JP -PUD -79-001 CONDITIONS Charter Oak Townhouse Development July 23, 1980 CONDITIONS: 1) Charter Oak townhouse planned unit development shall be developed in accordance with the attached plans. 2) Upon agreement between the Zoning Administrator, City of Stillwater and the Joint Powers Committee, no building permit will be issued prior to the approval and issuance of this Special Use Permit. 3) Sanitary and storm sewer and water improvements shall be constructed in compliance with plan A2.1 dated July 3, 1980 and the engineer's (Richard E. Moore) review dated July 21, 1980, both of which are attached to this permit. 4) On-site drainage shall comply with the grading and site plan as in- dicated on the attached plan A4R and dated July 3, 1980. 5) Design and location of private streets shall be located as indicated on the attached plan A2 and dated July 3, 1980. 6) Parking and internal circulation shall comply with the attached site plan A4R and dated July 3, 1980. 7) All drives and parking areas shall be constructed in accordance to the specification outlined on plan A3 and the engineer's review dated July 21, 1980 and attached. 8) All turfed areas on the parcel that have been disturbed or destroyed during the construction phase of this project shall be graded with topsoil, rough seeded, mulched and fertilized or sodded in accordance with the recommendations of the Zoning Administrator. 9) Any plant materials that do not survive two (2) growing seasons must be replaced as needed and where indicated on the attached plan A4R. 10) The site shall be landscaped according to the attached plan A4R. 11) Any parking areas or structures shall be lighted according to the standards of the Joint Powers Zoning Ordinance. 12) All waste materials and refuse shall be stored inside a fenced or screened area as indicated on the attached plan A4R. 13) Design, locations and specifications of signs shall conform with the Joint Powers Zoning Ordinance and subject to approval from the Zoning Administrator. All signs shall require a sign permit to be issued by the Zoning Administrator. 14) This permit shall not be considered a building or sign permit. 15) All townhouse and detached accessory structures shall be constructed according to the pians presented to the Joint Powers Committee. 16) This project shall be developed according to the project statistics listed on the cover sheet of the attached plans dated July, 1980. 17) The curb returns on the private streets entering onto Curve Street Boulevard shall be constructed according to the attached engineering specification sheet prepared by the Minnesota Department of Transpor- tation and numbered 70351. 18) All private streets shall be maintained and kept open at all times by the developer or its agent until such time the streets may be dedicated to and accepted by the City of Stillwater. 19) All existing trees to be saved during grading and construction shall be fenced at the crown line with snow fencing. 20) All parking stalls shall be painted with four (4) inch wide stripes and repainted as necessary. 21) The garages shall be sided with the same finish material as the townhouse structures. 22) There shall be no open air drying of clothes on the site. 23) Any alterations to the attached plans shall be reviewed and approved by the Zoning Administrator and shall require an amended Planned Unit Development Permit. 24) The conditions of this permit shall apply to the land described and shall not in any way, except herein noted, be affected by any sub- sequent sale, lease or other change from the current ownership. 25) Non-compliance with the conditions and attachments of this permit shall be considered a violation of said permit and may result in revocation of said permit. 26) Construction shall begin within one (1) year after the issue date of this permit or the permit becomes void. 27) A $252,923.00 financial security shall be retained by the Zoning Administrator to insure compliance with the conditions of this permit. -2- SNORT-ELLIOTT-HENDRICKSON, INC. OUR FILE NO. 80054 In accordance with your request of April 16, 1980, we have reviewed plan sheets Nos. A-4 and A-5 and the specifications for the subject project from HSR Associates, Inc., Architects, Engineers, Planning, LaCrosse and Madison, Wisconsin. Our review was of the following specifications: 02560 Sanitary Sewer 02570 Watermain 02580 Storm Sewer 02590 Trench Excavation & Backfill for Utilities 02650 Roadway Construction We find these technical specifications to be in accordance with the current city of Stillwater standards. The two plan sheets that we were furnished do not include the plans for sanitary sewer, watermain and storm sewer, however, I did review the prints which were submitted to HSR Associates from Short -Elliott -Hendrickson. We find these draw- ings as submitted to HSR to be in accordance with the present city of Stillwater standards also. Drawing No. A-4 indicates the grading and landscaping and roadway surfacing and sidewalk areas. The finished grades, as indicated on Drawing No. A-4, do not appear to be complete in that there is an elevation of 938 shown at approximately Station 2 + 50 on the westerly most road and the same elevation of 938 shown at Station 6 on the same roadway, which is indicated as finished grades. Nothing is indicated between these two stations as to whether there is a higher point or a lower point or some means of conveying the drainage overland. The prints of SEH, Inc. indicate there are two catch basins at approximately Station 2 + 50 which would pick up the storm water and convey that underground through pipes to Curve Crest Boulevard. 