IN THE COUNCIL CHAMBERS OF CITY HALL, 216 NORTH FOURTH STREET. AGENDA Approval of Minutes - August 18, 1986. PUBLIC HEARINGS: 1. Case No. 668 - Special Use Permit for modification of approved plans for larger free standing sign at 2500 West Orleans Street, Erickson Post, in the R -A Single Family Residential District - Suburban Lighting, Applicant. 2. Case No. 670 - Variance request to the front yard setback requirements for construction of garage addition and Special Use Permit for constructing oversized garage at 2106 Fairmeadows Road in the R -A Single Family Residential District - James Hanley, Applicant. 3. Case No. 671 - Variance request for a 56 inch high fence in the front yard setback area (maximum height 42 inches) at 320 West Laurel Street in the R -B Residential Duplex District - Barb Ertle, Applicant. 4. Case No. 666 - Preliminary Plat approval for a five lot subdivision subdividing one 24.3 acre lot into lots of 6.6, 4.4, 3.3, 5.2 and 4.9 acres located NE of the corner of County Road #5 and West Orleans Street in the PUD District - Arkell Development, Applicant. 5. Case No. 667 - Final Approval to second phase PUD, Cottages of Stillwater, for 60 housing units for Seniors located NE of the intersection of County Road #5 and West Orleans Street in the PUD Planned Unit Development District - Arkell Development, Applicant. MEMBERS PRESENT: Dean Miller Don Valsvik Judy Curtis Helen Miller Gerald Fontaine Nancy Put z Rob Hamlin Jean Jacobson Steve Russell, City Planner Also present Jay Kimble All members present, the meeting was called to order by Chairman, Dean Miller at 7 p.m. APPROVAL OF THE MINUTES Motion t� � approve the minutes of August 18, 1986, subject to corrections, by Don Valsvik, seconded by Judy Curtis. The following stand corrected: 1. Don Valsvik corrected as present. c_. Case 663, Special Use Permit, Elizabeth Larey applicants, corrected to Case 662. 3. Case 661, Mrs. Stanek, 612 N. 4th St., corrected t Miss Grace Stanek.. 4. Case 6611 condition 11, revised to include commercial Use. Dean Miller, Chairman, reported to members on the City Council actions. CASE 668 Special Use Permit Applicant Ray Remick, Suburban Lighting, and Andy Cast, Erickson Post, presented plans for approval of modification to an existing free standing sign, 2500 West Orleans St., Erickson Post, in the R -A Single Family Residential District. Mr. Remick described the modification and displayed pictures of the proposed signs to members. The sign would be 120 sq. ft. free standing, internally illuminated, with 10" letters. Mr. Remick compared other signs in the area, one of which is 184 sa. ft. and another 230 sq. ft. No audience comment. Discussion followed. Don Valsvik motion to approve, Nancy Putz second. Rob Hamlin opposed. Motion approved. CASE 670 Variance and Special Use Permits James Hanley, applicant, 2106 Fairmeadows Read, request to construct a 2214" x 26 ' garage addition to an existing tuck -under, two car garage. The new garage and need for variance, as explained in a letter of application, is to protect existing pipes from freezing. Applicant stated he would close off part of the existing garage to come under the 750 sq. ft. Special Use Permit requirement for oversized garages. Following discussion, Mr. Ray Remick, 301 Crestwood Terrace, adjacent property owner, expressed no objections to the proposed addition as a neighbor. Don Valsvik addressed the issue of the building cedes to Steve Russell, Planner. Discussion followed, with no further audience comment. Rab Hamlin motion to approve limited to 750 sq. ft. total garage space. Judy Curtis seconded. Gerald Fontaine abstained. Unanimously approved. CASE 666 Preliminary Plat Approval Arkel 1 Development Corporation, applicant, (NE Corner of Intersection of County Rd. ##5 and West Orleans, request for major subdivision plan. Paul Keleher, Project Director, presented an update on five lot subdivision, subdividing on 64.3 acre lot into lets of 6.6, 4. 4, 3.3, 5.2l and 4.9 acres located in the PUD Residential District, zoning R -A. The subdivision is a continuation of the Cottages of Stillwater Planned Unit Development. The current application proposes the division of the remaining 24.35 lots as follows: USE LOT ACRES 102 Apartments Lot 1 Block. 1 6.6 Community Center Lot 2 Block 1 4.44 Commercial Lot 3. Block 1 3.26 60 Units Housing Lot 1 Block 2 5.16 56 Units Housing Lot 2 Block S (Nancy Putt questioned the number of turn lanes in both directions on County Road #5, condition of approval #2, as reviewed by the City's Consulting Engineers. Lengthy discussion followed on traffic problems and members requested Steve Russell to investigate the condition for approval, before city council review. Motion to approve by Gerald Fontaine, seconded Don Va 1 svi k, unanimously approved. CASE 667 Final PUD Approval Arkell Development, applicant, request for Final Approval to second phase PUD, Cottages of Stillwater for 60 housing units for Senior Citizens, NE intersection of County Read #5 and West Orleans Street in the PUD Planned Unit Development District. Following review of the access for the Stillwater Fire Dept. by Jay V irtible, discussion followed. Motion to approve by Judy Curtis, seconded by Jean Jacobson. Unanimously approved. CASE 671 Variance Variance request for a 56 inch high fence in the front yard setback area, 320 West Laurel St., R -B Residential District, Barb Ert le applicant riot present. Mr. Richard Schubert, 318 Laurel St., owner adjacent property, Presented raernbers a picture of the East side of the property and stated object ions to the existing fence near a public sidewalk. Mr. Schubert stated objections due to the narrow street, numerous children in the area, and visibility problems, along with the problem of snow refloval in the winter months. Members requested the City Planner to check ether municipalities regarding penalties for violations. Discussion followed. Rob Hamlin motion to deny application, seconded by Gerald Fontaine, unanimous. Members adding that both the position and height of the fence should be in compliance. OTHER BUSINESS Discussion followed on the Infrastructure Study for the City of Stillwater, with Jay Kimble answering questions regarding the possible improvements being looked into by the City Council.
