CALL TO ORDER
Cathy Duck chaired the committee and called the public hearing for the
George Olsen Construction Company minor subdivision to order at 5:30 p.m.
Barry Stack presented a site plan and half section map showing the area
(Lot 7, Block 3, Feely's Addition) that is to be subdivided in an east -west
manner. The parcel meets frontage and area requirements. Drainage and
utility easements will be provided for as per Mr. Meister's recommendation.
Cathy Buck read a letter from Mr. Meister addressed to the committee dated
June 21, 1983 (attached). As per Cathy Buck's request, Mr. Meister demonstrated'
how the easements would be brought into the two parcels.
Bob Briggs stated the reason for the subdivision request is to build an office
building on the smaller parcel. They have no need, and would not purchase the
land without it being subdivided.
There was discussion on the requirements for sprinkler systems. Bob Brigg's
stated he was uncertain of what is required for sprinkler systems and stated
he did not know what type of building would be going in on the other parcel.
He anticipa'Ues another office building or compatible type use. Mr. Brigg's
pointed out at some time after the subdivision has occurred it may be
determined it is not economically feasible for them to build an office building
although it is their intention.
Dr. I..allace stated this particular lot was brought before the committee once
before ,-hen he requested permission to build an office/home. He was turned
down with the rationale a big manufacturing plant may someday be built out
there. Dr. Wallace stated the applicants have invested a lot of time and money,
and the parcel is large enough_ to make two nice lots.

Cathy Buck questioned if the street has to be torn up, who would pay the cost
of repair if it were put back negligently. Ann Bodloviok stated the City
of Stillwater is attempting to keep a close record of what contractop—opens
the street and attempt to get them to replace it if its not to the city's
satisfaction.
There was discussion regarding the street being cut into. Mr. Brigg's stated
if it were a restriction the street could not be cut into it would cause him
to question whether they would be willing to follow through on their plans.
Mr. Meister stated if a manufacturing firm were to be built that would require
a lot of water, digging into the street would have to take place to allow for
a larger water line. Buck felt a performance bond for security should be
required. Mr. Briggs had no objection to this. Mr. O'Donnell stated the
performance bond would be taken care of at the time of the Conditional Use
Permit.
The, public hearing closed at 6:00 p.m.

Dear Committee Members:
Pursuant to your request, we have reviewed the Wallace -Olson
minor subdivision of Lot 7, Block 3, Feeley's Addition.
Currently, an 8 -inch water service and a 6 -inch sewer service
have been provided to this lot. These services could be
extended in the boulevard to provide service to both parcels
of land in this minor subdivision. This would avoid digging
into the street. However, the owners will have to determine
if the size of these services are adequate for the type and
size of buildings proposed.
Ten foot wide utility and drainage easements should be
established on all of the lot lines except along Industrial
Boulevard, where a 20 foot easement is required. If the
services are extended southerly in the boulevard, they should
be constructed in this easement.

CALL TO ORDER
Cathy Bucy called the Axdahl/Ogren minor subdivision public hearing to order
at 6:00 p.m.
Don Raleigh, representing Larry Axdahl, stated they were present for preliminary
and final approval of a minor subdivision of two lots into three lots. The new
lots will conform to current standards. A grading plan has been prepared.
There was discussion regarding the storm sewer outlets that were plugged as
a result of the filling operations. Mr. Meister explained the storm sewer
outlets have been opened and the area will either have to be left open as it
is with a ditch section or pipe extended. Mrs. Feely stated some concern should
be given to the fact children play in the ponded water. Buck stated the ponding
area is open now and not ponding so there is no public concern.
Dennis O'Donnell stated there should be a development agreement containing the
following conditions:
1. Grading and drainage plan shall be implemented as per submitted plan.
2. Parking lot and drive would be surfaced with a bituminous surface with
curb in accordance with the Joint Powers standards.
3. Letter of credit for grading and drainage improvements and parking lot
improvements.
4. Park dedication fee is submitted.
5. Access to lots 1 and 2 shall be from Curve Crest Avenue.

