Case No. SV/87-1 - Petition for street vacation of a portion of the North side of East Hudson Street between Fifth and Sixth Avenues. Peter and Eve Furseth, Petitioners. (See related Case V/87-26). 2. Case No. V/87-26 - Request for a variance to the side yard setback requirement (two feet proposed, 20 ft, required) for construction of addition/garage with living space above in the RB Residential Duplex District at 809 South Sixth Avenue. David Peroceschi, Applicant. 3. Case No. SUP/V/ 87-28 - Request for Special Use Permit for Stillwater Yacht Club Master Plan including tennis court, swimming pool and variance to the land area coverage requirement to paving parking areas at the Stillwater Yacht Club, 222 East Mulberry Street in the RB Flood Plain/Bluffland/Shoreland District. David Carlson, Applicant. 4. Case No. SV/87-2 - Request for street vacation of Interlachen Drive approximately 600 ft. East of the intersection of Maryknoll and Interlachen to West Olive Street. Gerald Fontaine called the meeting to order. PUBLIC HEARINGS: CASE NO. SV/87-1 A street vacation request for a portion of the North side of Hudson Street between South Sixth Avenue and South Fifth Avenue in the R -B Residential Duplex District at 809 South Sixth Avenue. David Peroceschi, Applicant. David Peroceschi presented the request for Peter and Eve Furseth, Petitioners. He explained that he is the Furseth's son-in-law and is living at 809 South Sixth Avenue - along with his family. He noted that his reason for living. at this address was his in-law's ill health. He wants to build an addition to the home because it is too small at the present time. The vaca aovi would give him adequate room for building. The vacation is to reduce Hudson Street by five feet. It is presently 34 feet. A two-way right of way is 24 feet. Jim Poynter, a neighbor expressed concern about his access to a garage on Hudson Street. He also wants the access for plowing in the winter. After discussion by the Commission and reviewing the plans, a conclusion was made that he wouldn't be affected. The Commission discussed conditions to the vacation. Dean Miller made a motion that the request be approved with a condition that it be reviewed by NSP and Public Works. Second by Don Valsvik. Approved 7-0. 1 CASE NO. V/87-26 A variance request of 27 feet to the 30 feet corner side yard setback requirement. The proposed addition is located two feet from Hudson Street in the R -B Residential Duplex District at 809 Sixth Avenue South. David Peroceschi, Applicant. David Peroceschi presented the request as a related item to the street vacation (Case No. V/87-1). He stated that the addition would give his family a larger living space and increase the value of the home. The plans include a double garage, larger kitchen and bedroom. Motion by Don Valsvik with the condition that it be reviewed by Public Works and NSP. Second by Jean Jacobson. Approved 7-0. CASE NO. SV/870-27 Variance request to locate an above ground swimming pool in the side yard in the R -B Multi Residential District at 821 South Third Street. Robert Sandelands, Applicant. Robert Sandelands, the owner of the property, presented the request. He stated that he must locate the pool in the side yard because of the location of the garage and driveway. The above ground pool would be 16' x 24' with a security fence around the area. Mr. Conners, a neighbor, expressed concern about the noise, safety and drainage caused from a pool. He does not want his basement to flood. Motion by Dean Miller. Second by Rob Hamlin. Approved 7-0. CASE NO. SV/87-2 Vacation of Interlachen Drive approximately 600 feet East of Maryknoll Drive and Interlachen intersection as shown on the subdivision plan for the Interlachen Hills Third Addition in the RA Single Family District. Interlachen Company, Applicant. Developper's. Representative '11131f-7 Dale Beckman, the Beve}eper, presented the project and discussed the updated proposal for the Interlachen Hills Third Addition (Second Phase). He was also at the meeting to answer questions from the public on Case No. SV/87-24. Jim Himer, a resident, expressed concern about the traffic on Maryknoll. Martin Mueller, a resident, questioned a vacation of Olive to the end of Interlachen (Lot 17 and tie in with Meadowlark Park). Tyler Smith, a res.i;_dent, questioned Lot 8 and the, easement setback standards. F Dick Mulemaster questioned the elevation of lots from the pond and wondered if the retaining wall could be eliminated with a steeper grade on the road. Jack Rider expressed concern about a drainage easement on the back of some properties behind Croixwood. Tim Collins expressed concern about a cul-de-sac design on Crestwood. Motion by Judy Curtis with the following conditions: 1. Utility easements shall be provided as requested by NSP and City utilities. 