CONDITIONS:
1) All applicable provisions of the Joint Powers Zoning Ordinance as well
as any more restrictive provisions of the City of Stillwater concern-
ing commercial development shall be complied with.
2) Upon agreement between the Zoning Administrator, City of Stillwater
and the Joint Powers Committee, no building permit will be issued
prior to the approval and issuance of this CUP.
3) Sanitary sewer and water improvements shall be constructed and utilized
in compliance with engineering standards and approval of the City of
Stillwater.
4) On-site drainage shall comply with Exhibit 1.
5) Design and location of all drives and parking areas shall be as indi-
cated on Exhibit 1.
6) All turfed areas on the parcel that have been disturbed or destroyed
during the construction phase of this project shall be graded with
topsoil, rough seeded, mulched and fertilized or sodded prior to May
25, 1981 in accordance with the recommendations of the Zoning Adminis-
trator.
7) Design, locations and specifications of signs shall conform with the
Joint Powers Zoning Ordinance and subject to approval from the Zoning
Administrator. All signs shall require a sign permit to be issued by
the Zoning Administrator.
8) This permit shall not be considered a building or sign permit.
9) All waste materials and refuse shall be stored inside the trash en-
closure indicated on Exhibit 1.
10) Concrete curbs approved by the engineer shall be installed around all
paved areas as indicated on Exhibit 2.
11) Any alterations to the attached site plan shall be reviewed and ap-
proved by the Zoning Administrator and shall require an amended CUP.
12) Any plant materials that do not survive must be replaced as needed
where indicated on Exhibit 2.
13) The parking lot shall be lighted according to the standards of the
Joint Powers Zoning Ordinance and Exhibit 1.
14) The conditions of this permit shall apply to the land described and
shall not in any way except herein noted, be affected by any subse-
quent sale, lease or other change from the current ownership.
15) Non-compliance with the conditions and attachments of this permit
shall be considered a violation of said permit and may result in
revocation of said permit.
16) Construction shall begin within one (1) year after the issue date of
this permit or the permit becomes void.
17) A $22,500.00 financial guarantee shall be retained by the Zoning Ad-
ministrator to insure compliance with the conditions of this permit.
18) No food and/or beverage service other than vending machines shall be
permitted.
19) All curb returns onto the city street shall be constructed in accord-
ance with the specifications of Exhibit 4.
20) "Stop" signs shall be placed on all driveway exits.
21) A "Deliveries Only" sign shall be placed at the entrance of the ser-
vice driveway indicated on Exhibit 2.
22) Building elevations, drainage, grading and other site improvements
shall be developed according to Exhibit 5.

WESTERN MOTEL SITE
In accordance with Dan Koehler's request of October 27, 1980,
which we received on October 31, we are enclosing herewith a
report of our investigation of the site drainage and facilities
for the proposed motel on Lot 13 of the Matt Hooley Addition of
the Stillwater Industrial Park.
We find the proposed bituminous and gravel section for the parking
area to be in accordance with the suggested standards submitted to
the Joint Powers Committee.
The suggested standards that were submitted to the Joint Powers
Committee on August 13 also suggested that B 618 concrete curb
and gutter be used on sites within the Joint Powers area. The
curbing proposed for this development does not meet the B 618 Mn/DOT
standard, however, they do propose a concrete curb which appears
substantial enough to provide adequate protection within the site.
This site drainage is generally in agreement with the overall site
drainage for the Matt Hooley Addition. The drainage basically is
directed toward the ponding area on the westerly edge of the site.
The developer has provided a curb outlet on the west edge of his
parking area to allow drainage from the site to the pond overland.
The north -south gradient on the west edge of the parking lot is at
approximately a 0.4 percent grade. We feel that a minimum of 0.5
percent should be provided on bituminous parking areas. The cross -
slope of the parking lot is approximately 1.5 percent which meets
the suggested standards submitted to the Joint Powers Committee.
We are submitting aportion of the drawing that you submitted to us
which included the site plan for the proposed development with
these corrections indicated in red pencil. The developer has also
indicated on his drawing that concrete curbing would be extended to

the frontage road shoulder. We feel this curb should be terminated
at the property line and the portion of the driveway between the
property line and the frontage road shoulder be crowned or sloped
to one side to provide drainage from that surface into the ditch
serving the frontage road.
A culvert is required under the drive entrance to facilitate drainage
in the ditch serving the frontage road. We have determined the
drainage area served by this ditch to be approximately 3.89 acres.
In sizing the culvert we find the ditch grade to be at 2.95 percent
which would require a 21 inch CMP cul ' vert. This culvert should also
have apron end sections on each end.If the driveway entrance were
sloped at a 3:1 slope we feel it would require 50 lineal feet of
21 inch CMP including apron end sections.
We trust this report will satisfy the requirements of the review.
