HomeMy WebLinkAbout1982-06-23 JPC MINMinutes of the Joint Powers Committee June 23, 1982 ALLEN METCALF PUBLIC HEARING MEMBERS PRESENT Harry Peterson, Ray Senkus, Cathy Buck, William Lundquist, Ann Bodlovick STAFF PRESENT Doug Swenson, Dennis O'Donnell, Rhonda Thode OTHERS PRESENT Barry Stack, Max Fry, Jerry Daniels CALL TO ORDER Cathy Buck chaired the committee and called the public hearing to order at 5:35 p.m. PUBLIC HEARING Cathy Buck stated the purpose of the public hearing was to consider the minor subdivision request for Allen Metcalf, for the property legally described as part of the SW -1, of the SE -14 of Section 31, T30N, R20W, Stillwater Township, Washington County, Minnesota. Barry Stack, surveyor, presented the committee members plans for the subdivision, explaining the intent was to divide a 5.5 acre parcel into two (2) two and one-half (22) acre lots. Max Fry expressed concern over the possibility of future road development on an easement between his house and Metcalf's property. The committee felt this was not a problem after looking at the Road Transportation Map from the Joint Powers Comprehensive Plan. Max Fry stated the plans do not show where Mr. Metcalf would be putting in a driveway or road of any type by the house, and expressed concern over where such a road might be. Stack replied a road will probably be coming up by the west side of the drainfield. Bill Lundquist asked if there were any complaints from the neighbors. Stack replied he hadn't heard anything. Seconded by Ray Senkus. Motion carried unanimously. NEW BUSINESS Allen Metcalf Minor Subdivision Request O'Donnell stated the required soil borings have been done and both lots meet the minimum dimensional requirements of the ordinance, but the issue of park dedication needed to be addressed. O'Donnell stated either 10% of the market value of land prior to subdivision or 7% of the gross area of land is the usual procedure. Barry Stack presented the committee members with the market value of the land, which is $22,800.00, according to the Assessor's Office as of June 23, 1982. The house value is an additional $120,000.00. Buck stated half of the land value ($11,400.00) would be used as a base to figure the park dedi- cation. Ray Senkus moved that the request for a minor subdivision for Allen Metcalf be granted upon receipt of a certified check for $1,140.00 as a park dedication. Seconded by Bodlovick. Motion carried unanimously. Request for a Conditional Use Permit by Jerry Daniels Mr. Daniels stated he was present to request a Conditional Use Permit to sell Christmas trees in his parking lot with the same conditions that applied last year, except to move more trees in the back; but still keeping them out of the parking lot. Ann Bodlovick stated no complaints were received last year and moved that a Conditional Use Permit be drafted by Dennis O'Donnell and issued to Mr. Daniels on the same lines as last year. Seconded by Harry Peterson. Motion carried unanimously. OTHER BUSINESS Cathy Buck questioned the status of the violator who had a welding oepration in a trailer on his property. Doug Swenson stated it was still pending. Joint Powers Committee - Minutes June 23, 1982 Page 2 O'Donnell stated he has written several letters and was given a verbal commitment that the trailer would be removed. Swenson stated there are two possible courses of action: 1. Charge him with a misdemeanor. 2. Take civil action, using a court order to remove the trailer. Bodlovick felt a letter from the County Attorney should be sent before any action was taken. Swenson stated he would draft a letter with a deadline for response prior to the next meeting. Buck stated she saw a sign in the Joint Powers area that stayed "for sale in commercial zone" when it is in an industrial zone. O'Donnell stated he was aware of the problem. Bodlovick questioned whether the Croixgate sign had been corrected. O'Donnell stated a board had been nailed over a portion of the sign. O'Donnell asked the committee members what procedure they would like to take as far as minor subdivision requests in the future: 1. Hold a public hearing for every request. 2. Have every request come before the Joint Powers Committee without a public hearing. It was the general consensus of the committee to hold a public hearing for every minor subdivision request in the Joint Powers area. ADJOURNMENT Ray Senkus moved to adjourn at 6:25 p.m. Seconded by Ann Bodlovick. Motion carried unanimously. /s/ Dennis O'Donnell Notice of Public Hearing Notice is hereby given that the Joint Powers Committee of the City of Stillwater, Stillwater Township, and Washington County will hold a public hearing on Wednesday, June 23, 1982 5:30 p.m. Washington County Board Room Washington County Courthouse Stillwater, MN The purpose of the public hearing is to consider the request of Allen Metcalf for a minor subdivision to divide a 5.5 acre parcel into two (2) two and one-half (22) acre lots. The property is legally described as part of the Sun, of the SE -I, of Section 31, T30N, R20W, Stillwater Township, Washington County, Minnesota. The public is encouraged to attend and testify.
