennis club Stout will start recruiting members and obtaining financing. If Stout gets the needed memberships and finances he will prepare the engineering and landscaping plans before any permit is issued. The tennis club building will be a steel building with decorative mansonry on the front and on one side, rigid roof, and with bleachers, showers and a bel - cony. The club would be private. Koehler stated that commercial recreation and clubs are permitted by SUP in industrial zones. The Chairperson asked the audience for comments regarding the SUP application. There were no comments. Lund- quist seconded. Buck requested receiving minutes before the second Thursday of the month. Motion carried unanimously. NEW BUSINESS The chair entertained a motion to discuss the Zoning Ordinance Amendment regard- ing planting islands in parking lots. Bodlovick moved that the zoning ordin- ance amendment presented be adopted. Lundquist seconded motion. Motion to amend section 708.05, number 11 and 12 of the zoning ordinance carried unani- mously. TENNIS CLUB Buck stated that Mr. Stout was looking for a concept approval because he does not have all the required data needed for a special use permit. Koehler stated that he was comfortable with the proposal and that the committee could grant final approval. Buck entertained a motion to issue a special use permit to Stout on two conditions. Bodlovick moved to grant Dick Stout a special use permit for a private tennis club contingent on the grading plan being approved by the engineer and the zoning administrator and that a landscaping plan be approved by the zoning administrator. Senkus seconded. Moore mentioned a potential problem with the sewer hookup. He stated there would not be a problem if an easement was granted to the city for a manhole. With this easement the water and sewer could be split to provide service to Stout's property and the lots south of his. Bodlovick moved to amend her motion to include the requirements that a utility easement be granted to the city. Senkus seconded. Motion to amend carried unanimously. Motion carried unanimously. SANDAGER Koehler explained Sandager's proposal of a retail greenhouse and nursery is not permitted in an industrial district. Sandager intends to construct the Joint Powers Minutes March 18, 1981 Page Two nursery on lots 7 and 8, block 1 of the Kern-Pauley Addition. Nursery -garden- ing supplies and greenhouses are not permitted in industrial district. Koehler stated Sandager must apply for a rezoning or a zoning amendment so the use would be permitted. Retail nurseries are not allowed in industrial zones. Commercial nurseries are allowed in industrial areas with a special use permit. Nursery -Garden supplies (enclosed) are not permitted in industrial zones. Sandager owns Abrahamson Nursery in New Scandia Township. He proposes to construct a commercial nursery on lots 7 and 8 to include a store, design studio, greenhouse and nursery. His main business would be residential land- scaping, including design and installation, and retail sales. The Committee determined his business to be a Commercial Nursery. Sandager was informed to apply for a special use permit. The chair entertained motion to set a public hearing date for Mr. Sandager's special use permit application for Wednesday, April 22, 1981. Bodlovick made a motion to reschedule the regular Joint Powers meeting from April 15th to April 22nd and hold a public hearing for Sandager's special use permit at 5:30 p.m. on April 22nd. Senkus seconded. Motion carried unanimously. GENERAL DISCUSSION Bruce Folz presented a proposed grading plan for the Augustine Brothers' property. The proposal included a subdivision and an alignment of the 61st Street North. The Stillwater City Council has approved the proposal. Buck read a letter dated March 13, 1981 to the Stillwater City Council from Bruce Folz regarding the Augustine Brothers' property. The letter summarized all actions taken on the proposal from June of 1979 to July of 1980. Buck read another letter to the Joint Powers Committee from Short, Elliot, Hendrickson, Inc., consulting engineer for Stillwater, regarding the proposed grading plan for the property. Since the committee and the Stillwater City Council have approved this proposed alignment of 61st Street North Buck moved to amend the Comprehensive Plan to reflect the proposed alignment. Bodlovick seconded. The motion carried unani- mously. Folz stated he is seeking a minor subdivision so the lot along the frontage road