STILLWATER PLANNING COMMISSION MONDAY, FEBRUARY 28, 1983 Case No. 475 Donald Nolde Special Use Permit To construct a two-story office building at 275 South Third St. Case No. 474 Golden Mirror Beauty Shop Variance Install sign at 220 E. Chestnut Street. Case No. 478 Richard Iverson, Jr. Variance To build an oversized garage at 905 South Third Street. STILLWATER PLANNING COMMISSION PRESENT: Tom Farrell Josephine Vania Barbara Avise Russell Meister Dean Miller Al Zepper Ronald Newman Dean Marlette Douglas Seitz ABSENT: Alfred Roepke TIME: 7:00 P.M. DATE: February 28, 1983 The chairman, Tom Farrell, called the meeting to order at 7:03 p.m. Minutes from the last meeting were not made available and will be reviewed at the next meeting. Mr. Farrell stated that the sequence of the agenda would be changed for the evening. CASE. NO. 466 Charles Neuenfeldt, 500 S. Fourth St. Special Use Permit for a special use permit for one resi- dential unit in church basement in addition to the three units previously granted on the main level. Mr. Neuenfeldt showed members plans for the additional unit along with proposed parking. A neighbor, Glen Medberry, 215 W. Pine, stated his objection to another unit. There is already a traffic problem on the corner because of activities at the Jr. High and he. also has concerns regarding space for residents children to play. Another neighbor, Bob Safe, who lives on Fourth St., stated he has concerns regarding snow removal in the winter. He also is concerned where garbage would be put. He states the three units look great inside, but feels any more than that would create problems. On motion of Russell Meister, seconded by Dean Marlette, the request for special use permit was unanimously denied on the basis of traffic conditions and enough variances have already been allowed in the interest of citizens. CASE NO. 473 Thomas and Karen Loome, 320 N. Fourth Special Use Permit St., for a special use permit to sell second-hand religious books from old church located at 320 N. Fourth St. on Saturdays only from 10 a.m. to 10 p.m. CASE N0. 473 Continued Mr. Loome explained that this is almost exclusively a mail order business and they have approximately 35 customers in the State of Minnesota. He stated in 1973 the church was used for selling second- hand books. He anticipates only one or two customers each week and does not anticipate a parking problem. This is not his primary employment, as he works at College of St. Catherine. He states he has already brought several books in. Al Zepper questioned whether or not the church would hold them, as they are stored in the balcony. Al will check the building before the Council meeting.. The members also questioned whether or not he would be putting up a sign. He states there is a spot on the building for one and it will be no more than 4 square feet. The members questioned why he would like his hours to be until 10 p.m. Mr. Loome stated that if someone from the cities drove over for dinner, they would still have time to browse before driving back. Motion by Dean Miller to approve Mr. Loome's request contingent upon approval from the Building Inspector. Motion seconded by Barbara Avise. Unanimously carried. CASE N0. 474 Golden Mirror Beauty Shop to Variance install a sign at 220 E. Chestnut St. They are requesting a sign 22x25 and will not extend out more than 26". Josephine Vania questioned what material it would be made of. It will be of wood. Plans for the sign were shown. Members discussed the ordinance of signs. Josephine Vania stated how signs can add charm to a city if size, material and lighting can be controlled. Motion by Josephine Vania, seconded by Russell Meister to approve request for variance. Request denied - 3 yes, 4 no (no votes, Seitz, Avise, Newman and Marlette) CASE N0. 472 Patrick Mulvehill, 301 W. Myrtle Conditional Use Permit St. for a conditional use permit to practice psychotherapy out of a home located at 301 W. Myrtle St. Mr. Mulvehill stated this will be strictly a private practice and there will be two people at a time by appointment only. He currently has about one client per day and hopes to build his business to 4-5 per day. There will be no group meetings. He states there will be no problem with parking as he has room for his own car plus two in his driveway. He indicated that he will have a sign according to code. His hours will be from about 9 a.m. to 4:30 p.m. Motion by Barbara Avise, seconded by Russell Meister to approve request for conditional use permit. Unanimously carried. CASE NO. 478 Richard Iverson, Jr. for variance Variance to build an oversized garage at 905 S. Third St. Mr. Iverson showed the Commission plans for the garage. He states he does work on older cars (street -rods) he owns and cars for close relatives only. The chairman received a letter signed by 33 people objecting to such a garage because 1) an oversized garage would encourage further activity to which they are opposed and 2) the property is already cluttered. Another neighbor was present at the meeting and stated his objection to the request because of the already existing cars and clutter at the residence. Pictures of the property were presented to the Commission. Another man representing the Labor Temple was present and stated his objection for the same reasons. The Commission informed Mr. Iverson that a pole barn would not be allowed as there is an ordinance, but they would vote on a request for an oversized garage. Mr. Iverson withdrew his request and stated h_e will probably remodel the existing garage. Jean Nelson, 31 Maryknoll Dr. stated she has concerns with traffic problems already existing on Maryknoll because of hills, curves, etc. Another neighbor at 159 Maryknoll Dr. stated the proposed culdesac arrangement is preferred to eliminate some traffic problems. Dave Nelson, 31 Maryknoll Dr.. expressed his concerns of the possibility of overloading traffic on Maryknoll. Maureen Farrell, 205 Crestwood, stated her concern of a number of units that have already been approved in Stillwater and questions whether or not the city is ready to absorb the added population (schools, etc.) Calvin and Joanne Sprain, 109 Maryknoll, sent a letter which the chairman read to members. It stated their wishes and concerns that the buffer zone remain between the development and Maryknoll. Brian Simonet, 79 Maryknoll stated that if this land is to be developed, the plan pre- sented is the best so far. Most neighbors agreed that these gentlemen should be commended for the time and efforts spent with them in the proposed plan. Motion by Dean Miller, seconded by Josephine Vania, that;the planned unit development be approved. Motion unanimously carried. CASE NO. 475 Donald Nolde for special use Special Use Permit permit to construct a two-story office building at 275 S. Third Street. Mr. Nolde did not show up for the meeting.
