HomeMy WebLinkAbout1982-08-18 JPC MINMinutes of the Joint Powers Committee August 18, 1982 IMMUNO NUCLEAR PUBLIC HEARING MEMBERS PRESENT Bill Lundquist, Ray Senkus, Cathy Buck, Harry Peterson, Ann Bodlovick STAFF PRESENT Robert Lockyear, Douglas Swenson, Rhonda Thode OTHERS PRESENT Don Raleigh, Bruce Folz, Cory Zupf er, Ron Ebelsheiser, Mike Dvorak, David Lindquist, Mabel Lindquist, Leonard Feely CALL TO ORDER Harry Peterson chaired the committee and call ei the public hearing to order at 5:35 p.m. PUBLIC HEARING Harry Peterson stated the reason for the public hearing was to consider the platting of the property legally described as Lot 1, Block 1, St. Croix Business Park and part of SE -14 of SE4, Section 32, T30N, R20W. Bruce Folz showed the committee members the proposed plat of the three lots, explaining Lot 1 includes the existing building, Lot 2 is where the proposed building will go, and Lot 3 is for the proposed driveway access. Folz stated that the plat was fairly straight forward and was open for questions. Ann Bodlovick asked if the driveway and parking is proposed on Lot 3. Folz stated the driveway access was on Lot 3. The parking is on the west side of the building on Lots 1 and 2; however, Immuno was 19 parking places short on Lot 2, and they would be picked up on Lot 3. The reason for doing this is so Immuno could have separate financing on each lot. Don Raleigh stated Immuno Nuclear has agreed to have a permenant easement recorded for the driveway and for the parking of at least 19 automobiles in the southern part of Lot 3. Senkus questioned if the driveway easement could be imposed if.someone else were to buy Lot 3. Lockyear stated it could if it were recorded as part of the permit. Peterson questioned why it was specifically 19 parking places. Raleigh stated it was because Immuno Nuclear was short 19 parking places on Lot 2; one of the options was to move the lot line, but that created building problems. Joint Powers Committee Immuno Nuclear Hearing August 18, 1982 Page 2 In discussion with the Planning Department it was suggested Immuno Nuclear could maintain the building line with an easement, and if a third buidling were ever built there would be more than enough places on the lots for buildings and parking lots. Buck asked the engineer to speak to the issue of services for the sewer. Moore stated he didn't know exactly how Immuno is going to service the buildings. Cory Zupfer stated both the parcels will remain independantly by themselves, he further stated Immuno wants to keep some connection between the two buil- ings, so it will be connected by a walkway and Immuno will want to maintain that same connection on future buildings. Moore stated there was a service in the original plat, but they will have to come into the roadway and put in a larger service. Moore stated the sanitary sewer may be sufficient, and the water main should be adequate for one building, and may be adequate for two depending on their water use. Moore stated he could not address this issue until he looked at Immuno's building designs, fixtures, etc. Buck requested the opinion of the Planning Department. Lockyear stated the only other issue was a parking issue with respect to compact cars vs. normal size. However, the number of car spaces has been met and there is adequate space to expand the compact spaces if necessary. The public hearing was closed at 6:05 p.m. Minutes of the Joint Powers Committee August 18, 1982 ZONING ORDINANCE PUBLIC HEARING MEMBERS PRESENT Bill Lundquist, Ray Senkus, Cathy Buck, Harry Peterson, Ann Bodlovick STAFF PRESENT Robert Lockyear, Douglas Swenson, Rhonda Thode OTHERS PRESENT Don Raleigh, Bruce Folz, Cory Zupfer, Ron Ebelsheiser, Mike Dvorak, David Linquist, Mable Lindquist, Leonard Feely CALL TO ORDER The public hearing was called to order at 6:05 p.m. PUBLIC HEARING Raleigh stated for the benefit of review the zoning ordinance requires a 20' sideyard setback in an Industrial Zone. In order to secure financing, Immuno has to put its buildings on separate lots. The original plan connects these two buildings with a walk -way at the second story. This would leave only a 10' sideyard setback which is in compliance with the state building code and insurance code, and for that reason they proposed an amendment to the ordinance. Buck questioned if any language was proposed for this amendment. Lockyear stated there was only a change to the chart with a footnote indicating a 10' reduction required with a Conditional Use Permit. Bodlovick questioned the possibility of the applicants applying for a variance. Lockyear stated a variance could only be granted if there is a "hardship" shown. He did not feel that a hardship is presented in this case. Lockyear cautioned the committee that any decision to amend the ordinance would apply throughout the entire Joint Power's area, and the committee should not tailor the ordinance to apply to a specific situation. The property is legally described as the north 270' of the south 915' of the west 450' of the SE -1, of the SE -1, of Section 32, T30N, R20W, part of Lot 1, Block 1 of the St. Croix Business Park. Lockyear stated a special use permit could be prepared that would allow for the connections of the buildings with an overhead walkway, and attach conditions as the committee sees fit. Buck questioned what kinds of conditions might be taken into consideration. Lockyear replied that the only conditions that really would be attached are those based on fact with regards to fencing, landscaping, only one obstruction, adequate drainage, no storage or parking be allowed, and conform to health and safety standards. The public hearing was closed at 6:30 p.m. Don Raleigh withdrew the request for a public hearing on the variance request for Immuno Nuclear. Ray Senkus seconded. Motion passed unanimously. NEW BUSINESS A. Plat of Lot 1 Block 1, St. Croix Business Park and part of SE -14 of SE -I,, Section 32, T30N, R20W. Cathy Buck moved that the Joint Powers Committee grant preliminary and final approval on the plat submitted on this date with the following conditions: 1. That an easement and whatever instrument is needed to convey that easement be approved by the Joint Powers Committee staff regarding the southerly 50' driveway and parking, and that this instrument is to be recorded simultaneously or immediately there of to substantiate the title and recording of plat. 2. That the requirements needed to service this plat should be examined and approved by the City of Stillwater engineer. 