PUBLIC HEARINGS:
1. Case No. 649 - Final Plat Approval for a 48 lot subdivision, Oak Glen Fifth
Addition, located at the corner of Neal Avenue and McKusick Road in the R -A
One -Family Residential District, David Johnson, Applicant.
2. Case No. 650 - Variance request for construction of two single family
residential units on 100 ft. x 150 ft.- 15,000 sq. ft, lot with variances
to the side and front yard setback requirements, located on the Northwest
corner of Hazel Street and North Second Street in the R -A One -Family
Residential District, Gary Swager, Applicant.
3. Case No. 651 - Request to rezone a parcel on the Southwest corner of
Greeley Street and Curvecrest Blvd., 1750 South Greeley Street, from
Industrial Park Industrial IP -I to Industrial Park Commercial IP -C, Jack
Welch and John Ogren, Applicants.

314 E. Marsh Street in the Residential Two Family, RB District, James
Granger, Applicant.

(960 sq. ft.) located at 806 South Second Street in the Residential

APPROVAL OF MINUTES
Motion to approve the minutes of May 19, 1986, as corrected
by Don Valsvik, seconded by Gerald Fontaine. (.lase 634 motion to approve
corrected to Don Valsvik, and Case 647 seconded by Gerald Forsta. i ne.
Unanimously approved.
REVIEW OF COUNCIL ACTION
Gerald F izint al ne presented a review of council action on cases
of June 3, 1986. Discussion followed.
CASE 645
Final Plat Approval for a 46 lot Subdivision, Oak Glen Fifth
Addition, located at the corner of Neal Avenue and McKusick Road in the
R -A One -Family Residential District, David Johnson, Applicant.
Druce Folz, representing applicant, presented information or, the
final plat approval request, stating that the responsibility for the
ponding area drainage belonged to the city. In response t� i questions ins on
the engineering and the ponding level, Mr. Folz stated that the water
level was due to the unusual rain during the past five years and this
was not the issue at the present time. Mr. Folz stated that he expected
the city to honor their commitment and take care of the pumping in order
to maintain buildable lost=. Discussion followed without audience
comment.
Motion to approve by Gerald Fontaine, seconded by Doan Valsvik.
Unanimously approved.
CASE 650
Variance request for construction of two single-family
residential units on 100 by 150 ft. (15000 sq. ft. lot) with variances to
the lot area, side and front yard setback requirements, located on the
NW corner of Hazel Street and North Second Street in the R -A One -Family
Residential District, Gary Swager, Applicant.
Mr. Swager presented information to commissioners, requesting
consideration of the request. He stated that a previous structure has
been demolished and the garage remains, and the set -back variance is
needed dLte to the location of the old septic line.
Dean Miller questioned the location of the gar -age. While several
members agreed with Rob Hamlin in regards to the small lot size and the
need for septic. The resident who lives behind the site expressed
concern for how sewage would be treated and impact his lot.
Motion to deny by Rob Hamlin, seconded by Nancy Put z. Unanimt pus.
Motion denied.
CASE 634
Special Use Permit for construction of an oversized garage (960
sq. ft.) located at 806 South Second Street in the Residential Two -Family
District, Daniel and Linda Harder, Applicants.
Mr. Harder presented drawings on the proposed structure and
requested to build the garage due to the poor condition of the present
st ruct i_tre and need to store numerous vehicles.
Adjacent property owner, first 3 lots on 3rd street,
questioned the location of the garage and commissioners presented
numerous questions regarding the need for an oversized garage. In support
of the request, Mr. Harder stated that the building was designed to
appear as a two -car garage from the street and presented pictures of
surrounding area, which showed vehicles parked on owners property.
Discussion followed with various issues presented, such as the
possibility of a future owner turning the garage into a business=, the
size of the lot, size requirements, and the property boundaries.
Due to discrepency in lot discription, Dori Valsvik suggested a
survey to determine the lot lines before proceeding further.
Motion to deny by Rob Hamlin was not seconded.
Following discussion, Gerald Fontaine made a motion t• � continue
the application until a survey could be done to determine the exact
property lines and set -backs, and the owners could consider other
opt ions. Don Valsvik, second. Unanimous.
CASE 651
Zoning change from In&.tstrial Park Industrial, IP -I to
industrial Park Commercial 1P -C, of a parcel on the Southwest corner of
Greeley Street and Curvecrest Blvd., 1750 South Greeley Street.
Applicants, Jack Welch and John Ogren, addressed commissioners or, a
proposal to rezone an existing 1.28 acre parcel to permit retail use on
the site containing a service station.
Mr. Welch proposed the entire intersection be rezoned due t t h e
high volume of traffic, and assured commissioners that the far superior
brick buildings w.uld esthetically improve the area. The applicant
intends to sell convenience goods and gas.
Mr. John McKinsey, UFF•E representative, requested information :in
possible traffic problems, encroachment on business across thle street,
and whether the commercial zoning would place restrictions on the
exhisting zoning of the indi_tstrial area. Mr. McKinsey was ass, -tied on all
accounts. IP -C regUlat ions were similar- to the existing IP -•I zoning.
The area was expanded to include t wog parcels across the street on
Curvecrest, by the commission. Approved Unanimously.
CASE 654
Preliriiinary Plat request to subdivide an existing 1.2 acre lost
into two lets of .87 acres and .41 acres located or, the Southwest corner
of South Greeley Street and Curvecrest Blvd., 1750 South Greeley Street.
Application Withdrawn.
CASE 652
Special Use Permit for construction oof a Service Station with
retail sales on the Southwest corner of Curvecrest Blvd and Greeley
Streets, 1750 South Greeley Street. Applicants Jack Welch and John Ogren
requested approval to i construct a 3,463 sq. ft. service station and
convenience store combination on the corner.
This approval, following rezoning to IP -C, Would allow retail
sales and meets the IP -C requirements with exception of lariscaped setback
and requires additional street trees than the original proposal. Mr.
Welch saw no problems with the recammerided conditions, adding that the
setback may be larger than expected (up toi 131). Mr. Welch agreed tiz.

