Phil Easton, being duly sworn, on oath says he is publisher and printer of the
newspaper known as Stillwater Evening Gazette and has full knowledge of the
•facts herein stated as follows: (1) Said newspaper is printed in the English
language in newspaper format and in column and sheet form equivalent in printed
space to at least 900 square inches. (2) Said newspaper is a daily and is distributed
Monday through Friday of each week, except holidays. (3) Said newspaper has
50% of its news columns devoted to news of local interest to the community which
it purports to serve and does not wholly duplicate any other publication and is not
made up entirely of patents, plate matter and advertisements. (4) Said newspaper
is circulated in and near the municipality which it purports to serve, has at least
500 copies regularly delivered to paying subscribers, has an average of at least
75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post office. (5) Said newspaper
purports to serve the City of Stillwater in the County of Washington and it has its
known office of issue in the City of Stillwater in said county, established and open
during its regular business hours for the gathering of news, sale of advertisements
and sale of subscriptions and maintained by the publisher or persons in his employ
and subject to his direction and control during all such regular business hours and
at which said newspaper is printed. (6) Said newspaper files a copy of each issue
immediately with the State Historical Society. (7) Said newspaper has complied
with all the foregoing conditions for at least two years preceding the day or dates of
publication mentioned below. (8) Said newspaper has filed with the Secretary of
State of Minnesota prior to January 1, 1966 and each January 1 thereafter an af-
fidavit in the form prescribed by the Secretary of State and signed by the -publisher
and sworn to before a notary public stating that the newspaper is a legal
newspaper.
He further states on oath that the printed. Resolution 4419

RESOLUTION EST 'LISHING THE OFFICE OF PUBLIC
SAFETY DIRECTOR. AND DEPARTMENT OF PUBLIC SAFETY
AND DEFINING THE DUTIES AND RESPONSIBILITIES THEREOF.
WHEREAS The City Council of the City of Stillwater has determined that
the efficiency of function of the Police Department and the Fire Department of the
City of Stillwater and the best interests of the City would be furthered by com-
bining the supervision of those departments under one head, NOW, THEREFORE,
BE IT RESOLVED That the position of Public Safety Director and Department
of Public Safety are hereby established in the City of Stillwater, said Department
to include all functions heretofore included within the resoonsioilities of the
Police Department and the Fire Department of said. City, included but not limited
to the protection of all persons and property through the prevention and detection
of crime, the prevention and investigation of accidents, the prevention and suppres-
sion of civil disorders, the prevention and control of fires, the maintenance of
emergency services for the City of Stillwater, and the preservation and protection
of the general public safety and welfare of the residents of the City of Stillwater
through the enforcement of all Statutes of the State of Minnesota and Ordinances
of the City of Stillwater.
The Public Safety Director shall be in charge of the responsibilities of
said Department and shall divide the personnel and the responsibilities of said
personnel into functions which correspond with the present Police Department and
Fire Department of the City of Stillwater. It shall be his responsibility to co-
ordinate the activities of said Departments and the assignment of the personnel
within those Departments to the best interests of the City and in such manner as
to promote the maximum efficiency of each function and of the combined functions.
He shall recommend to the City Council such rules and regulations for operation of
the Department of Public Safety as may be required to promote the most effective
•service to the residents of the City of Stillwater. It shall be his responsibility
to recommend annually to the City Council a budget for the operation of the Depart-
ment of Public Safety.
The Director of Public Safety shall, subject to the supervision of the
City Council, have supervision of all personnel, employment and property of the

City associated with the currently existing Fire Department and Police Department.
Said Director shall make recommendations to the Council relative to promotions,
hirings and discharges. The Director of Public Safety shall have the authority to
suspend, for cause, personnel within his Department, with or without pay, for a
period of not to exceed thirty (30) days subject to the right of appeal
to the City Council.
Adopted by the City Council of the City of Stillwater, Minnesota the 21st
day of April, 1970.