3. That the street be repaired to the satisfaction of the City of Stillwater engineer upon servicing the plat. Seconded by Ann Bodlovick. Motion passed unanimously. B. Zoning Amendment Buck moved to amend the chart in the Joint Powers ordinance to read that in an industrial zoning district the 20' sideyard setback may be reduced to 10' following the issuance of a conditional use permit as needed to connect buildings. Seconded by Ann Bodlovick. Motion passed unanimously. Joint Powers - Minutes August 18, 1982 Page 2 C. Immuno Nuclear Special Use Permit. Ray Senkus moved that the Joint Powers Committee grant the Special Use Permit with the following provisions: 1. If fencing between buildings is proposed, fencing will be of such construction so as to allow for emergency vehicle access between buildings. 2. Landscaping in the form of ground cover and placed between the two buildings to be approved by the Joint Powers staff. 3. One overhead walkway obstruction will be allowed no wider than 20'. 4. Adequate drainage system to be provided and approved by the city engineer. 5. No storage or parking of vehicles to be allowed in the area. 6. The entire construction will conform to the health and safety standards of the community. 7. If these provisions are not followed, the Zoning Administrator shall have the right to require Immuno Nuclear to appear before the Joint Powers Committee to show cause as to why the permit should not be revoked. Lundquist moved to add that the reason for granting this special use permit was that both parcels of land and both buildings are in one ownership; and if Immuno Nuclear did not go through with the building of the.second building that the committee could revoke the 10' side - yard setback on Lot 1, and Immuno would have to move it back to 20'. Buck seconded. Motion passed unanimously. D. Immuno Nuclear Amended Conditional Use Permit Cory Zupher explained Immuno Nuclear is proposing to put in a temporary one car garage for their maintenance functions, and as soon as the permanent structure was built this garage would be torn out. Buck moved to amend the permit to allow for housing of animals in the original maintenance buildings and construction of a new maintenance facility where it is proposed on a tei-�iporary basis to be removed at the time of construction of the temporary building shall include the legals for Lots 1 and 2. Seconded by Bodlovick. Motion carried unanimously. E. Swager Brothers -- Discussion of Proposed PUD Mike Dvorak and David Lindquist representing Swager Bros., stated they were not sure if they were requesting a PUD or rezoning to R-4 to allow for duplexes. Lockyear stated PUD's for townhouses are allowed, and Joint Powers - Minutes August 18, 1982 Page 3 duplexes would require rezoning. Buck questioned if PUD's were allowed for duplexes. Lockyear replied it would if it remained under one ownership. Suck asked if PUD or rezoning on whole parcel or part of parcel. Lockyear stated he was under the impression Swager Bros. wanted to go to a duplex, therefore they should rezone entire parcel, particial rezoning may result with a piece of industrial in the middle of an R-4 district. Ann Bodlovick stated Stillwater would require a 30' road dedication. Buck stated she did not have enough information to give Swager Bros. a feel of what the committee might approve at some time in the future until they make some decision as to where they are going. GENERAL DISCUSSION Bob Lockyear stated Warehouse Market wanted to remove the planting islands in there parking lot. Lockyear stated this was in compliance with the ordinance as long as some kind of markers are on each isle. It was the general consensus of the committee this would not be a problem as long as the isles were clearly marked. AnontIRNMENT Ann Bodlovick moved to adjourn at 7:15 p.m. Seconded by Ray Senkus. The platting of property presently legally described as Lot 1 Block 1, St. Croix Business Park and the north 270' of the south 915' of the west 450' of the SE -1, of the SE -1, of Section 32, T30N, R20W. 2. Amending Section 602.01(8) of the Joint Power's Zoning Ordinance to read in an Industrial Zoning District the 20' sideyard setback requirement may be reduced to 10' following the issuance of a Special Use Permit. 3. Request of Immuno Nuclear, Inc. for a Special Use Permit to permit construction of a new building so both the new and existing building will be 10' from the side property line. The property is legally described as the north 270' of the south 915' of the west 450' of the SE -14 of the SE -4 of Section 32, T30N, R20W, part of Lot 1 Block 1 of the St. Croix Business Park. 4. A variance from the sideyard setback requirement submitted by Immuno Nuclear, Inc. to allow construction of a new building 10' from the side property line instead of the required 20'.
