SPECIAL CONDITIONS OR RESTRICTIONS
1) All applicable provisions of the Joint Powers Zoning Ordinance as
well as any more restrictive provisions of the City of Stillwater
concerning commercial development shall be complied with.
2) Upon agreement between the County Planning Department, City of Still-
water and the Joint Powers Planning Committee, no plan review will
be completed or building permit issued prior to the approval and is-
suance of this special use permit.
3) Water improvements shall be constructed in compliance with engineer-
ing standards and approval from the City of Stillwater.
4) The on-site.sewage treatment system shall be installed in accordance
with the septic system permit to be issued by Washington County and
regulated by the Washington County Septic System Ordinance. The
septic system permit must be current.
5) On-site drainage shall comply with the grading and parking lot grade
elevations plan as indicated on the attached plan dated October 9,
1979.
6) Design and location of access drives shall be located as indicated
on the attached plan dated October 9, 1979.
7) Parking and internal circulation shall comply with the attached plan
dated October 9, 1979.
8) All drives and parking areas shall be paved with bitumen before the
establishment opens for business.
9) All turfed areas on the parcel that have been disturbed or destroyed
during the construction phase of this project shall be graded with
topsoil and sodded prior to May 25, 1981 in accordance with the rec-
ommendations of the Washington County Soil Conservation Service.
10) The access drive shall be constructed in accordance with the stipu-
lations of the Access Driveway Permit issued by Washington County.
See the attached letter of approval submitted to Polka Dot Dairy,
Inc. by Robert W. Parent on October 25, 1979.
11) Six inch (6") poured in place concrete curbs or concrete curbing ap-
proved by the zoning administrator shall be installed around the en-
tire paved area as indicated on the attached plan dated October 9,
1979.
12) All plant materials listed on the attached plan dated October 9, 1979,
including sod, shall be planted and maintained. The survival rate of
all plant materials shall be one hundred percent (100%) until September
30, 1983. Dead plant materials shall be replaced as necessary during
the appropriate planting season.
13) All waste materials and refuse shall be stored in the area indicated
as "trash storage" on the attached plan dated October 9, 1979. The
trash storage area shall be completely enclosed and/or screened from
all public streets and adjacent properties.
14) The parking lot shall be lighted according to the standards of the
Joint Powers Zoning Ordinance.
15) The conditions of this permit shall apply to the land described and
shall not in any way, except as herein noted, be affected by any
subsequent sale, lease or other change from the current ownership.
16) Any proposed alterations to the attached plan dated October 9, 1979
shall be reviewed and approved by the Joint Powers Committee and
shall require an application for an amended special use permit.
17) Design, locations and specifications of signs shall conform with the
Joint Powers Area Ordinance and subject to approval from the County
Zoning Administrator. All signs shall require a special use permit
to be issued by the Zoning Administrator.
18) This permit shall not be considered a building or sign permit.
19) Non-compliance with the conditions and attachments of this permit
shall be considered a violation of said permit and may result in
revocation of said permit.
20) Construction shall begin within one (1) year after issuance of this
special use permit or this permit shall be void.
21) A $30,000.00 irrevocable letter of credit shall be submitted to the
Zoning Administrator to insure compliance with the special use per-
mit. This special use permit shall not be valid until said letter
has been submitted. The irrevocable letter of credit shall remain
in effect until January 1, 1984.

To Whom it may concern,
Your entrance for the Tom Tumb Store onto C.S.A.H. 5 has been

COUNTY HIGHWAY ENGINEER
approved with the following stipulations to be adhered to.
The entrance onto C.S.A.H, 5 is to be temporary and is to be at
the location of the future city street to be built at a later
date. When this street is built the access to the store will be
off of this purposed street. There is a 1899 x, 409 cmp culvert with
two aprons that is required for this entrance,. You will have to
post a five hundred dollar performance deposit_ which will be
refunded at the satisfactory completion and acceptance of said
project. There also is a ten dollar driveway application fee which
is due.

We hereby extend our Irrevocable Letter of Credit #1-80 in your
favor for the account of Polka Dot Dairy, Inc. for the sum not
to exceed $30,000.00, available by draft at sight, presented by
our Bank at the above address. Drafts must be accompanied by
invoices resulting from installation of concrete curbs, gutters,
asphalt paving, landscaping, sod, and black dirt as specified
in the building permits to be issued by your group in the con-
struction of a Tom Thumb Superette to be located at County
Highway 5 and Orleans Street.
All drafts drawn under this credit must be marked "Drawn under
Irrevocable Letter of Credit #1-80, dated 7/14/80, of the North-
western National Bank of Hastings". This credit is subject to
the "Uniform customs and practices for Documentary Credits (1974
Revision) International Chamber of Commerce Brochure #290."
We engage with you and any endorsers and holder of drafts drawn
and negotiated in compliance with the terms of this .tter of
