IN THE COUNCIL CHAMBERS OF CITY HALL, 216 N. 4th Street. AGENDA: 1. Approval of minutes of July 23, 1984 meeting. 2. Barry Stack - Benson Addition (Annexation) 3. David Johnson - Oak Glen plat update - Oak Glen 4th Addition 4. Case No. 546A - Norton Tucker - Minor subdivision of 1301 West Orleans Street 5. Case NO. 553 - George Speers - Variance for 1229 Third Ave. S. Request for 4'6" sideyard variance for expansion of current single car garage into 2 -car garage. 6. Case No. 554 - Anna Ready - 916 S. 6th - Special Use to start freelance editing business in home. 7. Case No. 555 - lst Church of Christ Scientist - Special Use to construct a church in a residential zone at the NW corner of South Everett and Churchill Streets. 8. Case No. 556 - John Ogren - Sign variance for Superamerica on Main and Myrtle Streets 9. Case No. 557 - Kermit Mohn - 501 N. Greeley - Variance for 8' front yard setback. 10. Case Ho. 558 - Trinity Lutheran Church - 118 N. 3rd Street Variance to replace existing chain link fence with brick & wood fence (on City right-of-way) STILLWATER PLANNING COMMISSION MEMBERS PRESENT: Thomas Farrell Josephine Vania Allen Zepper Colleen Mlecoch Dean Miller Douglas Seitz Dean Marlette Rob Hamlin DATE: August 27, 1984 TIME: 7:00 p.m. The meeting was called to order at 7:01 p.m. by chairman, Josephine Vania. Josephine Vania suggested the first item of business be the electing of a new Vice Chairman. Ron Newman held the position previously and has now resigned from the Commission. Motion by Thomas Farrell, seconded by Douglas Seitz, to nominate Dean Marlette as Vice Chairman of this Commission. Motion carried unanimously. Motion by Dean Marlette, seconded by Colleen Mlecoch to approve the minutes from the meeting of July 23, 1984. Unanimously carried. BARRY STACK Benson Addition Annexation Mr. Stack was present and is a land surveyor representing Mr. Benson. He stated in surveying the property there are several gaps and overlaps. There would be an addition of 5 or maybe 6 lots annexed to the city. Sewer and water are already in. There was some concern about leaving pieces of property in the township. It was felt this may create a problem at a later date if other parts of the property were asked to be annexed. Motion by Thomas Farrell, seconded by Dean Miller to approve preliminary plat approvaland that the Joint Planning Commission be informed and hear the case. Thomas Farrell will put the case or the Joint Planning Commission agenda for next month and be in contact with Mr. Stack. Motion unanimously carried. OAK GLEN PLAT UPDATE Dave Newpay and Bruce Bergan presented the plan for final plat approval. There was some question as to easements and radius of culdesacs. The Commission was informed that no changes have been made since the preliminary plat approval. Motion by Dean Miller, seconded by Colleen Mlecoch for final plat approval as presented. Motion carried unanimously. _,CASE NO. 546A Minor Subdivison Norton Tucker, 1301 W. Orleans for minor subdivision to split 1.3 acre lot into 3 buildable lots (one with existing house) and also zoning to R-2 for the two new lots if approved The existing house and lot are zoned R-2 but if subdivided the two new lots would be the same as the rest of the area which is R-1. A neighbor, Wayne Norman, stated that the plan is definitely not in perspective: Mr. Tucker has not had the property surveyed yet but will have if the plan is approved. Motion by Rob Hamlin, seconded by Dean Marlette to approve concept approval subject to a survey. Unanimously carried. Motion by Colleen Mlecoch, seconded by Dean Marlette to rezone the two new lots to. R-2. Motion carried (1 opposed, Rob Hamlin) CASE NO. 553 George Speers, 1229 Third Ave. S. Variance for 416" sideyard variance for ex- pansion of single car garage into two -car garage. Mr. Speers states their family is currently in the process of purchasing the property and the sale is contingent on this request. He stated he has contacted several_ neighbors and none have objected. He states the roof line will be 6" from the line. Six neighbors affected have signed a statement of their approval. Motion by Dean Marlette, seconded by Douglas Seitz to deny the request for the variance based on the feeling that there is no hardship pre- sented. Motion carried (1 opposed - Dean Miller). Mrs. Speers expressed her disappointment with the decision because they had very much wanted to live in this community. CASE NO. 554 Special Use Anpa Delores Ready, 916 S. Sixth St. for special use to start freelance editing business in home. Ms. Ready stated there would be no deliveries or people at her home. She would simply be working out of her home. There would be no signs. She states she has been doing the same from her home but for a company for some time and she simply wants to start her own businers. Motion by Rob Hamlin, seconded by Dean Miller to approve request for special use. Motion carried unanimously. CASE NO. 555 First Church of Christ Scientist for Special Use special use to construct a church in a residential zone at the NW corner of Everett and Churchill. Earl Dornfeld, a member of the congregation and building committee chairman presented proposed plans. CASE NO. 555 Continued Mr. Dornfeld stated the building would be built mainly on parcel 3 and may use part of parcel 2. They have not hired an architect or contractor yet but plans would be for about a 28x72 building. There would be adequate off street parking and the building is only used on Sunday mornings and Wednesday evenings. They do not have dinners, fund-raisers, etc. A neighbor, Myron Scullen 904 W. Churchill, expressed his objections to the church because of traffic and parking. He states there is already a problem because of the hospital, clinic, beach, park, welfare office, etc. He presented the Commission with a petition objecting the church signed by about 60 people. Merle Stone, another neighbor stated his objections because of snow removal, traffic, and his desire to leave the area for residential use. The current owner of the property, Jim Aysta, expressed his feelings that this would be a good use for the property. The lots could be used for three duplexes, and the church would create less traffic and problem than somethirgsuch as that. Mr. Dornfeld stated there would be a small steeple but no chimes, etc. Mr. Farrell expressed his feelings that this church would be no different than having a house on the property simply because it is such a small congregation. Another neighbor whose property would abut parcel 2 expressed,her concern of what might happen in the future because of the church's declining membership. Might another church purchase the property and then try to expand? Motion by Dean Miller, seconded by Colleen Mlecoch to approve the request for special use. Motion carried (1 opposed, Rob Hamlin) CASE No. 556 Variance John Ogren for sign variance for Superamerica on Main and Myrtle Sts. Allen Zepper suggested that the Commission not hear this request for sign variance because other variances requested have not yet been complied with. Mot6ion by Dean Marlette, seconded by Colleen Mlecoch that request for variance be tabled until previous variances are complied with. Carried unanimously. CASE NO. 557 " Kermit Mohn, 501 N. Greeley, for Variance 8' front yard setback variance to build a storage shed. CASE. N0. 557 Continued Mr. Mohn stated he would remove the existing metal shed and replace with a new 13x18 shed. The street is a dead-end and no neighbors are near. Motion by Rob Hamlin, seconded by Dean Miller, to approve request for variance. Unanimously carried. CASE N0. 558 Trinity Lutheran Church, 118 N. Third Variance St. for variance to replace existing chain link fence with brick and wood fence. (on City right-of-way) Linda Mitchie from Be Architects representing Trinity Church explained the proposed fence. She states the fence simply will replace the existing chain-link one and is mainly there for safety purposes. She stated that Trinity is aware that if the fence needs to be removed that they are responsible for it. She was informed that the fence needs to meet the code of 12" maximum opening. Motion by Dean Marlette, seconded by Dean Miller, to approve request for variance with the stipulation that codes be met. Motion carried unanimously.