2. A right of way for a pedestrian pathway shall be provided from Interlachen to Meadowlark Park and Crestwood Terrace. 3. Lot 9 and 1/2 of 10 shall be purchased by the Developer (as park dedication requirement) and/or City for expansion of Meadowlark Park. 4. An agreement shall be entered into between the Owner of Lot #8 and the Developer to provide access to the lot. 5. Passe s en Ion by Nancy Putz. CASE NO. SV/87-24 Preliminary Plat Approval for a 39 lot subdivision in the R -A Single Family Residential District. Interlachen Company, Applicant. The project is a revised proposal from discussion and comments at the meeting of May 11, 1987. Dale Beckman, the Developer, presented the project and answered questions (See Case SV/87-2). CONDITIONS: 1. Conditions from SV/87-2. 2. Lot #22's elevation shall be lowered to 438.5. 3. The final cul-de-sac design for Crestwood Terrace shall be modified and approved by the City's Consulting Engineer. 4. The Developer shall increase the grade of Interlachen Way Circle as required by the City Council to eliminate the retaining walls on Lots 9 and 10. Motion by Judy Curtis. Seconded by Dean Miller. Putz. 3 6-0. 1 abstention 7/13/x'7 Passed -7-0= Abstention Nancy CASE NO. SUP/87-28 Variance and Special Use Permit for the Stillwater Yacht Club including addition of swimming pool, tennis court and paving over 20% of the North area with an impervious surface. The site is located at 222 East Mulberry Street in an R -B Marina/Park District. David Carlson, Applicant. Charles Stone, Attorney representing the Stillwater Yacht Club and David Carlson presented the plans. He described the plans including paving the South area launch ramp roads and landscaping, paving the North boat storage and parking areas, addition of a swimming pool and tennis court. The applicant indicated that storm water runoff would run over the bank into the river as it currently does. A minimum 12 foot green landscaped area along the river bank would filter the runoff before it flows into the river. As an alternative, the applicant indicated that runoff could be directed to catch basins and piped under the bank into the river. A sedimentation trap could be provided to filter runoff before the water enters the river. The Staff report suggested having a pedestrian path along the river bank in the green open space area. This would continue public access to the river that eventually will begin at Sunnyside Marine and continue to Muller Point. It was pointed out a recorded pedestrian easement was required as a conditon of the Dock Cafe approval. The Commission discussed the pathway idea. They felt pedestrian access along the river was important, land could eventually tie in with an overall plan when the Downtown Area Plan is prepared. Concerns were expressed by the applicant for security of the boats. It was suggested that security gates and time limits could be used to manage access. The applicant wondered who would be liable for injuries along the path. Staff indicated that if the pathway was the City's, it would be the City's responsibility as it is along other sidewalks. After further discussion, the Commission decided the Council should consider the requirement for the pathway with input from the City Attorney regarding the legal authority of the City. Other areas discussed was need for additional details plans showing final paving, drainage, landscaping, fencing, green zone treatment as required by Condition #1 below. Condition: 1. A site plan showing the details of landscaping (plant materials and size), fencing (location and design), green zone treatment, pathway location and final drainage and paving plan. 2. The drainage plan shall provide for the direction of runoff to catch basins filtering sediment and parking runoff under the river bank to the river. 3. Upon request by the City, additional trailer car spaces shall be provided to accommodate trailers of boats launched from the Muller Point launch ramp. 4 4. That the City be granted an exercisable easement for a four foot pedestrian path in the green zone along the river bank. (The pedestrian path could not be used until it is accepted by the City and improved). 5. Mechanical equipment for the swimming pool shall be elevated above the flood level. Motion by Don Valsvik. Second by Dean Miller. Approved 7-0. Development Staging Plan The Staging Development Plan for Annexation with the Township and the City was discussed. It was rejected as it was in 1985.