Cathy Buck called the meeting to order at 6:15 p.m.
APPROVAL OF MINUTES
Bill Lundquist moved to approve the May 18, 1983 minutes as presented. Ann
Bodlovick seconded. Motion carried unanimously.
OLD BUSINESS
Final approval of Metcalf Minor Subdivision. Barry Stack stated the reason
for the delay on the Metcalf subdivision request was a survey problem where
some of the corners had been moved by the County Surveyor. That problem has
now been resolved.
Ray Senkus moved that final approval for the Metcalf minor subdivision be
granted subject to approval of the park dedication fee. Ann Bodlovick seconded.
Motion carried unanimously.

Discussion of Park Dedication Fee for'Mirior Subdivisions. Dennis O'Donnell
stated there has been concerns by applicants as to the fee for park dedications
in minor subdivisions. According to the ordinance, a park dedication fee of
10% of the market value prior to subdivision is required which could result in
substantial sums of money being dedicated. The ordinance does say that the
board can waive some of the requirements of a major subdivision. Mr. O'Donnell
stated there are three possibilities in the minor subdivisions the committee
can examine, they are as follows:
1. Require to dedication of 10% of market value prior to subdivision.
2. Waive the requirement entirely.
3. Come up with a dedication of a certain dollar amount for each lot.

Bill Lundquist asked if a park dedication fee was paid when these lots were
created. Cathy Buck felt it was the burden of the developer to prove if they
had paid a dedication fee. In the case of Olsen Construction Company, the
dedication fee had been paid.
Don Raleigh felt industrial uses don't require parks and it would be unfair to
add this additional burden to industrial and commercial land that ought to be
in business to provide appropriate tax revenue. Buck differed with this opinion
in that many firms have recreational teams that play in the city and use city
parks during their lunch hours. She noted not all these people live in the city.
After lengthy discussion Ray Senkus moved that for minor subdivisions in platted
areas where a park dedication fee has been paid, whether its commercial, industrial,
or residential a fee of $100 per newly created lot be charged. Bill Lundquist
seconded. Motion carried with Harry Peterson abstaining.
Harry Peterson moved that for minor subdivisions in unplatted areas to charge
a park dedication fee of 10% of the market value prior to development in residential
areas. Ray Senkus seconded. Motion carried unanimously.
There was discussion regarding park dedication fees in industrial and commercial
nonplatted areas. Ray Senkus moved it be the Joint Powers policy to charge a
$100 fee per lot in those cases where no park dedication fee has been paid in
the industrial park. Harry Peterson seconded. Motion carried unanimously.

were seeking preliminary plan approval of the subdivision as submitted.
Ann Bodlovick moved to approve the preliminary minor subdivision with the
utility easements as showm on preliminary plan and that the developer understands
there will be a park dedication fee of $100 for the new lot created. Harry Peterson
seconded. Motion carried unanimously.
Axdahl/Ogren Minor Subdivision. Ray Senkus moved to grant preliminary and final
approval to Lhe Axdahl/Ogren subdivision subject to the development agreement
containing the following:
1. Grading and drainage plan shall be implemented as per submitted plan.
2. Parking lot and drive would be surfaced with a bituminous surface with
curb in accordance with the Joint Powers standards.
3. Letter of credit for grading and drainage improvements and parking lot
improvements.
4. Park dedication of $300.

GENERAL DISCUSSION
Chairperson Buck stated Pastor Swagger of Open Harvest Ministries has requested
a gospel tent meeting on July 13 - July 17, 1983 from 7:30 p.m. to 10:00 p.m.
The tent is 40, x 60, seating 150 people. Open Harvest will rent a satilite
and provide policing to look after the property. The parking will be on grass.
Pastor Swagger stated he obtained permission from Mr. Hooley to have the tent
meeting on his property between Perkins and the Stillwater Motel.
Ann questioned if anything would be sold at this meeting. Pastor Swagger
stated there would not. Buck felt the neighboring property owners should be
informed of the meeting. Harry Peterson felt it was a city council matter,
and suggestedlbe County Fairgrounds as an alternative site.
Bill Lundquist moved the matter be referred to the city council. Ray Senkus
seconded and motion carried unanimously.
