UNIT EXHIBIT A CONDITIONS (Permit #) JP -CUP -82-005 (Applicant) River Valles Professionals (Date) May 6, 1982 - Ned Windmi11er 1) All applicable provisions of the Joint Powers Zoning Ordinance as well as any more restrictive provisions of the City of Stillwater concerning this development shall be complied with unless waived by this permit. 2) Upon agreement between the Zoning Administrator, City and Town of Stillwater and the Joint Powers Committee, no building permit will be issued prior to the issuance of the Conditional Use Permit. 3) Sanitary sewer and water improvements shall be constructed and util- ized in accordance with the standards and approval from the City of Stillwater Engineer and Later Department. 4) On-site drainage shall comply with the grading plan as indicated on Exhibit 1, except as follows: a low point must be provided on the north curb of the easterly parking lot, a catch basin installed and the 18" stub used for internal drainage as per the recommendation letter from Short, Elliot, Hendirckson, Inc. dated May 5, 1982 (Exhibit 2). 5) Design and location of all drives and parking areas shall comply with Exhibit 1. 6) Concrete curb and gutter within the parking lot and driveways shall be constructed to meet the requirements of design B618 set forth in the State of Minnesota Department of Transportation Standard Plates Manual: Standard Plate No.7100E (Exhibit 3) and shall be located as indicated on Exhibit 1. 7) Existing curb and gutter on the public street at the driveway en- trances shall be removed and replaced with curb and gutter that meets the specifications of State of Minnesota Department of Transportation Standard Plates Manual: Standard Plate No. 70351 and attached as Exhibit 4. 8) The public street shall be repaired according to the specifications of Exhibit 5 in any and all locations the street is disturbed. 9) Any plant materials indicated on Exhibit 1 that do not survive must be replaced as needed. 10) All turfed areas on the parcel that have been disturbed or destroyed during the construction phase of this project shall be graded with topsoil, rough seeded, mulched, and fertilized or sodded in accordance with the recommendations of the Zoning Administrator. 11) All waste materials and refuse shall be stored inside a fenced or screened area, or inside a structure. 12) The parking lot shall be lighted according to the standards of the Joint Powers Zoning Ordinance. 13) Design, locations and specifications of signs shall conform with the Joint Powers Zoning Ordinance and are subject to the approval of the Zoning Administrator. All signs shall require a sign permit to be issued by the Zoning Administrator. 14) Any alterations to any of the attached Exhibits shall be reviewed and approved by the Zoning Administrator and shall require an amended Conditional Use Permit. 15) The conditions of this permit shall apply to the land described and shall not in any way, except herein noted, be affected by any subse- quent sale, lease or other change from the current ownership. 16) Non-compliance with the conditions and attachments of this permit shall be considered a violation of said permit and may result in revocation of said permit. 17) Construction shall begin within one (1) year after the issue date of this permit or the permit becomes void. 18) A $39,752 financial guarantee attached as Exhibit 6 and 7 shall be retained by the Zoning Administrator to insure compliance with the conditions of this permit. 19) Each. proposed use in this office building must be approved by the Joint Powers Zoning Administrator prior to occupancy. We discussed the alternatives for roof drainage for the River Valley Professional Building to be constructed near the intersection of Curve Crest Boulevard and Northwestern Avenue. As I indicated at that time, we plan to drain the roof directly to the site, and will confirm with the architect that the site must also be properly drained. The other subject we discussed last week concerned the installation of a natural gas supply pipe in the ceiling space of this building. As I explained to you and to Alan Zepper, the pipe must run approximately eighty feet across the ceiling which serves as the return air plenum. Alan agreed that this design will be acceptable if we use welded steel pipe and test it under pressure before we put it into service. I will send a copy of this letter to Alan for his information. This site is located on Lots 4, 5, and 6, Block 2 of the Kern-Pauley Addition. This is the southwest quadrant of the intersection of Curve Crest Boulevard and Northwestern F,venue. We find the grades within the site to be in accordance with the standard requirements of the joint powers committee. Concrete curbing and bituminous surfacing has been designed for all the parking area and driveways. The architect will utilize the existing curb cut on Curve Crest Boulevard such that the driveway into the site will be aligned with openings in the island area of Curve Crest Boulevard. The architect has proposed to remove and reconstruct curbing on Northwestern Avenue to accommodate a driveway on the easterly edge of the site. We find this curb cut as designed on the plans to be in conformance with the Joint Powers requirements. The site is generally graded in a northwesterly direction such that drainage will exit the existing curb opening on Curve Crest Boulevard. When Curve Crest Boulevard utilities were .constructed an 18" RCP storm sewer stub was provided in the vicinity of Lot 6. This stub was intended to pick up, internal drainage since the racketball club site drains northerly along the common lot line between Lots 5 and 6. It was felt this drainage should be picked up internally and then piped through the storm sewer system rather than overflow onto Curve Crest Boulevard. PAUL, MINNESOTA 55117 • PHONE (612) 484-0272 Joint Powers Committee May 5, 1982 Page 2 storm sewer utilization was not indicated on the architect's site plan however, the undersigned contacted the architect by telephone and requested that a low point be provided on the north curb of their easterly parking lot; a catch basin installed and the 18" stub used for internal drainage. The undersigned was assured that this change. would be made to accommodate the overland drainage. We reviewed the proposed structural section for the bituminous areas within the site. The architect is proposing either an 8" Class 5 Aggregate Base or a 5" Classi Five Aggregate Base utilizing 100% crushed rock. This will be surfaced with a 2" bituminous surfacing. We find the structural section to be adequate for the proposed traffic loadings and existing soil conditions. Sanitary sewer and water services were stubbed into the easterly edge of Lot 6 from Northwestern Avenue. These services will be utilized for the buildings sanitary sewer and water service. We trust this letter will satisfy the requirements of our review of the proposed River Valley Professional Building located on Lots 4, 5, and 6 of the Kern-Pauley Addition, Block 2.
