THE STILLWATER PLANNING COMMISSION WILL MEET ON MONDAY, OCTOBER 20, 1986 AT

PUBLIC HEARINGS:
1. Case No. 672 - Special Use Permit for a mail order business operated out
of a residence at 2847 Woodridge Lane in the R -A Single Family Residential
District. Bansri D. Mehta, Applicant.
2. Case No. 673 - Special Use Permit and Conditional Use Permit for existing
Marina and for the construction of a 2,400 square foot storage building
located at 514 East Alder Street in the R -B Residential Two -Family and
Bluffland/Shoreland Districts. Lynn Wolf, Wolf Marine, Inc., Applicant.
3. Case No. 674 - Special Use Permit for a musical instrument reconstruction
and repair business operated out of a residence at 602 Sunrise Avenue in

4. Case No. 675 - Variance for construction of a deck and steps in the

APPROVAL OF THE MINUTES
Motion to approve the minutes of September 15, 1986, subject t� i
corrections by Judy Curtis, seconded by Jay Kimble. Case 668 Andy Cast
correction to read Andy Kass.
Dean Miller reported on actions by Laity Council.
CASE 672
Soecial Use Permit
Mr. Gary Schurrer, representing Ban<sri. Mehta, presented
information regarding the request for a mail order business operated
out of a residence at 2847 Woodridge Lane, a R -A Single Family
Residential District.
The applicant occupies the home and intends to advertise the sale
of leather g000s, cards, and keyehalns through magazines and no
customers would frequent the residence.
Motion to approve subject to conditions, by Gerald Fontaine.
Seconded by Judy Jacobson. Unanimously Approved. Conditions are as
follows:
1. No advertising signs.
2. No display or outside storage.
3. No commodity (good or services) sold on premises.
4. No employees except for residents of dwelling.
G. No excessive pedestrian, automobile or truck traffic to the
dwelling.
7. Applicant must have permission from owner of dwelling unit, if
not applicant.
8. Applicant must be resident of the dwelling.
7. Applicant may have nameplate not to exceed one (1) souare foot
in size.
10. The use permit shall be reviewed upon complaint.
CASE 673
Special Use Permit and Conditional Use Permit
Lynir, Wolf, Wolf Marine, Inc., request permit for construction ion ref
storage building for marina use at 524 East Alder Street. The wood
frame building will be used for storing equipment necessary to operate
and maintain the marina. Plans were submitted for members insrection.
Conditions for approval are as follows:
1. Evergreens shall be planted along the East, South and West
sides of the site as approved by the Community Development
Director.
2. The billboards shall be removed before a building permit is
issued.
3. The marina plan shall be submitted showing the location and
uses on site.
4. The site shall be fenced with solid beard six ft. fence if
trailers on other materials are stored outside.
5. DNR Conditions:
a. The building height should not exceed 35 ft.
b. The structure is painted earth � �r summer vegetation
tones.
C. The building is used for marina machinery storage only.
No in -out dry storage operation shall be permitted.
d. If any use of the new building is proposed to change in
the future, the Special Use Permit must by amended.
Brad Kress expressed concerns regarding the location and height of
the building. Discussion followed. Motion to approve by Gerald
Fontaine, seconded by Nancy Putz. Approved.
CASE 674
Special Use Permit
Thomas Crawley request for .r ho me musical instrument reconstruction
and repair at 602 'Sunrise Avenue. Applicant described the use as a
workshop with sales and business conducted through business contacts
rather than customers at the residence.
Conditions of approval:
1. No advertising signs.
c. Not display or outside storage.
3. No commodity ( goods or services) sold on premises.
4. No objectionable equipment, noise or odor.
S. Applicant must have permission from owner of dwelling _snit, if
not applicant.
7. Applicant may have nameplate not to exceed on square foot in
size.
B. This special use permit shall be reviewed by the Planning
Commission upon complaint.
9. One vehicle used for business may be stored on or off site in
the vicinity of the use.
Discussion followed. Motion the approve subject to conditions, by
Nancy,. Putz, seconded by Judy Curtis.
CASE 675
Variance to front yard setback.
Fred and Patricia Kalinoff request for variance to front yard
setback for construction �n of a deck and stairs at 106 Lakeside Drive, in
a R -B Single Family District. The lost slopes up to the house and the
deck. would extend out ten feet, with steps down to the driveway on the
South. The zoning_ ordinance requires a 30 ft. front yard setback.
Discussion Xn followed without audience comment. Motion to approve
subject to conditions by Gerald Fontaine, seconded by Jean Jacobson.
Unanimously approved. Conditions are as follows:
1. Shrubs shall be planted or lath used to conceal the deck
supports.
c. The deck and stair railing shall be ooen.
CASE 676
Conditional Use Permit
Applicant Richard J. Anderson, 306 West Olive Street, public
hearing request for conditional use permit for the operation sof a
Berl & Breakfast. The Nontransferable Special Use Permit has previously
granted by the City Council in 1985. Applicant does not intend to
change the present business activity and intends to sell the property.
Lengthy audience discussion followed. Leo Lohmer, neighbor,
questioned enforcement of conditions and the difference between a hotel
and a Bed & Breakfast. John Phuette questioned the distinction between
permanent and temporary housing. Mr. Ert le recommended approval and
limiting the number and size sof the operations and control of the
situation. Numerous concerns were presented, including, enforcement of
violations, maxifllum stay of guests, 1iquor sales and consumption,
parking, and management. It was suggested the guests be allowed a
maximum stay of seven days at a time, however, Mr. Anderson expressed
objections to this stipulation.
Following commission discussion, members agreed clarification of
conditions by Council was needed. Members approved motion by Gerald
Fontaine to approve the application subject to City Council
clarification fore Bed & Breakfast conditions. Seconded by Judy Curtis.
Jean Jacobson and Nancy Put z opposed. Approved.
CASE 677