200 HILLSBOROUGH OFFICE BLDG • 2353 RICE STREET • ST. PAUL, MINNESOTA 55113 • PHONE (612) 484-0272 Mr. Dan Koehler, Planner July 21, 1980 Page 2 The original street section as recommended in the soils report was 3 inches of bituminous and 10 inches of aggregate base, Class VI. The bituminous was supposed to be 1-1/2 inches of 2341 wearing course and 1-1/2 inches of 2341 binder course. SEH designed an equivalent section which was as follows: 1-1/2 inches 2341 wearing course, 2 inches 2331 base course and 9 inches aggregate base, Class V. These two sections are equivalent in structural strength. Drawing No. A-5 from HSR Associates, Inc. indicate a paving section of 3 inches of bituminous paving and 10 inches of aggregate base. The section as designed by SEN, Inc. would be a little easier to construct, but since they are equivalent sections either one may be used. In reviewing the storm sewer it was determined that the design was based on a five year return frequency of storms. The standard for the city of Stillwater has been a 10 year return period storm design. However, the storm sewer as designed would meet the requirements of a 10 year storm with the exception of the 15 inch storm sewer on the easterly most road. We would recommend that the size remain the same as originally designed but the grade be increased from 0.40 percent to 0.46 percent. The undersigned did talk to Mr. Tim Larson regarding these two plan sheets. Mr. Larson indicated that the design as set forth by SEH, Inc. originally would be indicated on the final plan sheets. The only item which was not discussed with Mr. Larson was increasing the grade on the 15 inch RCP on the easterly most roadway. One other item which was discussed with Mr. Larson which was not indicated on Drawing No. A-4 were the two radii which should be constructed where the easterly most roadway intersections the 64 foot radius, 12 foot wide turnaround. These radii were designed as being 20 foot radius by SEH, Inc. Mr. Larson indicated that these would also be shown as 20 foot radiuses on the final plan. GENERAL SECTION 02821 SEEDING Page 1 1. Scope: a. The requirements of Divisions 0 and 1 apply to this Section. b. Provide all materials, labor, services and incidentals necessary for the completion of this Section of the Work. C. Include restoration of any planted areas, lawns damaged as a Y result of completing work of this project. d. Provide spread and fine grade all top soil required to complete the work. 2. Free of any admixture of subsoil, stones, lumps, clods of hard earth, plants, roots, sticks and other extraneous materials. b. Black, fertile and native to the area for traditional grasses. C. For native grasses top soil shall be like existing sandy soil at 4 Project Site. 2. Fertilizers: a. Commercial fertilizer: complete fertilizer partially derived from organic sources and containing nitrogen, phosphoric acid, potash in varying percentage amounts be weight as specified in Part C. herein. b. Seed shall be obtained from a commercial source normally dealing in prairie grasses and forbs. b. All seed shall be guaranteed by the vendor to be true to name, origin, purity, germination and percent pure live seed per pound as required herein. C. Where state certification laws are in force, all seed will bear certification of tests acceptable to that state's control agency and shall be free of all noxious weeds. The amount of all other weed seeds shall not exceed one percent. d. Seed quality chart for grasses shall be submitted to the Architect for approval with seed test results for the various seeds as supplied by Vendors. e. Seed Inoculation: (1) All legume seeds shall be inoculated with the proper Rhizabium bacteria inoculum in the amounts and manner required by the manufacturer of the inoculant before sowing or mixing with other seeds for sowing. (2) All legume seed normally hulled and scarified shall be so treated before inoculation. (3) Seed shall be sown as soon as possible after inoculation and seed that has stood more than 24 hours after inoculation shall be reinoculated before sowing. f. Conditioning and Handling of Seed: r. (1) Certify that each type of seed has been properly stratified and received proper handling (including moisture content and tempera- ture control of those grasses and forbs which require such special attention) from time of gathering to time of planting. (2) Prior to mixing have seed available for inspection by Architect. g. Seed Mixtures: (1) Germination rates for grass seeds furnished shall meet desired minimum PLS/Sq. Ft. by the end of the first growing season as determined by the Architect. Contractor shall furnish enough seed of each type to meet these specifications. Traditional Grass Seed a. Fresh stock, labeled in accord with U.S. D.A. Rules and Regulations under Federal Seed Act. b. Deliver in sealed, original containers which show analysis. C. 95% pure live seed by weight. d. Weed seed shall not exceed 0.5% by weight. e. Minimum 85% germinating. f. Mixture: Kentucky Blue Grass 50% by weight (min.) Chewings Fescue 20% by weight -Red Fescue 20% by weight American Rye 10% by weight (max.) g. Conform to the requirements of applicable