Case No. 466 Charles Neuenfeldt, 500 S. 4th Special Use Permit St., for special use permit for one residential unit in church basement in addition to the 3 granted on the main level. 2. Case No. 469 Rezoning & Concept Approval of PUD 3. Future Armory Site Paul D. Emerson, 11694 N. 20th St., Lake Elmo for rezoning of the property described in Exhibit B (Parcel A) to CA, and concept approval for PUD for peoperty described on Exhibit A; park dedication in connection with PUD for property described in Exhibit C. STILLWATER PLANNING COMMISSION PRESENT: Thomas -Farrell Josephine Vania Barbara Avis - Dean Miller C. Jay Sleiter Allen Zepper Ronald Newman Russell Meister ABSENT: Alfred Roepke TIME: 7:00 P.M. DATE: December 26, 1982 The chairman, Thomas Farrell, called the meeting to order at 7:10 p.m. Motion by Josephine Vania, seconded by Russell Meister that the minutes from the meeting of November 22, 1982 be approved as written. CASE NO. 466 Special Use Permit Charles Neuenfeldt, 2159 Oakgreen Avenue, for special use permit for one residential unit in basement of church. at 500 S. 4th St. in addition to the 3 granted on the main level. Mr. Heuenfeldt explained his proposed plan. He stated he would like to request that this unit have on -street parking along Fourth Street. The unit would utilize unused space in the basement and will be only a one - bedroom unit with a walk -out. Square footage of the new unit would be 1,090. He stated the unit would be sold with the understanding that the buyer was aware he would not have off-street parking. Ronald Newman questioned if Mr. Neuenfeldt was aware of any ground water problem. Mr. Neuenfeldt replied he was not aware of any, though several neighbors have told him there was. A neighbor, Bob Say, 506 S. Fourth St., was present and stated his oppo- sition to another unit mainly because of the parking and traffice problem. Tom Farrell also read a letter from neighbors, Glen and Patricia Medbery, 215 W. Pine, who were unable to attend tonight's meeting expressing their opposition to Mr. Neuenfeldt's request. They stated this would definitely contribute to the parking and traffic problem. Motion by Dean Miller, seconded by Russell Meister to deny request for special use permit. Motion carried unanimously. CASE 'No. 469 Rezoning & Concept Paul D. Emerson, 11694 N. 20th St., Lake Approval of PUD Elmo, for rezoning of Parcel A to CA (as described on application), concept approval for PUD for property described on Exhibit A (attached to application), park dedication in connection with PUD for property described in Exhibit C (attached to application) Bob Briggs, Attorney, explained a map of the request. The area East of Co. Rd. 5 would be for 283 units. The park bordering Croixwood would be dedicated to the city. The other area would be zoned for a controlled commercial business such as a drive-in bank or professional office build- ing. Bruce Folz then explained the request in detail. He states there is adequate surface -water drainage. The proposal he has is not for the townhouses he had pictures of. The request is simply for marketing the land. A developer would then have to come back to the Commission for approval of a plan. A neighbor, Tom Schwintek, 2327 Hidden Valley, questioned the liability of such a contract. Mr. Briggs stated the city attorney would handle the contract. He was also concerned about the density. Mr. Foltz stated there would be an average of 8 units per acre. Jeris Pike, 811 Pine Tree Trail expressed her concern that the drainage is not adequate. She was informed by Mr. Foltz that her concern should be addressed to the city because the city has told him the drainage is adequate. Tom Schwintek also stated that most neighbors were not in- formed of this meeting and had they been notified, more would be here. He was told that the City Council will hear this request on January 18th and if neighbors do not receive ample notice, to inform the city. Motion by C. Jay Sleiter, seconded by Dean Miller to approve the request as follows: Parcel A - limited CA to controlled office Parcel B open space to park land Parcel C - PUD, maximum of 283 units. Motion carried unanimously. ARMORY SITE Tom Farrell explained Nile Kriesel"'s memo to members. A new site must be purchased sometime between now and 1990 and the sooner property is acquired the more reasonable it could be purchased. The city now basically only owns parks, drainways and gulleys. Members were asked to consider possibilities for a future site. The Federal Govt. would construct and maintain the building. On motion by Russell Meister, seconded by Josephine Vania, the meeting adjourned at 9:05 p.m. Respectfully Subpitted, G n Monty