request for final approval for construction of 56 units in Cottages of
Stillwater. The project is consistent with the Concept PUD approval
and the third phrase would be in conjunction with sewer service. Upon
recommendation of more parking spaces for the added twos—bedro� n units,
Mr. Kel iher stated there would be additional spaces provided, a total
of 79 spaces.
Discussion followed with no audience comment. Motion to approve
by Nancy Put z subject to staff recommendations ions as to parking, seconded
by Jean Jacobson. Unanimously approved.
CASE 678 & 679
Comprehensive Plan amendment and Request for Zoning Ordinance

Applicant Gary Swager reviewed Comprhensive Plan Amendment,
changing 4.71 acres of land from Industrial/Commercial to residential
apartment property located behind Warehouse Market North of Highway 36
Frontage Road and West of Oak Park Heights city boundary.
would change. Mr. Swager also explained request for rezoning the same
property from IP -C Industrial Park Commercial to RCM Medium Density
Multi -Family Residential property. The purpose of the discussion was
to explain the current situation and to provide information. Mr.
Swager did not request commission approval at this meeting.
Discussion followed with audience participation. Concerns were
expressed regarding road access, fencing around any development,
current juvenile problems, and other property owners in the area.
Following discussion, motion by Jean Jacobson to continue i.nue the
r=equest for study on land use and circulation on the entire area. Mr.
Swager would like the request for his property only. Gerald Fontaine
seconded the motion. gin. Approved.
CASE 680 --Request for Special Use Permit Withdrawn.
OTHER BUSINESS
UPDATE ON ACCESSORY BUILDING ZONING ORDINANCE AMENDMENT received
at the September 16th meeting. Mr. Russell discussed with
commission members the ordinance which will go into effect 30 days
after City Council approval.
REVIEW OF TEMPORARY USE OF CONNOLLY SHOE BUILDING for temporary
use by the Library for approximately 6-8 months. City Council review
is required due to the current use of the building for light
manufacturing. Discussion followed on parking and inspection by the
Fir -•e Marshall and Building Officials. Nancy Putz motion to approve
recommendation n to City Council for temporary housing on the second
floor of the Connolly Building. Jean Jacobson second. Approved.
SIGN ORDINANCE AMENDMENT for polital signs was discussed upon
request by City Council. Steve Russell, CDD, will review regulations
in the surrounding area and renort to commission.
ANNEXATION INITIATION by City Council regarding certain "islands"
of land surrounded by the City of Stillwater. The City has requested
the assistance of the Township in affecting the annexations in the area
adjajent to Mid Oaks Ave. This area is completely urban in nature with
city streets, sewer, water, and police and fire. The annexation of
this land would facilitate future maintenance and upgrading of Mid Oaks
and Interlachen Ave. Discussion followed.
STREET PLAN for 62nd Street and Adjacent Area as part of the
Woodland Lakes project design, Curve Crest Blvd. Commissioner
recommendation to City Council review of improvements in the area with
the Township to provide access for development on the West Side of
County Rd. #5 and to minimize intersections with County Road #5.
Motion by Judy Curtis, second by ,lean Jacobson, unanimously approved.
Dean Miller discussed upoomming Annual Planning Institute and
Chamber of Commerce meetings with members. Interested members are to
contact Steve Russell regarding details.
