Fourth St. Request for a two and one-half foot variance for a fence in front yard. George Parker, 320 S. Fourth St. Request to increase number of units to four. (previous request was for 2, approved on 4-24-79) 3. Case No. 459 David and Shirley Smith, 14359 St. Special Use Permit Croix Tr. N., Marine on St. Croix. Request for home occupation as an office for the Forrest A. Nutting, Co.; three employees; two cars, both of which would be parked inside a garage; no signs; no customer contact on the premises, all of which would be at 502 Quarry_. 4. Case No. 460 G. Dean Miller, 622 N. Third St. Variance Request for one foot sideyard variance on the north side of the property for a screen house addition. June 28, 1982 The Chairman, Tom Farrell, called the meeting to order at 7:00 p.m. Motion by Barbara Avise, seconded by Russell Meister that the minutes from the meeting of April 26, 1982 be approved with the addition of Charles Swanson added to members absent. Motion carried unanimously. Motion by Russell Meister, seconded by Barbara Avise to approve the minutes from the meeting of May 24, 1982. Motion carried unanimously. CASE NO 457 Variance Charles Bischoff, 1207 S. Fourth St. for a 22 foot variance for a fence in front yard. Charles Bischoff explained where the fence will be built. The variance is for the heighth of the fence, not the location. Tom Farrell questioned Mr. Bischoff what type of fence will be built. Mr. Bischoff stated it will be a privacy fence, alternate vertical slats. Motion: By Charles Swanson to recommend approval of 22 foot variance for fence in front yard. Seconded by Russell Meister. Unanimously carried. CASE NO 458 George Parker, 320 S. Fourth St., to increase Amend Special Use Permit use from 2 units to 4 units. Mr. Parker presented schematic designs for his proposed plan. Mr. Farrell questioned proposed parking for the rental house. Mr. Parker stated there are a number of ways off-street parking can be provided. There was considera- ble discussion regarding Fourth Street as an access road -- who will put it in, who will maintain it, and what about Kilty's property being accessible if he would build in the future? Motion: By Charles Swanson to recommend approval for 2 additional units provided adequate and feasible off-street parking via 4th Street (4 garages & 4 off-street spots) be provided prior to permit being issued and hook-up CASE N0. 459 Special Use Permit 4 units to city sewer prior to permit being issued. Seconded by Dean Miller Motion carried unanimously. David & Shirley Smith for home occupation @ 502 Quarry, as an office for the Forrest A. Nutting, Co., 3 employees, 2 cars, no signs, no customer contact on premises. Mr. Paul Wolf, representing Dave Smith, gave an overview of the Smith's intentions. He stated the Smith's currently live north of town and when their family is grown (1 in Sr. High & one in college) it is their intention to live at this address. He stated there would be no visible changes on the exterior of the building and the interior will only have the living room changed to provide extra space to the already existing office in the home. Neighbors, Ray and Ann Sayers, stated their concerns. They included the following: 1) They would not have built a new home there had they known it was a business 2) Re -sale value of their home 3) Having a family next door (children, etc.) as opposed to a business. Another neighbor, Carolyn Fredell, 408 Quarry Lane, stated she was concerned regarding the permit being transferrable. CASE N0. 460 _ Variance Motion: By Russell Meister to recommend special use permit with provisions that Mr. Smith have no more than 3 employees, the office hours be Monday through Friday, 8 a.m. - 5 p.m., that the permit be non-transferrable, and contingent on a review after 1 years time. Seconded by Dean Miller. 5 Ayes 1 Nay - C. Jay Sleiter G. Dean Miller, 622 N -Third Street, for a one -foot sideyard variance on the south side of the property for a screen house. Mr. Miller presented his plans to the Commission. He distributed copies of letter from neighbors stating they have no objection. Mot ion: By Charles Swanson to recommend one foot sideyard variance on south side of property Seconded by Russell Meister Motion carried unanimously. Mr. Farrell reminded members that at next month's meeting which will be July 26, 1982 at 7:00 p.m. part of our agenda will include guests from the historical society and R.T.R. regarding setting up the Historical Preservation Commission. On motion by Barbara Avise, seconded by Russell Meister, the meeting was adjourned at 8:55 p.m.