State laws regarding noxious seed. C. EXECUTION 1. General: a. Seed entire area within project limits shown on Project Drawings to be seeded. b. Restore areas outside project limits disturbed by work of the project to original conditions. C, Perform work as rapidly as portions of the site become available, consistent with seasonal limitations. d. Any conditions existing at the time work of this Section commences which will adversely affect the proper execution of work -shall be immediately brought to the attention of the Architect. e. Start of work implies acceptance of preceding work as satisfactory to execution of this Section of the Work. 2. To ski : a. Provide all -topsoil meeting specified requirements as necessary to complete the Work. b. Do not place topsoil while in frozen or muddy condition. C. Scarify subsoil, which has become densely packed during construction, to a full depth of 2 inches prior to placement of topsoil required. d. Place topsoil and spread uniformly over all -lawn areas to a depth sufficient to provide a total thickness of 6 inches topsoil in seeded areas. lightly roll. e. After placement provide fertility test for "in-place" topsoil. f. Remove all debris and scarify to depth of ,5 inches. g. Rake until surface is friable, smooth and of uniformly fine texture immediately prior to seeding. h. Correct all soft spots and irregularties in grade. i. Spread and rake 10-10-10 commercial fertilizer into topsoil at rate of 15 lbs. per 1,000 square feet. 3. Native Grass Seedinq a. Seeding Equipment: (1) Ground preparation shall be done with conventional equipment satisfactory to the Architect. ,. (2) Seed shall be broadcast or hydro -seeded. (3) Seed shall be sown to an average depth of 1/4 inch. SECTION 02821 SEEDING Page 6 (4) Broadcast seeding shall be raked and compacted with a "culti- packer" or other roller to insure contact between soil and seed. Hydro -seeding shall use a separate application of a wood - fiber mulch to insure seed coverage of organic matter. b. Preparation of Seeded Area: (1) Outer perimeter of area to be seeded (all seed mixes) shall be staked by Contractor and approved by Owner's representative prior to starting any work. (2) As soon as practical after award of contract, plow areas to be seeded. (3) Seed bed shall lay fallow until early spring. (4) Lightly disc (3" - 4" deep) area to be seeded at least twice before seeding to control seeds. (5) Immediately prior to seeding the area shall be lightly harrowed and the ground surface shall be worked smooth, level, friable and of uniformly fine tedture. (6) No maintenance of native grasses required after germination has been established. 4. Traditional Grass Seeding: a. Do not seed in muddy soil. b. Do not seed when prevailing wind exceeds 5 miles per hour or strong enough to separate light and heavy seed. C. Sow seed uniformly at a rate of 6 lbs. per 1000 square feet using mechanical seeder. d. Rake seed lightly into soil to a depth of no more than 1/4 inch. e. Roll sown area with roller weighing approximately 100 pounds per lineal foot, f. Water thoroughly, after rolling, with fine mist until soil is soaked 3 to a depth of 3 inches. g. Maintain soil in moist condition until seeds have sprouted and reach a height of 1 inch. h. Water thereafter until soil is soaked at least weekly unless natural rainfall has provided equivalent watering. i. After seeding is completed, cover with layer of clean straw. j. Protect seeded areas against tresspass or damage. k. Maintain seeded areas for a minimum of 30 days after seed has caught and shown uniform stand or until substantial completion of all work on project, whichever is longer. 1. Repair all damage resulting from erosion or other causes by filling with topsoil, tamping, reseeding -prior to acceptance of work. M. Do all necessary mowing, weeding required during maintenance period. n. Contractor may, at his option, sod all areas indicated to be seeded. 5. Traditional Grass Maintenance: :.- a. Commence immediately after each portion df lawn, planting is com- vleted. b. Water, mow and reulant lawns to establish uniform turf until acceptance. C. Maintain lawns until completion of project or a mitnimum of 30 days after completion of all work, whichever is latest, r 7. SECTION 02821 SEEDING Page 7 d. Scattered I •e spots in lawn no larger than one square foot each will be acceptable up to 3 percent of lawn area. e. Maintain new planting until all planting is completed, inspection made and planting is accepted, but in no case less than 30 days. f. Include watering, weeding, cultivating, mulching, tightening and repairing of guys, removal of dead material and resetting plants to. proper grade for all plants, trees. g. Protect completed lawn areas during operations. Repair any damage resulting from planting operations. Inspection: a. Notify Architect at completion of planting operations and 10 days :prior to end of 30 day minimum maintenance period. b. Inspection will be held and contractor notified of acceptance, exclusive of replacements required ~during guarantee period, subject to completion of any deficiencies noted. Guarantee and Replacement: Contractor shall guarantee the quality of workmanship of the seeded areas. He shall be responsible for reseeding or overseeding in accordance with paragraph g.(1) as may be required to establish a uniformed grassed area satisfactory to the Owner's representative.