can be sold and developed with a retail use. Koehler mentioned that this minor subdivision would landlock the remaining property. Bodlovick asked whether the committee could be held liable for allowing the creation of a land- locked parcel. Koehler stated the committee could be held liable since it is Joint Powers Minutes March 18, 1981 Page Three the committee's responsibility to insure that each newly created lot is buildable and meets all of the ordinance regulations. However, Koehler felt as long as the committee has adopted a plan for the alignment of 61st Street North that will assure frontage for the remaining property the minor subdivi- sion could be approved. Moore stated he was satisfied with the grading plan and proposed subdivision. He recommended that no development be allowed on the remaining property until the overflow pipe from the southern holding pond to the northern pond is in- stalled. Koehler stated he would issue a grading permit for the proposal subject to Folz submitting a restoration plan and a financial guarantee for the restora- tion. Bodlovick moved to approve the minor subdivision of a lot approximately 3.5 acres in size with the frontage on 60th Street North provided no development occur on the remaining property until the overflow pipe between the holding ponds is installed. Senkus seconded. Motion carried unanimously. Moore recommended the Committee adopt standards on grading. He questioned whether the Committee had ever adopted his grading recommendations. The Committee has not formerly adopted them. The recommendations will be dis- cussed at the next meeting. Buck suggested that Joint Powers take the initiative to promote industrial uses within the area. Moore said industry considers certain elements in an area in which they will locate such as: 1) housing, 2) schools, 3) recreation and 4) amenities. Stillwater has all of these qualities. Moore also sug- gested organizing committees to prepare brochures and slide presentations on various parts of a community that would be of interest to industry. It was decided to discuss this topic at the next meeting. Concern was expressed by several board members regarding a sign on County Road 5, on Croixgate property. The party who erected the sign did not obtain a permit and used the misleading words on the sign of "commercial" and "resi- dential," thus resulting in false advertising. Buck directed Koehler to con- tact the party responsible for the sign and have the wording changed to reflect the actual zoning. ADJOURNMENT Chair entertained a motion to adjourn. Rectful ely submitted, Dan Ko hl r Zoning Administrator ORDINANCE NO. 6 JOINT POWERS COMMITTEE OF THE CITY AND TOWNSHIP OF STILLWATER AND WASHINGTON COUNTY WASHINGTON COUNTY MINNESOTA AN ORDINANCE AMENDING ORDINANCE NO. 1, THE JOINT POWERS ZONING ORDINANCE, THAT REGULATES LAND USE IN THE JOINT POWERS DISTRICT. The Joint Powers Committee does ordain: SECTION 1. AMENDMENT. Section 708.05 (11) is hereby amended to read as follows: "Parking Stall Delineation. Each parking stall in a lot with a non- porous surface shall be delineated with four (4) inch stripes painted the entire length of the parking stall." SECTION 2. ADDITION. Section 708.05 (12) is hereby added: Parking Bays. Parking Bays that do not head into a lawn area at least six (6) feet wide and parking bays designed with angle parking of less than ninety degrees (90 0) shall be defined with vertical markers at each end of the bay. Vertical markers may include concrete curbing, bermed planting islands with six inch (6") concrete curbing, lighting standards, sign posts, bumper guards at least three feet (3') high or other devices approved by the Zoning Administrator. SECTION 3. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication according to law. Koehler, Zoning Administrator ORDINANCE NO. 5 JOINT POWERS COMMITTEE OF THE CITY AND TOWNSHIP OF STILLWATER AND WASHINGTON COUNTY WASHINGTON COUNTY MINNESOTA AN ORDINANCE AMENDING ORDINANCE NO. 1, THE JOINT POWERS ORDINANCE, THAT REGULATES LAND USE IN THE JOINT POWERS DISTRICT. The Joint Powers Committee does ordain: SECTION 1. AMENDMENT. Section 407.01 (6) is hereby amended to read as follows: "A forty-five (45) foot height limitation shall apply to monuments, chimneys and smokestacks, transmission towers of private radio and television broadcasting stations and television antennae." SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full force and effect from,and after its passage and publication according to law.
