NOTICE OF PLANNING COMMISSION MEETING
THE STILLWATER PLANNING COMMISSION WILL HOLD A MEETING ON MONDAY,
JULY 22, 1985 AT 7:00 P.M. IN THE COUNCIL CHAMBERS OF CITY HALL,
216 North Fourth Street.
AGENDA
1. Approval of Minutes - June 24, 1985 and July 8, 1985.
2. Case No. 599 - Doyle Hubbell, 714 West Maple Street - request
for Variance to change one family home to duplex.
3. Any other business the Planning Commission may wish to
consider.

Memo to: Mayor and City Council

As I mentioned at the last Council Meeting, I will not attend the meeting on July
16th. Following are my concerns and opinions on the Public Hearings:
CASE NO. 593 John A. Fox, 437 South Second St. - Request Special Use Permit for a
Bed and Breakfast facility. (See attached list of comments from Mr. Fox.)
I have a concern over a couple of items Mr. Fox mentioned. He said Stillwater needs
"transient" housing. He also made the statement that the living room was so large,
and he would have audio/visual equipment avqilable. This indicates to me that an
Amway or Shaklee (or whatever) person could rent a room and use the larger room for
their meeting. I think this could be a definite parking and traffic problem.
Mr. Fox was also told that if he went over five sleeping rooms, he would have
to come in for a hotel permit and very extensive remodeling would have to be done to
meet Fire, Life Safety and Building Codes. It was told to him very explicitly so
there was no doubt of his understanding it. If you get over five sleeping rooms, the
Codes classify it as a hotel. I would also recommend the Fire Department make yearly
inspections on all of the Bread and Breakfast establishments to insure continued
compliance.
Some of the hotel requirements are:
1. Escape window in each room.
2. Each sex toilet for each ten (10) people or part of ten.
3. One handicapped accessable unit.
4. Sound ratings.
5. Kitchen help facilities (ie restroom)
6. Two exits off third floor.
7. Rated corridors.
8. One hour separation from basement.
9. One hour resistive thru out.
These are the major items, but not all of the requirements.

CASE N0. 594 Mike Collins, 309 W. St. Croix Avenue - Request for 10 ft. front
yard setback.variance for construction of a shed.
No problems either way. Lady to the West was concerned that her vision from
her window would be impaired. She has lived there forty some years.
CASE NO. 595 Grant D. Ranum, 522 W. Hickory St. - Request reduction of required
building separation variance (7 ft.).
No problems either way, except if the garage was slid eight more feet to the
West there would be a useless junk collecting corner behind the garage. Mr. Ranum
knows he will have to firewall the garage if approval is given.
CASE NO. 596 Lawrence Rose, 1321 South Fifth Street - Request Special Use Permit
for construction of a commercial building.
My concern is for the safety for workers and/or customers in this building which
will have a plastic covering. Plastic is flamable and gives off toxic fumes. We
should be sure this building is not open to the public if approved.
CASE NO. 597 George and Louise Speers, 1229 Third Avenue South - Five ft. sideyard
setback variance to construct a three season porch.
No problems either way. They have an enormous rear yard and John Ogren is the
only one really effected. He has no objections to the project.

Vice Chairman, Jerry Fontaine, chaired the meeting for Dean Miller.
Jerry called the meeting to order at 7:23 p.m.
Motion by Jay Kimble, seconded by Jean Jacobson to approve the minutes
from the meeting of July 8, 1985. Carried unanimously.
Jerry Fontaine reviewed Council action on last month's cases.
CASE NO. 599
Variance
Doyle Hubbell, 714 W. Maple, for
variance to change one family home to
duplex.
Mr. Hubbell explained that he has made an offer to purchase the house
contingent on this variance. He stated he has had previous experience
in property management. There is room for off-street parking. The
house was previously used as a duplex (until 1979) and no remodeling is
necessary. The present owners only re?oved the appliances. Mr. Hubbell
presented a list of neighbors who are in favor of the proposed plan.
A neighbor living at 715 Hickory expressed her concern of the lot being
too small and that the house has only been on the market for a short
time and there would be a possibility of a single family buying it. She
is concerned about the growing number of duplexes in the area.
Motion by Nancy Putz, seconded by Jean Jacobson to approve 161-,' front
yard variance and a 1438 sq. foot yard variance. Motion carried.
(4 yes, 1 abstained, Seitz).
There was some discussion regarding bed and breakfast facilities. John
Fox was present and explained some of his feelings on several things that
were denied in his request for a bed and breakfast facility. He stated
that there is to be no liquor and that he is not able to control his guests
if they bring in liquor. He would very much like consideration of new
definitions of codes. Mr. Zepper stated that the building inspectors are
working on bed and breakfast facility codes and regulations.
Motion by Allen Zepper, seconded by Jean Jacobson to adjourn at 8:15 p.m.
Carried unanimously.