Dean Miller read staff recommendations ions on conditions for
approval to applicants, whereby Mr. Welch agreed.
Conditions of Approval are as follows:
1. One additional parking space shall be provided.
2. The parking setback for the 11 stalls fronting on Curvecrest
shall be setback 5 ft. rather than 3 ft. from the property

3. The applicant shall sod and maintain the street frontage
areas between the applicants parcel and the street, as
approved by the Parks and Public Works Direct�-rs.
4. This application shall not be approved until the rezo ring .-if
the property from IP -I to IP -C is in effect.
5. Additional street trees and landscaping shall be provided as
approved by the Community Development Director.
b. Signage for the site shall be as submitted only with no
other signage without required permits.
Discussion followed on the entrances and exits into the aarea and
Mr. Ogren informed members that the traffic engineers designed the corner
with four ci_irvecuts, at the time Curvecrest was originally coDristructed.
Mr. Welch added the need for all the cuts and explained the configuration
and the traffic flow in and out of the site. Further discussion followed
regarding the area surrounding the site and possible changes. Mr. Welch
stated that this is the only configuration possible.
Motion to approve provided the six card i t i o ons were met by
Don Valsvik seconded by Nancy Putt, unanimously approved.
CASE 65.3
Prelirriinary Plat approval to subdivide a 4.86 acre parcel into
two parcels of 2.40 acres and 2.4E acres located at 1.749 South Greeley
Street in the Industrial Park. Industrial, IP --I and Single Family
Residential R -A Districts. Mr. Welch and John Ogren as applicants
addressed the separation of parcels and imp 1 i cat ions in the event of
different owners. Mr. Ogren does not plan to develope the property
behind his site and in the event of transfer of ownership felt the new
owners would insist or, access to the property as a condition of
ownership. Swager owns the property on the other boundary line.
There is proposed a Sig ft. right -cif -Ajay access to the rear R --A zoned
parcel "B".
At present the property is zoned part residential and
part industrial and the proposal will subdivide the property approximately

OTHER BUSINESS
Steve Russell presented commissioner with up-to-date zoning ordinances
and zoning maps. The materials were reviewed and cedes clarified in
varioUs zoning districts.
Discussion followed on garage setback requirements.
Mr. Russell passed out a list of existing regulations regarding garage
setbacks and some Suggested changes for coriimission consideration.
Commissioners will review the changes and come back with suggestions for a
revised ordinance to be drafted.
Discussion on the steepness of the slope of the land for new Structures
was discussed at length.
The meeting was adjourned at approximately 9:45 by a motion from
Rob Hamlin, second by Nancy Putz.
