HomeMy WebLinkAbout2017-218 (concept planned unit development for our saviors lutheran church and ecumen cpc case no. 2017-25) RESOLUTION 2017-218 CITY OF STILLWATER WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING PRELIMINARY PLAT FOR ECUMEN STILLWATER/OUR SAVIOR'S LUTHERAN CHURCH CASE NO. 2017-48 WHEREAS, Anne Stanfield of Ecumen and Pastor Dale Stiles of Our Savior's Lutheran Church ("applicants") have submitted an application for the development of the properties located at 114 Brick Street South and 1616 Olive Street West, legally described on Exhibit A, and are requesting approval of: 1) Final Planned Unit Development for the Current Phase: Ecumen Stillwater 2) Preliminary Plat for Ecumen Stillwater/Our Savior's Lutheran Church, as depicted on Exhibit B 3) Final Plat for Ecumen Stillwater/Our Savior's Lutheran Church 4) Special Use Permit for Senior Living Facility in the RA,One-Family Residential Zoning District WHEREAS, on October 11, 2017 the Planning Commission held a public hearing on the associated requests and, upon hearing testimony from the public, recommended conditional approval; and WHEREAS, on October 23, 2017 the Park and Recreation Commission discussed the associated requests and recommended conditions of approval; and WHEREAS, on November 7, 2017 the City Council held a public hearing on the requests and found them to be compatible with the neighborhood and consistent with the City's Zoning Ordinances, Subdivision Ordinances, and Comprehensive Plan. NOW,THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby approves the Preliminary Plat for Ecumen Stillwater/Our Savior's Lutheran Church,as depicted on Exhibit B,with the following conditions: 1. Prior to the release of the Final Plat from the City, the applicant shall: a. Submit for review and approval by the City Attorney copies of: Case No.2017-48 Preliminary Plat CC:11/7/2017 Page 2 of 4 i. All covenants and scenic and conservation easements relating to the provision, use and maintenance of common open space including wetlands and wetland buffer areas. ii. Conservation, drainage and utility easements, determined and found acceptable by the City of Stillwater and the Middle St. Croix Watershed Management Organization. iii. A cross access, use and maintenance agreement for all shared parking and driveway areas. b. Enter into an agreement with the City for access,use and maintenance of the City owned trail to ensure upgrades and year-round fire department access is achieved. c. Shall be responsible for payment of all required park and trail fee-in-lieu, as determined by the Park and Recreation Commission.
